Recommended Action
Staff recommends that the City Council:
1) Introduce for first reading the attached ordinance amending Chapters 4.62 and
4.63 of the Santa Monica Municipal Code to enhance investigato rs’ enforcement
authority and access to records.
2) Adopt a Resolution repealing and readopting the City’s administrative fine
schedule to establish fine amounts for violations of Santa Monica Municipal Code
Chapters 4.62 and 4.63.
3) Receive information on implementation of the minimum wage law’s service
charge and paid sick leave provisions.
Executive Summary
Santa Monica’s local minimum wage law has been in effect since July 1, 2016. Based
on two years of experience implementing and enforcing the law, staff recommends
amending the law to include stronger enforcement language, and adoption of a
resolution to increase administrative citation fines for minimum wage violations.
Additionally, this report provides information regarding staff’s efforts to establish
administrative rules and regulations related to service charges , as well as staff’s
interpretation of the paid sick leave provisions of the law.
Background
Council adopted Santa Monica’s local minimum wage law on May 10, 2016 (Attachment
C) and directed staff to monitor implementation and return with any recommendations.

At the time of the law’s adoption, the City did not have a dedicated wage enforcement
function and did not have prior experience with broad minimum wage law enforcement.
The City Council authorized the Los Angeles County Department of Consumer and
Business Affairs (DCBA) to enforce Santa Monica’s minimum wage law in June 2016
(Attachment D). On October 23, 2018, the City Council authorized a modification and
extension of the agreement with DCBA to provide enforcement services for up to 10
years.
On July 19, 2018, an Information Item (Attachment E) provided an update on the
minimum wage law, outlined activities and lessons learned during implementation, and
described next steps, including a shift from outreach to enforcement during the third
year of implementation.

Discussion
Following two years of minimum wage law implementation, staff recommends
modifications to the minimum wage law to assist enforcement efforts and increase
administrative citation fines. In addition, this report provides information regarding the
promulgation of administrative rules and regulations related to service charges, and
information about staff’s interpretation of the paid sick leave provisions of the law.
Enforcement

DCBA’s experience enforcing cases in Santa Monica and in Los Angeles County
suggests that stronger compliance language would improve enforcement efforts.
Most investigations require that an investigator review business records. The LA
County Wage Enforcement Ordinance includes language enabling County staff to
require a business to provide certain records (Los Angeles County Code Section
8.101.070 (C)). County staff are then able to cite and f ine businesses that do not
comply with an investigator’s requests. Santa Monica’s law requires businesses to
retain payroll records, including a record of service charge distribution, for three years
(Santa Monica Municipal Code Section 4.62.015 (g) and 4.62.040 (g)). However, the
ordinance currently does not specifically require a business to provide its records to
enforcement officials, nor is there an immediate penalty for a business that does not
comply. County staff rely on explicit authority in the County’s ordinance to facilitate
enforcement actions in its own jurisdiction and have identified several Santa Monica
cases for which similar authority would have been useful.
Requiring unconditional access to an employer’s records may infringe upon privacy
interests contained in certain categories of records, e.g., employee payroll records. This
privacy concern was recognized in a recent U.S. Supreme Court case, City of Los
Angeles v. Patel (2015) 135 S.Ct. 2443, relating to hotel guest records. Accordingly, in
order to balance the City’s legitimate interests in authorizing access to employer records
to improve upon the City’s ability to enforce its minimum wage law, and the privacy
interests of certain categories of employer records, staff proposes an approach that
would build in an administrative subpoena process. This process would be similar to the
administrative subpoena process set forth in the City’s home-sharing and vacation
rentals ordinance (Santa Monica Municipal Code Section 6.20.100). Through this
process, businesses would be entitled to a pre-compliance review before being required
to provide DCBA staff with access to records that may contain private information. Staff
intends to establish administrative rules that distinguish the types of records for which
the administrative subpoena process would apply. For example, business receipts may
not contain private information, in which case employers would be required to turn such
records over to DCBA investigators upon request, without the investigator needing to
first go through an administrative subpoena process. In contrast, for example, DCBA

