R11205City Council Meeting: October 22, 2019 Santa Monica, California RESOLUTION NUMBER 11205 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER TO EXECUTE A HISTORICAL PROPERTY CONTRACT WITH THE OWNER OF THE PROPERTY LOCATED AT 310-312 WILSHIRE BOULEVARD, SANTA MONICA IN ACCORDANCE WITH GOVERNMENT CODE SECTION 50280 AND SANTA MONICA MUNICIPAL CODE SECTION 9.56.270.G WHEREAS, California Government Code Sections 50280 et seq. authorize a city to enter into a historical property contract with the owner of any qualified historical property to restrict the use of such property so that it retains its historically significant characteristics in return for which the property owner obtains property tax relief; and WHEREAS, Santa Monica Municipal Code Section 9.56.270.G provides that designated Structures of Merit, Landmarks, and contributing structures located in Historic Districts that are privately owned and not exempt from taxation shall be considered qualified historical properties eligible to enter into historical property contracts with the City; and WHEREAS, Section 9.56.270.G further provides that the City Council shall, by resolution, approve a historical property contract with the owner of a qualified historical 1 DocuSign Envelope ID: 3A4E86B4-3CB1-499D-BFEE-F3A8D074CFE5 2 property, provided that the property meets all requirements set forth in Section 9.56.270.G; and WHEREAS, the property located at 310-312 Wilshire Boulevard is a designated City Landmark and the owner of the property has filed an application to enter into a historical property contract with the City; and WHEREAS, the City Council has determined that it is appropriate for the City to enter into a historical property contract with the owner of the property located at 310-312 Wilshire Boulevard. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby finds that, in accordance with Santa Monica Municipal Code Section 9.56.270.G: A. The property located at 310-312 Wilshire Boulevard has no confirmed and outstanding violations of the Santa Monica Municipal Code, or any other applicable Federal, State or local law, rule or regulation. B. The property located at 310-312 Wilshire Boulevard is not subject to a tax delinquency. C. All completed or ongoing alterations, construction or rehabilitation to designated buildings or structures located on the property located at 310-312 Wilshire Boulevard conform to the Secretary of Interior’s Standards for the treatment of Historic Properties. Pursuant to Santa Monica Municipal Code Section 9.56.270.G, the City Council authorizes the City Manager to enter into a historical property contract with the owner of the property located at 310-312 Wilshire Boulevard, Santa Monica, California in accordance with Government Code Sections 50280 et seq. SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
