SR 07-25-2017 11B Ci ty Council Report City Council Meeting : July 25, 2017 Agenda Item: 11.B 1 of 6 To: Mayor and City Council From: David Martin, Director , Administration Subject: Amendment of Preferential Parking Zone DD Recommended Action Staff recommends that the City Counci l: 1. Amend Preferenti al Parking Zone DD to change 26 th Street between Pearl Street and Ocean Park Place North from “2 Hour Parking, 8 A.M. to 6 P.M. Monday - Friday by Permit” to “No P arking , 9 A.M. to 6 P.M., Monday -Friday, except by permit”; and 2. Approve the attached Resolution (Attachment A) establishing Preferential Parking Reg ulations. Executive Summary Residents of the 2400 to 2600 block of 26th Street have submitted qualifying petitions for preferential parking regulations. The residents assert and staff agrees that the existing regulations prohibiting all parking from 10 A.M. to 2 P.M. Monday thru Friday do not resolve the impacts of non -resident parking, is an insufficient solution by not providing parking even to residents or their guests during these hours, and that by simply removing the existing signage would create sig nificant impacts from non -resident parking on residents’ ability to find parking near their homes. The s treet was pre - approved for Preferential Parking by City Council in July 2011 ; however, residents have requested changes to the previously approved park ing regulations thereby requiring additional Council action . Staff recommends amending Preferential Parking Zone DD , approving the following preferential parking regulations for 26th Street between Ocean Park Place North and Pearl Street with the regulati on “No Parking, 9 A.M. to 6 P.M., Monday thru Friday, except by permit .” 2 of 6 Should Council approve the recommended action, it is estimated that permit sales for the 2400 to 2600 blocks of 26th Street would generate revenues of approximately $2 ,000 annually, which would offset, but not fully recover, the cost to the City of issuing permits to residents. Additionally, new signage would be required at an estimated one - time cost of $2,000. Background Preferential parking is a tool the City uses to manage non -r esident parking use on residential streets, as authorized by Santa Monica Municipal Code Chapter 3.08 and the California Vehicle Code. Preferential parking regulations manage the use of on -street parking to make parking more available for residents near th eir home. Only residents who live on a block with preferential parking restrictions are eligible to purchase a permit. Permits may be used within two block faces of the permit holder’s address. Residents may petition to initiate a preferential parking zone at any time. Typically, u pon receipt of a petition representing two -thirds of the residential units on a block, a parking occupancy study of the neighborhood is conducted and a community meeting is held. In evaluating the petitions, staff typically evalua tes the larger neighborhood rather than an individual block in order to account for parking displacement when regulations are established or changed. As a result, staff typically recommends that the Council preapprove preferential parking regulations for m ore than one block to streamline and expedite the process for adjacent blocks should some displacement occur. However, when the surrounding residential streets are already served by residential permit parking, it is unnecessary to conduct further parking u tilization studies. Once Council approves preferential parking regulations, they are implemented on the block or blocks that have submitted qualifying petitions. Preferential parking regulations are not implemented on blocks that have been pre -approved by the Council until the time that the residents of those blocks submit qualifying petitions representing two -thirds of the residential units on the block. Discussion 3 of 6 The residents of 26th Street between Ocean Park Place North and Pearl Street have submitt ed complete petitions requesting to install preferential parking regulations. The surrounding area includes:  to the north Preferential Parking Zone DD “2 hour parking 8 A .M .- 6 P .M . daily, except by permit” along 26 th Street north of Pearl Street,  to the e ast, along Pearl Street , Zone H “2 hour parking, 9 A .M .