investigators would need to use the administrative subpoena process in order to access
specific employee payroll records, on the basis that employees would have strong
privacy interests in their payroll information.
Additionally, staff recommends that employers be required to cooperate with
investigators, including allowing investigators to interview persons, including employees,
during normal business hours. These provisions are similar to the County’s ordinance.
The recommended ordinance amending Chapters 4.62 and 4.63 of the Santa Monica
Municipal Code, as explained above, are included as Attachment F.
Fines
All Santa Monica minimum wage violations currently carry the City’s default
administrative citation fine of $75. This approach reflected the City’s initial expectations
for the law’s implementation, as well as the newness of the law and its enforcement.
Staff now recommends that Council adopt higher administrative fines tailored to
particular minimum wage violations. The recommended amounts of fines reflect the
significance of the violation and constitute an additional incentive to comply with (or act
as a deterrent from violating) the minimum wage laws. The fines are consistent with
those established for parallel provisions in Los Angeles County’s minimum wage law.
Staff recommends that Council adopt the attached resolution establishing the fines and
violations in the table below:

Service Charges
Santa Monica is one of at least five California cities (i.e., Emeryville, Long Beach, Los
Angeles, and Oakland) that regulate service charges. How service charges are
currently defined and regulated in the Santa Monica Municipal Code is similar to and
broadly consistent with that of these other cities. As Council directed and approved
during the law’s development, service charge regulation serves the dual purpose of
consumer transparency and employee fairness: it requires that an y service charge be
clear and conspicuous to customers, and that all service charge revenue be distributed
equitably to employees providing the service.
Staff has received numerous inquiries related to service charge use from businesses
and employees leading up to and following the law’s adoption. Businesses in particular
have looked for clarity on what constitutes a “service charge”, how to handle surcharges
(other mandatory charges that customers are required to pay but are not specifically
titled service charge), and authorized language a business could use to ensure it is in
compliance with the law. Staff has provided consistent advice that points back to the
law’s language and Council’s intent.
In response to consumer concerns about service charges and to assist with ongoing
questions, staff plans to develop administrative rules and regulations, consistent with
other cities’ practices. The rules would define how a business may approach
establishing a service charge, including more specific requireme nts consistent with, but
not currently spelled out in, the law. The rules are intended to clarify requirements for
businesses and employees. Following promulgation of the administrative rules, staff will
continue to monitor concerns about service charges and will request Council action, if
needed.
Paid Sick Leave
Since the law’s adoption, paid sick leave questions have made up the majority of all
minimum-wage related inquiries. Paid sick leave is also an area where Santa Monica’s
legal requirements and administrative implementation are somewhat different from that
of other jurisdictions requiring paid sick leave.

