SR 05-09-2017 11A Ci ty Council Report City Council Meeting : May 9, 2017 Agenda Item: 11.A 1 of 7 To: Mayor and City Council From: David Martin, Director , Transportation Planning Subject: Establishment of Preferential Parking Zone RR and Amendment of Zone U and adopt a Resolution establishing Preferential Parking Regulations. Staff recommends that t he City Council: 1. Establish Preferential Parking Zone RR to include:  Fourth Street between Pico Boulevard and Ocean Park Boulevard, and Strand Street, Pacific Street, and Bay Street between Third Street and Fourth Street with the regulation “No parking 10 P .M. to 7 A.M., 2 hour parking 7 A.M. to 10 P.M., daily, except by permit”, and  Strand Street between Fourth Street and Sixth Street with the regulation “2 hour parking 7 A.M. to 6 P.M. daily, except by permit”. 2. Amend Preferential Parking Zone U to reclass ify Strand Street between Fourth Street and Sixth Street from Zone U to Zone RR. 3. Approve the attached Resolution (Attachment A) establishing Preferential Parking Regulations. Executive Summary Residents of the 2300, 2400, and 2500 block of Fourth Street , and the 500 block of Strand Street have submitted qualifying petitions for preferential parking regulations. The residents assert that non -resident parking is impacting their ability to find parking near their homes. A parking study conducted in August a nd September of 2015 confirmed that street parking has high usage throughout the day for both the weekend and weekday. Staff recommends creating Preferential Parking Zone RR, approving the following preferential parking regulations for the following block s:  Fourth Street between Pico Boulevard and Ocean Park Boulevard, and Strand Street, Pacific Street, and Bay Street between Third Street and Fourth Street with the regulation “No parking 10 P.M. to 7 A.M., 2 hour parking 7 A.M. to 10 P.M., daily, except by permit”, and  Strand Street between Fourth Street and Sixth Street with the regulation “2 hour parking 7 A.M. to 6 P.M. daily, except by permit” (reclassifying these two blocks from Zone U to Zone RR). 2 of 7 Should Council approve the recommended action it is estimated that permit sales for the 2300,2400, and 2500 blocks of Fourth Street would generate approximately $11,000 annually, which would offset, but not fully recover, the cost to the City of issuing permits to residents. New permit revenue would not be expected to be generated for the 500 block of Strand Street, as it has pre -existing preferential regulations that are being changed, so there would be few if any new permits issued. Additionally, new signage would be required at an estimated cost of $1,200 for all four blocks. Background Preferential parking is a tool the City uses to manage non -resident parking use on residential streets, as authorized by Santa Monica Munic ipal Code Chapter 3.08 and the California Vehicle Code. Preferential parking regulations manage the use of on -street parking to make parking more available for residents near their home. Only residents who live on a block with preferential parking restric tions are eligible to purchase a permit. Permits may be used within two block faces of the permit holder’s address. Residents may petition to initiate a preferential parking zone at any time. Upon receipt of a petition representing two -thirds of the resid ential units on a block, a parking occupancy study of the neighborhood is conducted and a community meeting is held. In evaluating the petitions, staff typically evaluates the larger neighborhood, rather than an individual block due to the potential for pa rking displacement when regulations are established or changed. As a result, staff typically recommends that the Council pre - approve preferential parking regulations for more than one block to streamline and expedite the process for adjacent blocks should some displacement occur. SMMC 3.08.030 provides Council with the authority to create preferential parking zones. Once Council approves preferential parking regulations, they are implemented on the block or blocks that have submitted qualifying petitions. Preferential parking regulations are not implemented on blocks that have been pre -approved by the Council until the time that the residents of those blocks submit qualifying petitions representing two -thirds of the residential units on the block . Discuss ion The residents of Fourth Street between Strand Street and Hollister Avenue, and Fourth Street between Hollister Avenue and Ocean Park Boulevard have submitted complete 3 of 7 petitions requesting to install preferential parking regulations. Residents of Strand Street between Fifth Street and Sixth Street currently located in Preferential Parking Zone U submitted a petition to change their current parking regulations from “2 hour parking 7AM -6PM Monday -Friday, except by permit” to “2 hour parking 7AM -6PM daily, except by permit”. The surrounding area includes:  to the east Preferential Parking Zone U “2 hour parking 7AM -6PM Monday - Friday, except by permit”,  to the west Zone M “No parking 10PM -2AM, 2 hour parking 9AM -10PM daily, except by permit”, and  also to t he west Zone I “No parking 6PM -2AM, 2 hour parking 9AM -6PM daily, except by permit”. The existing area regulations and petition blocks are shown in Attachment B. Parking demand in the area is high due to its dense residential nature as well as its proxi mity to the successful business district on Main Street. A summary of peak parking occupancies is included as Attachment C. The summary is based on a parking survey conducted in August and September 2015 for both weekend and weekday time periods from 7 A.M . to 10 P.M., to capture both summer and Santa Monica High operations.  