- 6 P .M . daily, except by permit”, and  to the west, along Pearl Street, Zone DD “2 hour parking, 8AM -6PM, Monday - Friday, except by permit”. The p etition blocks are shown in Attachment B . The existing area regulations and petition blocks were previously established by Council Action between 2002 and 2006. Parking demand in the area is moderate due to its moderately -dense residential nature as well as its proximity to the successful business district al ong Ocean Park Boulevard. City Council previously approved the 26th Street between Ocean Park Place North and Pearl Street, as well as the surrounding streets as Zone DD. As a result, there is no subsequent need to conduct utilization studies . Communit y Input Residents along 26th Street and the Friends of Sunset Park Neighborhood Association were notified of the proposed preferential parking zone by mail several times in each of the three preceding months and invited to attend a June 15, 2017 evening co mmunity meeting at the Pico Branch of the Santa Monica Public Library to discuss preferential parking. A summary of the comments received at the meeting are listed below:  Residents expressed a preference for regulations limiting on -street parking to reside nts and no parking for those without permits during the day;  Residents expressed concern regarding employees working at Ocean Park Boulevard businesses parking on 26th Street; 4 of 6  F urther, these same employees scramble to move their vehicles just before the on set of the existing 10 AM to 2 PM parking prohibition and then returning afterwards, causing undesired speeding and other behavior concerns; and  Some residents were initially opposed to any preferential parking regulations and voiced concerns regarding inc onvenience, cost of parking permits, and difficultly for visitors to park. Nevertheless, residents have come together and have now exceeded the required supermajority of 66%, with 9 3 % of households in favor of moving forward with the residential permit zo ne as proposed . Recommended Preferential Parking Regulations Based on previous City Council pre -qualifications for this part of town and the community comments stating the difficulty of finding street parking and a desire for preferential parking, staff r ecommends approving the following preferential parking regulations for the following block:  26th Street between Pearl Street and Ocean Park Place North with the regulation “No parking, 9 A.M. to 6 P.M., Monday to Friday, except by permit.” As the intention of preferential parking is to improve access to street parking for block residents and as the parking located on the 26th Street is adjacent to pedestrian access to Ocean Park Boulevard and is frequently used by employees of Ocean Park Boulevard businesse s, staff recommends the proposed preferential parking regulations be applied to the parking along this segment of 26th Street. Alternatives The Council could maintain the existing parking regulations including pre -approved preferential parking, o r adopt di fferent hours and types of restrictions than recommended. Environmental Analysis The proposed project has been determined to be categorically exempt from the provisions of the California Environmental Quality Act (CEQA), pursuant to Article 19, Section 15 301 (c) which defines Class 1 exempt projects in the following way: “Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor 5 of 6 alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination.” The exemption includes: “Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities.” Preferential parking zones involve only the issuance of permits for the use of an existing public street and include negligible or no expansion of the existing use. Next Steps If preferential parking regulations are approved, regulations wou ld be implemented on the 2400 to 2600 block of 26th Street within seven (7) weeks. This allows time for: residents to apply for permits, staff to process applications, signs to be ordered, manufactured, and installed, and a grace period between the install ation of signs and the enforcement of preferential parking regulations. Financial Impacts and Budget Actions The amendment of Preferential Parking Zone DD would generate approximately $2 ,000 in ongoing revenues beginning FY 2017 -18 from the sale of an es timated 60 new resident and visitor permits. Funds for the one -time cost related to the purchase of new signage for the 2400 to 2600 block of 26th Street t otaling $2,000 are included in the FY 2017 -18 Biennial Budget in the Planning and Community Developm ent Department. When residents on our block first sought approval fo r preferential park ing we were advised by a former Mobility Division staff member that a request for a Sat-Sun extension to the existing restrictions would be the most prudent way to move forward. We had no idea that more extensive restrictions were possible and already under consideration. Since the other RR zoned streets will have restricted parking until 10pm daily and permit-only overnight parking, there is a strong likelihood th at Strand will be negatively imp acted by vehicles, itinerant people, tourists, workers and bar patrons who leave their cars late into th e night and/or sleep in them. There was already an attempted break-in to my home in the middle of the night by drunk person who had seemingly “lost” the way to his car. It was a terrif ying experience! My neighbors, Lindsey Childs and Jason Champagne, have been impacted by other such incidents. We would appreciate your immedi ate attention to this matter.