Santa Monica’s law requires that employers provide an established amount of paid sick
leave hours that employees may use consistent with California state guidelines.
Additionally, SMMC Section 4.62.060(b) further prohibits employers from “directly
fund[ing] the wages and benefits required [by local law] by reducing the pension,
vacation, or other non-wage benefits of any Employee, or by increasing charges to
Employees for parking, uniforms, meals, or other work-related materials or equipment.”
Staff have consistently interpreted these provisions to mean that vacation or paid time
off (time that can be used for vacation or sick leave) could not be used to satisfy the
local law’s paid sick leave requirement. This also means that employers must provide
Santa Monica’s required paid sick leave hours in addition to any pre-existing vacation or
other paid time off hours. These requirements do not exist in other jurisdictions
requiring paid sick leave, including the City of Los Angeles. Some businesses believe
that these requirements disadvantage those businesses that provided vacation or paid
time off hours before the City passed the minimum wage law.
Staff believes that the current interpretation reflects Council direction and supports the
law’s goal of providing Santa Monica employees time to care for themselves and family
members and protecting overall community health. However, if Council wishes to revisit
paid sick leave policies, staff stands ready to receive and implement direction on such
efforts.
Financial Impacts and Budget Actions
Staff does not expect any significant budget impact related to the report’s recommended
actions. While the proposed fine amounts are above the default level, staff does not
anticipate any material or consistent associated revenue increase. The fines are meant
as a deterrent and not as a means to increase City revenue.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA AMENDING SANTA MONICA MUNICIPAL CODE CHAPTERS 4.62
AND 4.63 TO ENHANCE INVESTIGATORS’ ENFORCEMENT AUTHORITY AND
ACCESS TO RECORDS
WHEREAS, on January 26, 2016, the City Council of the City Of Santa Monica
adopted Ordinance No. 2509 (CCS), adding Chapter 4.62 to the Santa Monica Municipal
Code requiring a minimum wage for employees, and adding Chapter 4.63 to the Municipal
Code requiring a living wage for hotel workers; and
WHEREAS, on May 10, 2016, the City Council adopted Ordinance No. 2515
(CCS), amending Chapters 4.62, 4.63, and 4.65 of the Municipal Code relating to wage
alignment, first-time workers, paid sick leave, service charges, enforcement, and hotel
hardship waiver; and
WHEREAS, the City’s experience over the past two years in implementing and
enforcing the minimum wage and hotel living wage laws, in coordination with the Los
Angeles County Department of Consumer and Business Affairs, demonstrates that
enhancing enforcement capabilities and access to employer records would improve the
City’s ability to ensure fair working conditions and wages for employees in compliance
with local law; and thereby promotes the public health, safety, and welfare.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Santa Monica Municipal Code Section 4.62.100 is hereby amended
to read as follows:
4.62.100 Law enforcement access, remedies, and penalties.
(a) Records and Interview Access; Cooperation with Investigations. To
monitor and investigate compliance with the requirements of this Chapter, every
Employer shall cooperate with City-authorized investigators, including but not
limited to: accessing records, and allowing investigators to interview persons,
including Employees, during normal business hours.
(b) The City may issue and serve administrative subpoenas as
necessary to obtain specific information regarding minimum wage and benefits
provided to Employees pursuant to this Chapter, including, but not limited to,
records pertaining to each Employee that document the name, address,
occupation, dates of employment, rate or rates of pay, amount paid each pap
period, the hours worked for each Employee, and the formula by which each
Employee’s wages, sick leave, service charge distribution, and benefits, as
applicable, are calculated, to determine whether the Employer is in compliance
with this Chapter. Any subpoena issued pursuant to this section shall not require
the production of information sooner than 30 days from the date of service. A
person that has been served with an administrative subpoena may seek judicial
review during that 30-day period.

(ac) Unless otherwise specifically provided, any person violating any
provision of this Chapter shall be guilty of a misdemeanor, which shall be
punishable by a fine not exceeding $500 but not less than $150 per violation, or
imprisonment in the County Jail for a period not exceeding six months, or by both
fine and imprisonment, or shall be guilty of an infraction, which shall be
punishable by a fine not exceeding $250 but not less than $100 per violation.
Each such person shall be guilty of a separate offense for each and every day
during any portion of which any violation of any provision of this Chapter is
committed, continued, or permitted by such person and shall be punishable
accordingly.
(bd) Any person violating any provision of this Chapter or any rule or
regulation may be subject to administrative citation pursuant to Chapter 1.09 of
this Code.
(ce) Any person convicted of violating any provision of this Chapter or the
terms and conditions of any permit or approval issued pursuant to this Chapter
shall be required to reimburse the law enforcement agency that investigated the
violation its full investigative costs.
(df) Violation of any provision of this Chapter, with the exception of
Sections 4.62.060 and 4.62.070, shall be considered a strict liability offense;
accordingly, the prosecution shall not be required to prove criminal intent or that
the violator meant to violate any provision of this Chapter.
(eg) Prosecution for any violation of this Chapter, including the issuance
of any administrative citation or order, shall be commenced within three years

after discovery of the commission of the offense by law enforcement authorities
or by the victims of the offense.
SECTION 2. Santa Monica Municipal Code Section 4.63.100 is hereby amended
to read as follows:
4.63.100 Law enforcement access, remedies, and penalties.
(a) Records and Interview Access; Cooperation with Investigations. To
monitor and investigate compliance with the requirements of this Chapter, every
Hotel Employer shall cooperate with City-authorized investigators, including but
not limited to: accessing records, and allowing investigators to interview persons,
including Hotel Workers, during normal business hours.

provided to Hotel Workers pursuant to this Chapter, including, but not limited to,

period, the hours worked for each Hotel Worker, and the formula by which each
Hotel Worker’s wages, sick leave, service charge distribution, and benefits, as
applicable, are calculated, to determine whether the Hotel Employer is in
compliance with this Chapter. Any subpoena issued pursuant to this section shall
not require the production of information sooner than 30 days from the date of
service. A person that has been served with an administrative subpoena may
seek judicial review during that 30-day period.

