R11117City Council Meeting: June 12, 2018 Santa Monica, California RESOLUTION NUMBER I t t i'l(CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING A PERMIT FEE FOR THE SHARED MOBILITY DEVICE PILOT PROGRAM AND A PER SHARED MOBILITY DEVICE FEE WHEREAS, the City consists of just over eight square miles of land, which is home to 90,000 residents, the job site of 300,000 workers, and a destination for as many as 500,000 visitors on weekends and holidays; WHEREAS, the City's public rights-of-way are designed to accommodate a multimodal transportation system and are heavily utilized by residents, workers and visitors; WHEREAS, in recent months, in part due to rapid technological advancements, the City's public rights-of-way have been flooded with new, unpermitted commercial Shared Mobility Systems and Devices; WHEREAS, a shared mobility device pilot program would be established for a short term to inform the content of future operating requirements and program components, and to provide flexibility during the pilot program duration through the Administrative Regulations; 1 WHEREAS, the City now seeks to create and adopt permit fees to cover the cost of operating a shared mobility device pilot program that will improve access to mobility options for residents, employees, visitors to Santa Monica, create new and diverse mobility options, ensure safety by reducing sidewalk and pathway impediments, facilitate access for disabled individuals, educate users about the proper rules and etiquette, create a legal and enforceable framework for managing shared mobility in the public right of way, and build good working partnerships with shared mobility service providers; and WHEREAS, the permit fees established by this resolution are not more than necessary to recover the costs of the services provided. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The Operator Fee for participation in the Shared Mobility Device Pilot Program is $20,000 per year. SECTION 2. In addition to the Operator Fee, each Operator shall pay a Per Device Fee of $130 per year for each of its shared mobility devices. SECTION 3. The Operator Fee and the Per Device Fee set forth in this resolution shall be administratively revised and increased annually by a factor equal to the net change in City salaries and benefits costs for that fiscal year. Such net change is measured by comparing the total budgeted City salary and benefit costs for the fiscal year in which the change is to become effective to the total budgeted City salary and benefit costs for the prior fiscal year. Notwithstanding the foregoing, in no event shall the annual administrative revision set forth be less than zero percent (0%). SECTION 4. The fees established by this resolution shall be effective as of September 17, 2018. SECTION 5. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
