SECTIONS 9l29Fla l29Flal AND 9129Fl 4 FROM THE SANTA MONICA MUNICIPAL CODE PERTAINING TO OFF STREET PARKING REQUIREMENTS AND THE DEFINITION OF ADJUSTED FLOOR AREA THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS SECTION 1 Section 9102 of the Santa Monica Mun cipal Code s hereby amended to include a def n t on of adJusted floor area following the deflnit on of excessory livlng quarters and prior to the defin t on of admlnistrator wh ch definltlon shall read and be as follows for the purpose of Chapter 1 Article 9 of the Santa Monica Municipal Code and for such purpose shall be construed as here n set forth unless t s apparent from the context that a dlfferent mean ng s intended AdJusted floor area is the net floor space in a structure and shall include restrooms lounges kitchens partlt ons storage areas interlor and exterior hallways and corridors and the like but shall not lnclude exterlor and load bearlng walls sta rways and sta rwells elevators and shafts SECTION 2 Section 9129Fl of the Santa Monica Munic pal Code s hereby amended and shall read as follows 1 CA RL S jak e Hospitals Sanitariums Rest Homes Board and Care Facilities One 1 space for each two 2 beds or fractlon thereof In the computation of the total parking spaces required for any buildlng site fractlonal space shall be resolved to the next whole number B COMMERCIAL DISTRICTS Resldentlal Uses The same requirements as that for the Resldential Dlstrlcts shall apply CA CP C2 C3 C4 For buildings or additlons up to elght thousand 8 000 sq ft of adjusted floor area one 1 sq ft of parklng area for each sq ft of adJusted floor area or one 1 space for each three hundred 300 sq ft of adjusted floor area For buildings or additions in excess of eight thousand 8 000 sq ft of adJusted floor area one 1 space for each three hundred 300 sq ft of adjusted floor area Exceptlons Bowling Alleys Four 4 spaces per alley Restaurants Drive In Restaurants One 1 space p r one hundred 100 sq ft of adjusted floor area Food Markets in excess of five thousand 5 000 sq ft one 1 space per one hundred fifty 150 feet of adjusted floor area 3 CA RL9IS Jak Churches One 1 space per ten 10 f1xed seats or one 1 space per eighty 80 sq ft of floor area in places of assembly if no fixed seats Theatres Dance Halls Convention Centers Meeting Halls and Places of Assembly One 1 space per four 4 f1xed seats or one 1 space per e1ghty 80 sq ft of floor area 1n places of assembly 1f no fixed seats Trade Schools and Business COlleges One I space per one hundred f1fty ISO sq ft of adjusted floor area Schools Elementary Ten 10 spaces plus one 1 addit10nal space per classroom Jun10r High Ten 10 spaces plus one add1t1onal space per classroom High School Ten 10 spaces plus f1fteen 15 additional spaces per classroom Colleges Ten 10 spaces plus thirty 30 addit10nal spaces per classroom C INDUSTRIAL DISTRICTS Ml and M2 Industr1es One 1 space per three hundred f1fty 3S0 sq ft of adjusted floor area Warehouses and Storage BU1ld1ngs One 1 space per one thousand 1 000 sq ft of gross floor area Mortuar1es One 1 space per five 5 f1xed seats or one 1 space per forty 40 sq ft of floor area 1n places of assembly if no fixed seats Commercial Uses Requirements for 4 i L CA RLeIS Jak commercial uses shall be the same as the requirements for commercial d1stricts C CHANGE OF USE Noth1ng in this sect10n shall preclude a bU1ld1ng or structure from being changed or converted to another use hav1ng the same or a lower parking requirement but such bU1ld1ng or structure shall not be changed or converted to any use having a higher park1ng requirement unless addit10nal parking spaces equal to the higher requ1rements are provided such spaces to meet all other requirements of this chapter SECTION 3 Sect10n 9l29Fla of the Santa Monica Municipal Code is hereby deleted and repealed in its entirety SECTION 4 Sect10n 9129Flal is hereby deleted and repealed in its entirety SECTION 5 Sect10n 9129Fla4 of the Santa Monica Municipal Code 1S hereby deleted and repealed in its entirety SECTION 6 The C1ty Council of the C1ty of Santa Monica finds that the Planning Commission of the City of Santa Monica has held a public hearing on April 4 1977 regarding the changes made by th1S ordinance SECTION 7 The C1ty Counc1l of the City of Santa Mon1ca f1nds that the changes made by this ordinance are consonant with and compelled by public necessity public convenience general welfare and good zon1ng practice SECTION 8 Any prOV1S1ons of the Santa Monica Municipal Code or appendices thereto inconsistent herewith to the extent of such inconsistencies and no further are hereby repealed or modified to that extent necessary to effect the prov1sions of this ord1nance SECTION 9 If any section subsection sentence 5 CA RL IS Jak clause or phrase of th s ordinance is for any reason held to be nvalld or unconstltutional by a decision of any court of competent jurlsdict on such dec slon shall not affect the valid ty of the rema ning port ons of the ordinance The City Council hereby declares that it would have passed this ordinance and each and every section subsect on sentence clause or phrase not declared invalld or unconst tutlonal SECTION 10 The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance The Clty Clerk shall cause the same to be published once in the offlcial newspaper w thin f fteen 15 days after 1ts adoptlon The ordinance shall become effective after thirty 30 days from its adoptlon ADOPTION and APPROVED thlS 9th day of August 1977 J MJIYOR