(ac) Unless otherwise specifically provided, any person violating any
provision of this Chapter shall be guilty of a misdemeanor, which shall be
punishable by a fine not exceeding five hundred dollars but not less than one
hundred fifty dollars per violation, or imprisonment in the County Jail for a period
not exceeding six months, or by both fine and imprisonment, or shall be guilty of
an infraction, which shall be punishable by a fine not exceeding two hundred fifty
dollars but not less than one hundred dollars per violation. Each such person
shall be guilty of a separate offense for each and every day during any portion of
which any violation of any provision of this Chapter is committed, continued, or
permitted by such person and shall be punishable accordingly.
(bd) Any person violating any provision of this Chapter or any rule or
regulation may be subject to administrative citation pursuant to Chapter 1.09 of
this Code.
(ce) Any person convicted of violating any provision of this Chapter or the
terms and conditions of any permit or approval issued pursuant to this Chapter
shall be required to reimburse the law enforcement agency that investigated the
violation its full investigative costs.

effect the provisions of this Ordinance.
SECTION 4. If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional by a decision of any
court of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council hereby declares that it would have passed
this Ordinance and each and every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether any portion of the ordinance
would be subsequently declared invalid or unconstitutional.
SECTION 5. The Mayor shall sign and the City Clerk shall attest to the passage
of this Ordinance. The City Clerk shall cause the same to be published once in the official
newspaper within 15 days after its adoption. This Ordinance shall become effective 30
days from its adoption.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
SETTING FORTH THE ADMINISTRATIVE CITATION SCHEDULE OF FINES FOR
CERTAIN VIOLATIONS OF THE SANTA MONICA MUNICIPAL CODE, SETTING
CIVIL PENALTIES FOR PARKING VIOLATIONS AND FOR THE LATE PAYMENT OF
PENALTIES, SETTING FINES FOR POLICE AND FIRE DEPARTMENT RESPONSES
TO EXCESSIVE FALSE ALARMS, AND SETTING FINES FOR THE
SANTA MONICA PUBLIC LIBRARY
WHEREAS, on May 15, 2002, the City Council adopted Ordinance Number 2043
(CCS) amending Article 1 of the Santa Monica Municipal Code relating to code
enforcement (“Ordinance No. 2043”); and
WHEREAS, Ordinance No. 2043 added Chapter 1.09 to the Municipal Code, which
authorizes the imposition of fines for certain code violations through the issuance of
administrative citations; and
WHEREAS, Section 1.09.040 states that the amount of fines for code violations
imposed pursuant to Chapter 1.09 shall be set forth in a schedule of fines established by
resolution of the City Council and that the fine schedule shall specify any increased fines
for repeat violations of the same code provision by the same person within thirty-six (36)
months from the date of an administrative citation and specify the amount of any late
payment charges imposed for the payment of a fine after thirty (30) days from the date of
issuance of the administrative citation; and

WHEREAS, effective code enforcement is vital to effectuating the City’s
commitment to protecting its residents’, businesses’ and visitors’ health, safety, welfare,
and quality of life; and
WHEREAS, effective enforcement of regulations governing vehicles for hire and
taxicabs is a critical component of the City’s commitment to assure reliable, safe, quality
taxicab services in the City and to eliminate undue congestion and air pollution,
disorganization and hazards associated with an unregulated taxicab environment; and
WHEREAS, the California Vehicle Code and the Santa Monica Municipal Code
authorize the City to establish a schedule of parking penalties for parking violations and
for the late payment of such penalties; and
WHEREAS, California law provides that such parking penalties are civil in nature
and subject to administrative enforcement; and
WHEREAS, the amount of such parking penalties may be set by resolution; and
WHEREAS, there is a constant and heavy demand on police services; and
WHEREAS, false alarms are significant and unnecessary drains on precious police
resources; and
WHEREAS, diversion of police resources to respond to false alarms hampers
response efforts for actual emergencies and thus endangers public safety; and
WHEREAS, Chapter 3.56 of the Santa Monica Municipal Code authorizes the
imposition of a police false alarm response fine; and
WHEREAS, false fire alarms responses result in the reduction of significant Fire
Department resources necessary for response to actual emergencies, thereby causing a
negative impact on the overall safety of the community; and

