R11242ATTACHMENT C 1 City Council Meeting: April 14, 2020 Santa Monica, California RESOLUTION NUMBER 11242 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DESIGNATING AUTHORIZED REPRESENTATIVES TO ACT ON BEHALF OF THE CITY OF SANTA MONICA TO APPLY FOR STATE OR FEDERAL DISASTER RELIEF FUNDING RELATING TO COVID-19 AND TO APPLY FOR STATE, FEDERAL, OR PRIVATE GRANTS SUPPORTING COVID-19 RELIEF WHEREAS, international, national, state, and local health and governmental authorities are responding to an outbreak of respiratory disease caused by a novel coronavirus named “SARS-CoV-2,” and the disease it causes has been named “coronavirus disease 2019,” abbreviated COVID-19, (“COVID-19”); and WHEREAS, on March 4, 2020, the Los Angeles County Board of Supervisors and Department of Public Health declared a local emergency and local public health emergency to aid the regional healthcare and governmental community in responding to COVID-19; and WHEREAS, on March 4, 2020, the Governor of the State of California declared a state of emergency to make additional resources available, formalize actions already underway across multiple state agencies and departments, and help the State prepare for the broader spread of COVID-19; and WHEREAS, on, before, and after March 4, 2020, the City actively planned and implemented measures to prevent the spread of COVID-19 and to prepare for any and all emergency actions in response to the spread of COVID-19; and DocuSign Envelope ID: EB456964-B550-4A6E-9E26-8A5C25B1FED0 ATTACHMENT C 2 WHEREAS, on March 13, 2020, the City Manager, in his role as the Director of Emergency Services, issued an Executive Order declaring the existence of a local emergency pursuant to Chapter 2.16 of the Santa Monica Municipal Code; and WHEREAS, on March 13, 2020, the President of the United States of America declared a national emergency and announced that the federal government would make emergency funding available to assist state and local governments in preventing the spread of and addressing the effects of COVID-19; and WHEREAS, the national and state declarations described above entitle the City to potentially receive certain federal financial assistance under Public Law 93-288 as amended by the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988, as administered by the Federal Emergency Management Agency (“FEMA”), and state financial assistance under the California Disaster Assistance Act, as administered by the California Office of Emergency Services (“Cal OES”); and WHEREAS, Cal OES requires localities to adopt a resolution identifying authorized agents to pursue federal and state disaster relief funding and to list these authorized agents on a Cal OES Form 130 (“Form 130”); and WHEREAS, the completion of a Form 130 is a prerequisite before any federal or state disaster aid can be provided to the City; and WHEREAS, on September 29, 2015, City Council adopted Resolution No. 10914 (“Resolution 10914”) which authorized the City Manager, the Assistant City Manager, and the Director of Finance to act as authorized agents in connection with a Form 130 submitted in 2015 for a period of three years; and WHEREAS, Resolution 10914 expired on September 29, 2018; and DocuSign Envelope ID: EB456964-B550-4A6E-9E26-8A5C25B1FED0 ATTACHMENT C 3 WHEREAS, in response to COVID-19, the City must submit to Cal OES a new Form 130 before any state or federal disaster relief funding can be provided to the City; and WHEREAS, the City desires to identify the same city staff positions identified in Resolution 10914 to act as authorized agents on a forthcoming Form 130, and WHEREAS, in addition to federal and state disaster relief funding under state and federal law, the City may be eligible to obtain federal, state, and private grants and other funding opportunities (“COVID-19 Grant Opportunities”) for the benefit of the City’s ongoing COVID-19 recovery and response efforts; and WHEREAS, the City intends to pursue various COVID-19 Grant Opportunities; and WHEREAS, Santa Monica Municipal Code section 2.24.240(a) authorizes the City Manager, the Emergency Services Manager, and the Purchasing Agent to apply for grants and aid during a local emergency and to execute documents necessary to obtain such grants and aid without further action from City Council; and WHEREAS, Santa Monica Municipal Code section 2.24.240(b) authorizes the City Manager, the Emergency Services Manager, and the Purchasing Agent to delegate their authority to pursue grants and aid during a local emergency; and WHEREAS, on April 9, 2020, the City Manager delegated his authority to pursue COVID-19 Grant Opportunities to the Emergency Operations Center Finance Section Chief, and staff acting under her direction, during the pendency of the COVID-19 emergency. DocuSign Envelope ID: EB456964-B550-4A6E-9E26-8A5C25B1FED0 ATTACHMENT C 4 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Manager, Assistant City Manager, and Finance Director are hereby designated as the City’s authorized representatives to be identified on a forthcoming Form 130 to obtain federal and state disaster assistance from Cal OES and FEMA in connection with COVID-19 and any subsequent local emergencies for a period of three years. SECTION 2. The Emergency Operations Center Finance Section Chief, and City staff acting under her direction, are authorized to pursue and execute any documents necessary to apply for and obtain any COVID-19 Grant Opportunities without further action from City Council. SECTION 3. In the event the City succeeds in obtaining funding from any COVID-19 Grant Opportunities, the Finance Director, the Emergency Operations Center Finance Section Chief, and City staff acting under either of their direction, are authorized to make any necessary changes to the City budget to account for such funding without further action from City Council. SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect for a period of three (3) years.