For both August and September for both the weekend and weekday parking occupancies on Fourth Street, Bay Street, and Pacific Street are near or above 85% occupancy between 7 A.M. and 1 0 P.M.  For both August and September for both the weekend and weekday Strand Street between Third Street and Sixth Street parking occupancies are near or above 85% occupancy except for the block between Fifth and Sixth Streets which has still high but lo wer parking occupancy during the morning. The data indicates street parking is in high demand throughout the day and most residents may be required to circle the block to find a parking space near their residence. Community Input Residents, businesses, property owners, the neighborhood organization, and business districts of the area were notified of the proposed preferential parking zone by mail and invited to a June 23, 2016 community meeting to discuss preferential parking. A listing 4 of 7 of the comments r eceived at the meeting and in writing is included as Attachment D. A summary of the major issues stated at the meeting are listed below:  residents expressed a preference for regulations limiting overnight parking to residents and limited time parking for t hose without permits during the day;  residents expressed concern regarding employees working on Main Street parking all day on Fourth Street;  some residents preferred more restrictive all day regulations; and  some residents were opposed to any preferential parking regulations and voiced concerns regarding inconvenience, cost of parking permits, and difficultly for visitors to park. Recommended Preferential Parking Regulations Based on the parking occupancy study which showed high usage of str eet parking throughout the day and the community comments stating the difficulty of finding street parking and a desire for preferential parking, staff recommends approving the following preferential parking regulations for the following blocks:  Fourth Str eet between Pico Boulevard and Ocean Park Boulevard, and Strand Street, Pacific Street, and Bay Street between Third Street and Fourth Street with the regulation “No parking 10 P.M. to 7 A.M., 2 hour parking 7 A.M. to 10 P.M., daily, except by permit”, and  Strand Street between Sixth Street and Fourth Street with the regulation “2 hour parking 7 A.M. to 6 P.M. daily, except by permit”. As the intention of preferential parking is to improve access to street parking for block residents and as the parking loc ated on the Fourth Street median is adjacent to and frequently used by residents of Fourth Street staff recommends the proposed preferential parking regulations be applied to the parking located in the Fourth Street center medians. Hotchkiss Park is a comm unity park that borders Strand Street and Fourth Street. Street parking along the curb immediately adjacent to the park would not be changed to maintain public parking access to the park. The Community and Cultural Services staff communicated they are not concerned about the proposed preferential parking regulations. Coastal Zone 5 of 7 The preferential parking area is located within the Coastal Zone. Staff does not believe that the approval of the preferential parking area would require a Coastal Development Pe rmit, as the City has made significant infrastructure investments to improve beach access. The City provides thousands of public parking spaces at the beach and has made significant investments to improve transit, pedestrian, and bicycle access to the beac h. Thus, staff does not believe the establishment of preferential parking Zone RR or modification of Zone U would adversely impact public access to the beach. However, a Coastal Development Permit will be obtained if required by law. . . Staff will inf orm Council if the Coastal Commission believes that a Coastal Development permit is required. Alternatives The Council could maintain the existing conditions or adopt different hours and types of restrictions than recommended. The Council could also direc t staff to pursue a Coastal Development permit prior to implementation of the regulation. Environmental Analysis The proposed project has been determined to be categorically exempt from the provisions of the California Environmental Quality Act (CEQA), pu rsuant to Article 19, Section 15301 (c) which defines Class 1 exempt projects in the following way: “Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facil ities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination.” The exemption includes: “Existing highways and streets, sidewalks, gutters, bicycle an d pedestrian trails, and similar facilities.” Preferential parking zones involve only the issuance of permits for the use of an existing public street and include negligible or no expansion of the existing use. Next Steps 6 of 7 If preferential parking regulatio ns are approved and there is no action pursued with the California Coastal Commission, regulations would be implemented on the 2300, 2400, and 2500 block of Fourth Street, and 500 block of Strand Street within eight weeks. This allows time for: residents t o apply for permits, staff to process applications, signs to be ordered, manufactured, and installed, and a grace period between the installation of signs and the enforcement of preferential parking regulations. Additional blocks within the zone would have preferential parking implemented approximately eight weeks after receipt of a petition signed by residents representing two -thirds of the residential units of that block. Financial Impacts and Budget Actions If an agreement is reached with the Califor nia Coastal Commission , the approval of Preferential Parking Zone RR would generate $11,000 in ongoing revenues beginning FY 2017 -18 from the sale of an estimated 395 new resident and visitor permits. Funds for the one -time cost related to the purchase of new signage for Preferential Parking Zone RR