WHEREAS, historical records of false fire alarm responses indicate that many
locations have had three (3) or more emergency responses to false fire alarms during the
same fiscal year; and
WHEREAS, Chapter 8.44.150 of the Santa Monica Municipal Code authorizes the
imposition of a false fire alarm response fine to recover the Fire Department’s costs in
responding to repetitive false alarms and provides that such fine shall be set by resolution
of the City Council; and
WHEREAS, library fines ensure that library materials are returned so that
libraries can serve their primary purpose; and
WHEREAS, the Library Board, which has charge of the administration of the
Santa Monica Public Library and empowered to make and enforce such by-laws, rules
and regulations as may be necessary for the administration, government and protection
of the City Library, has approved of these fines; and
WHEREAS, on June 25, 2013, the City Council adopted Resolution Number
10754 (CCS) (“Resolution No. 10754”) to adopt fines and to consolidate prior
resolutions adopting fines in order to streamline the process for adopting and collecting
City fines and to further allow the public to more easily gather information about such
fines; and
WHEREAS, since 2013, the City has regularly updated its consolidated master
fine schedule; and
WHEREAS, most recently, on June 12, 2018, the City Council adopted
Resolution Number 11123 (CCS) (“Resolution 11123”) to establish non-standard fine
amounts for violations of Sections 3.21.040(a) and 3.21.040(b) related to dockless

mobility devices; establish non-standard fine amounts for sections 510.6, 606.8,
2306.7.4, 5307.5, 5707.1.1, 6109.4, of the California Fire Code; revise the fine amount
for Section 5704.3.3.3 of the California Fire Code; eliminate fines for sections 604.2.4,
904.11.6, 1504.4, 5704.2.11.1 of the California Fire Code; revise certain reference
citations for consistency with the current version of the California Fire Code; revise
citations to Chapter 7.10 to align with the amendments and clarifications adopted
pursuant to Ordinance 2546; and make other administrative corrections as necessary;
and
WHEREAS, on November 27, 2018, the City introduced for first reading an
ordinance to amend Chapters 4.62 and 4.63 of the Santa Monica Municipal Code
regarding local minimum wage and hotel worker living wage law, to authorize
investigator access to employer records and require employer cooperation with
investigators (“Amended Minimum Wage Ordinance”); and
WHEREAS, the City now desires to revise its master fine schedule to establish
non-standard fine amounts for violations of Chapters 4.62 and 4.63 of the Santa Monica
Municipal Code to enhance the City’s enforcement of local minimum wage and related
regulations.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. STANDARD FINE: Except as otherwise specifically set forth below
in Section 4, the administrative citation fine amount imposed pursuant to Chapter 1.09 to
the Municipal Code (“administrative citation fine amount”), for a first violation of the Santa
Monica Municipal Code by a person shall be $75.00.

SECTION 2. REPEAT VIOLATIONS: The administrative citation fine amount for
a second violation of the same Municipal Code provision by the same responsible party
within 36 months from the date of an administrative citation shall equal 125% of the fine
amount listed in this Resolution for a first violation of that Municipal Code section at the
time of the second violation. The administrative citation fine amount for a third and any
subsequent violation of the same Municipal Code provision by the same responsible party
within 36 months from the date of an administrative citation shall equal 150% of the fine
amount listed in this Resolution for a first violation of that Municipal Code section at the
time of the third, or as applicable, subsequent violation.
SECTION 3. LATE PAYMENT CHARGES: Payment of the administrative citation
fine amount after 30 days from the date of the administrative citation shall be subject to
an additional late payment charge. The late payment charge shall equal 10% of the
administrative citation fine amount due to the City, or 10% of the amount remaining unpaid
to the City if a portion of the fine amount was timely paid. Late payment charges shall be
in addition to the amount of the administrative citation fine amount. In addition, interest
shall accrue on all unpaid monies due, exclusive of late payment charges, at the rate of
one half of one percent per month of the total amount due from the date the administrative
citation fine amount becomes delinquent until the date that all delinquent amounts are
paid to the City.
SECTION 4. NON-STANDARD FINES: The specific administrative citation fine
amounts applicable to each associated Santa Monica Municipal Code section or its
successor legislation, or rule or regulation, are hereby established as set forth in the
attached Exhibits 1 and 2 for any first violation.

