Legacy Construction for the Clover Park Restroom Replacement Project Recommended Action Staff recommends that the City Council: 1. Award Bid #SP2388 to C.S. Legacy Construction, Inc., a California-based company, to provide construction services for the Clover Park Restroom Replacement Project; 2. Authorize the City Manager to negotiate and execute a contract with C.S. Legacy Construction, Inc., in an amount not to exceed $2,312,010 (including a $210,183 contingency); and 3. Authorize the Director of Public Works to issue any necessary change orders to complete additional work within contract authority. Executive Summary Clover Park is one of the largest and most active of Santa Monica’s parks. The Clover Park Restroom Replacement Project would demolish and replace two aging restroom facilities to bring them into compliance with current code requirements. Staff recommends C.S. Legacy Construction, Inc. to provide construction services for the Clover Park Restroom Replacement Project in an amount not to exceed $2,312,010. Background In March 2016, the City entered into a Professional Services Agreement with DNA A+D to provide architecture and design services for the Clover Park Restroom Replacement Project in an amount not to exceed $114,410 (Attachment A). The design work to construct two new restroom facilities at Clover Park is now complete. Discussion 2 of 3 There are two separate, freestanding restroom facilities at Clover Park. Restroom 1 is located near the parks administration offices, and Restroom 2 is located in the park extension adjacent to the baseball/softball fields. Both restroom buildings are over 30 years old and require extensive maintenance and upgrades to be code-compliant. Therefore, staff recommends full replacement of both buildings. Because of the high usage and potential for vandalism in park restrooms as well as the stringent public contracting, health, labor and other code requirements, restroom replacement is costly, but necessary. The Clover Park Restroom Replacement Project would demolish and replace the two existing restroom facilities. Construction is anticipated to begin in late July 2018 and to be completed by late May 2019. Temporary restrooms would be provided for public use during construction. Vendor Selection On March 19, 2018, the City published Notices Inviting Bids to provide construction services for the Clover Park Restroom Replacement Project in accordance with City specifications. The bid was posted on the City's on -line bidding site, and notices were advertised in the Santa Monica Daily Press in accordance with City Charter and Municipal Code provisions. Forty-five vendors downloaded the bid. The following three bids were received and publicly opened on April 18, 2018. Bidder Bid Amount Calco Construction Services $2,553,792 C.S. Legacy Construction, Inc. $2,101,827 STB Stone $1,290,000 (withdrawn) Bids were evaluated based on the criteria in SMMC 2.24.072, including price, previous experience, ability to deliver, quality of product, and compliance with City specifications. 3 of 3 C.S. Legacy Construction Inc. has construction experience with similar projects for other Southern California municipalities. Staff contacted references provided by C.S. Legacy Construction, Inc., and all respondents reported that the contractor completed projects in a timely and cost-efficient manner. The California Contractors State License Board verified that the contractor’s license is current and in good standing. Based on these criteria, C.S. Legacy Construction, Inc., the lowest bidder, is recommended as the best bidder. Financial Impacts and Budget Actions The contract to be awarded to C.S. Legacy Construction, Inc. is for an amount not to exceed $2,312,010 (including a $210,183 contingency). Funds in the amount of $1,589,865 are available in the Capital Improvement Program budget in account C010747.589000 / C0105060-689000. An additional $722,145 is included in the Proposed FY 2018-20 Capital Improvement Program Budget. It’s obvious that those restrooms need to be replaced, or at least repaired. When the Santa Monica Festival took place at Clover Park, it was always disturbing to see a pool of water standing on the floor of the main women’s restroom and not know whether it came from the sink or the toilets. However, I don’t understand why it would cost $2.3 million to replace the restrooms. Is that the standard price for constructing restrooms in our city parks, or for park restrooms in other cities? Was the Recreation and Parks Commission allowed to review the plans and cost for this project? IMPORTANT! Please REJECT Clover Park Restroom Replacement Project Dear Mayor, Council members, City Manager, Sorry I cannot be there tonight to deliver this in person. Feel free to use this information to add to the discussion in deciding this issue. I strongly urge you to REJECT this $2.3 million contract for two Clover Park restrooms and strongly suggest you direct city staff to spend a month or two in a new effort that can and should save the city hundreds of thousands of dollars. Our Recreation and Parks Commission was essentially aghast when this matter came before us more than a year ago... . As I recall we were told the project was already funded and at $1.4 million, which every Commissioner thought was way too high. We looked at designs. Made some recommendations as that was what staff asked us to do. Many of us asked why the restrooms are so expensive and not even bigger than the ones currently there. We were told things are more expensive here and that the restrooms we’re replacing are relics and falling apart. I recommended the city look at companies that make pre-fab restrooms in use by many other cities including some in CA like Long Beach. They are cheaper but look nice and are very functional. We Commissioners also said why not just pick one of the good designs we already bought and built in Santa Monica and simply replicate it. Commissioner LaGuardia told me this week she remembers the meeting well, because it was the night I, as the new Chair, swore her in as our newest Commissioner LaGuardia. She also reminded me that we were told by staff that the cost of the restrooms WAS NOT in our preview. I and others disagree. But we finished our comments and recommendations and most of us vowed to try and prevent such costly purchases in the future. Fast-forward to a few weeks ago when I saw the bid notice in the Santa Monica Daily Press with that new $2.3 mil price-tag. More than $1 million a restroom. Each. I cannot support that. Neither can you. I urge you to reject this bid. We must start rejecting the BMW's in our budget when a Toyota or Honda will do just fine. FYI... I spoke with Parks and Recreation professionals from Long Beach and Manhattan Beach at a conference right after this matter came before our Commission. Both said we were paying too much. I also met company officials from ‘Easi-set’. They said they can build good pre-fab restrooms for less than half the cost. A similar prefab is planned for the Civic Field. Bottom line: Council should direct staff to query three local cities, LB, Manhattan Beach and Redondo and find out what THEY do and at what cost. Staff should also look at previous designs we have built and get bids on how much to replicate them. Finally, staff should contact three pre-fab companies, tell them what we want and get quotes.
