A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA ESTABLISHING IMPOUND FEES
FOR SHARED MOBILITY DEVICES
WHEREAS, it is the policy of the City of Santa Monica (the "City") to charge for the
full costs of services provided by City Staff when such services benefit individual users,
rather than member of the community as a whole; and
WHEREAS, Ordinance Number 1754 (CCS) (the "Ordinance"), adopted July 12,
1994, governs the setting of the amount of user fees or fees for services provided to or
for particular individuals or entities rather than the general public and allows such fees to
be set by ordinance, resolution, or any other means authorized by law; and
WHEREAS, Santa Monica Municipal Code Section 1.09.040 states that the
amount of Administrative Citation fines for code violations imposed pursuant to Chapter
1.09 shall be set forth in a schedule of fines established by resolution of the City Council
and that the fine schedule shall specify any increased fines for repeat violations of the
same code provision by the same person within third -six (36) months from the date of the
administrative citation and specify the amount of any late payment charges imposed for

the payment of a fine after thirty (30) days from the date of issuance of the administrative
citation; and
WHEREAS, the City's public rights-of-way include any area dedicated for public
use as a public street, pedestrian way or other thoroughfare, including but not limited to
a street, sidewalk, parkway, alley, public transportation path or easement; and
WHEREAS, the City's public rights-of-way are designed to accommodate a
multimodal transportation system and are heavily utilized by residents, workers and
visitors; and
WHEREAS, in recent months, due in part to rapid technological advancements,
the City's public rights-of-way have been flooded with new unpermitted commercial
Shared Mobility Systems and Devices; and
WHEREAS, the rapid proliferation of such systems and devices creates serious
safety hazards for pedestrians, bicyclists, and drivers; and
WHEREAS, the proliferation of such systems and devices impedes pedestrian
circulation and paths of travel and creates hazards in the public rights-of-way, for persons
with disabilities and others, especially when left unattended; and
WHEREAS, effective enforcement of regulations governing Shared Mobility
Systems and Devices is vital to effectuating the City's commitment to protecting its
residents', businesses' and visitors' health, safety, welfare, and quality of life; and

WHEREAS, it is in the public interest to remove commercial Shared Mobility
Devices abandoned in the public rights-of-way to preserve public peace, health and
safety.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The following fee for impound of a Shared Mobility Device is hereby
Shared Mobility Device Impound Fee: $60 per Shared Mobility Device
SECTION 2. If there are any conflicts between the fees and fines adopted in this
Resolution and any adopted prior resolution or schedule, the fees and fines adopted
through this Resolution shall take precedence.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