SECTION 5. The Schedule of Civil Penalties for Parking Violations and for Late
Payments are hereby established as set forth in the attached Exhibit 3.
SECTION 6. The penalties listed in Exhibit 3 for a Santa Monica Municipal Code
or California Vehicle Code section shall apply to all unlisted subsections, prohibiting the
same violations.
SECTION 7. The fines for the second, third and fourth Police Department
responses to a false alarm within the same fiscal year are hereby established as set forth
in the attached Exhibit 4.
SECTION 8. A false fire alarm response fine (“Response Fine”) for the third and
subsequent response by the Fire Department to a false alarm at the same location during
a fiscal year for purposes of recovering costs associated with resources and services
provided by the Santa Monica Fire Department in connection with responses to excessive
false fire alarms is hereby established as set forth in the attached Exhibit 4.
SECTION 9. Library fines are hereby established as set forth in the attached
Exhibit 5.
SECTION 10. All fines established by this Resolution shall become effective on
November 27, 2018. Notwithstanding the foregoing, specific administrative citation fine
amounts established for violations of Santa Monica Municipal Code Sections 4.62.100
and 4.63.100 as set forth in Exhibit 1 shall only become effective upon the effective date
of the Amended Minimum Wage Ordinance.
SECTION 11. Resolution 11123 is hereby repealed in its entirety.

SECTION 12. If there are any conflicts between the fines adopted in this
Resolution and the fines adopted in any prior resolution or schedule, the fines adopted
pursuant to this resolution shall control.
SECTION 13. The City Clerk shall certify to the adoption of this resolution, and
the same shall be in full force and effect.

Except as otherwise specifically set forth , the administrative citation fine amount imposed pursuant to Chapter 1.09 to the Municipal
Code (“administrative citation fine amount”) for a first violation of the Santa Monica Municipal Code by a person shall be Seventy-Five
Dollars ($75.00).
Repeat Violations:
The administrative citation fine amount for a second violation of the same Code provision by the same responsible party within thirty-
six (36) months from the date of an administrative citation shall equal one hundred twenty-five percent (125%) of the fine amount
listed in this Resolution for a first violation of that Municipal Code section at the time of the second violation. The administrative
citation fine amount for a third and any subsequent violation of the same Code provision by the same responsible party within thirty-six
(36) months from the date of an administrative citation shall equal one hundred fifty percent (150%) of the fine amount listed in this
Resolution for a first violation of that Municipal Code section at the time of the third, or as applicable, subsequent violation.
Late Payment Charges:
Payment of the administrative citation fine amount after thirty (30) days from the date of the administrative citation shall be subject to
an additional late payment charge. The late payment charge shall equal ten percent (10%) of the administrative citation fine amount
due to the City, or ten percent (10%) of the amount remaining unpaid to the City if a portion of the fine amount was timely paid. Late
payment charges shall be in addition to the amount of the administrative citation fine amount. In addition, interest shall accrue on all
unpaid monies due, exclusive of late payment charges, at the rate of one half of one percent per month of the total amount due from
the date the administrative citation fine amount becomes delinquent until the date that all delinquent amounts are paid to the City.

Penalties shall accumulate without limit.
Suspension of Franchisee’s Franchise:
Every franchisee, vehicle permittee and driver who does not comply fully with any one or more of the Department’s rules and
regulations, with the terms and conditions of a taxicab franchise or the Santa Monica Municipal Code shall be guilty of a violation
and subject to the penalty schedule as shown in the brackets at the end of each rule. Each day that a violation continues shall
constitute a separate and distinct violation. If a penalty due date falls on a weekend or holiday, penalties are due the next City
business day.
Any suspension of a permit shall be recorded on the driver’s Permit Suspension Record and will be considered when applying
Taxicab Rule 306f. A permittee must serve a suspension during a period of time in which the Taxicab Driver’s Permit
has been physically turned in to the City.
Whenever the cumulative amount of the monetary penalty assessed against any franchisee for any calendar quarter period exceeds
$10,000, the franchisee’s franchise is subject to immediate suspension.
The following progressive penalties shall be applied when the same driver, vehicle permittee, or franchisee is guilty of a second or
subsequent violation of the same rule or any combination of the rules listed for the same Progressive Penalty Schedule within any
24-month period. When IOS appears in a penalty, a driver or vehicle may be placed in an Immediate Out of Service status at the
absolute discretion of the Police Officer.