totaling $1,200 are included in the FY 2017 -18 Proposed Biennial Budget in the Planning and Community Development Department. I urge you to approve the preferential parking requests before you as defined. I live on 4th between Hollister and Ocean Park, there is rarely a spot to be had. We are the parking lot for the workers on Main Street, and have been for years. It isn't just during the day, it is at night as well, as many establishments are open late and have many employees. What I think is the best solution, and I hope you implement it, is to extend the beach p arking lots to the employees for a very nominal sum. $100 dollar a month is a lot of money for most retail workers. Something like $20 dollars is fair. It's unrealistic to expect workers to take public transit, many just cannot or won't. I strongly support the new parking to be as requested. No parking overnight from 6 PM to 7 AM, and two hour parking from 7 AM to 6 PM. I do hope, however that you consider the employees and make provisions for them to park at the beach lots for something they can afford. My building is on the eastern side of the street, which has a red painted curb for the entire block. All five parking spaces on our block are across the street, which is a bu sy one, with a landscaped m edian to discourage pedestrians crossing mid-block. Not an ideal place for to park if there are groceries to unload, for instance. I'd much rather park around the corner on Bay St., between 4th and 6th. This is where my back alley le ts out actually. It falls under Zone U. When I tried to purchase a residents parking pass for use there, I was turned away, since my address around the corner is technically not in the zone. Is it possible to file a petition to initiate a preferential pa rking zone that is specific to one side of the street, rather th an the whole block? Is a petition even really even necessary, for blocks that don't have any parking to begin with? (If our side of the street was designated part of the zone, there would be no need for expenditures for new signage.) I would be so pleased if you could just add the odd numbered addresses on the 1900 block of 4th street to the parking office's database, so I would have the privileged of purchasing a pass for use within 2 blocks of my home. I am handicapped and cannot walk that fa r and on numerous occasions have gotten street cleaning tickets because there was no place to pa rk. I usually go all the way north to the mini market or south of the bridge. I've spoken to so me of the people who use 4th Street for business parking explaining I cannot walk far and they ba sically walk away. We as residents of this neighborhood do not have attached parking with our homes (just so me of the larg er apartment complexes do). It seems ridicul ously unfair for residents to co ntort themselves, park several blocks away from their home or....on weekends...c ircle around and around aimlessly for over an hour to squeeze into a spot. We love the Main St Farmers Market and the Beach, but it seems fair to limit parking to 2 hours for vi sitors errands. Permit Parking would bring some income, sanity, and civility to a very chaotic situation. The stress is high around here and there is no reason for this. The parking signs have NOT kept up with th e growth and crowding in terms of parking. Try buying groceries, parking blocks away and walk ing home with a cane. On the odd time I've pulled up in front of my house w ith my handicap placard and flas hing lights, I've been ticketed for no parking (for 5 minutes), my neighbor's car was hit when she did the same and we are chastised and penalized because we don't know what to do with our cars. I understand that employees need parking too but th ere are the metered lots off Main Street with all day parking. We shouldn't have to resort to that. Not only is parking like winning the lottery, so many people take up more than what they ne ed to park creating too many empty spots where we can't park. What I think is the best solution, and I hope you implement it, is to extend the beach p arking lots to the employees for a very nominal sum. $100 dollar a month is a lot of money for most retail workers. Something like $20 dollars is fair. It's unrealistic to expect workers to take public transit, many just cannot or won't. I strongly support the new parking to be as requested. No parking overnight from 6 PM to 7 AM, and two hour parking from 7 AM to 6 PM. I do hope, however that you consider the employees and make provisions for them to park at the beach lots for something they can afford. Fourth Street is the first non-perm itted street with access to the beach an Main Street, so we are th e first choice for all-day street parking. As I get older, and hope to remain in my current reside nce, I’m becoming concerned a bout arriving home late at night - I attend classe s three nights a week arriving home at 11:00 pm, and about the difficulty of unloading groceries and other things and carryi ng them from several blocks away. We have worked hard to get this proposal this far, and I hope you will complete the process so that finding a parking spot will no longer be a major concern in our lives. I live on 4th between Hollister and Ocean Park, there is rarely a spot to be had. We are the parking lot for the workers on Main Street, and have been for years. It isn't just during the day, it is at night as well, as many establishments are open late and have many employees. What I think is the best solution, and I hope you implement it, is to extend the beach p arking lots to the employees for a very nominal sum. $100 dollar a month is a lot of money for most retail workers. Something like $20 dollars is fair. It's unrealistic to expect workers to take public transit, many just cannot or won't. I strongly support the new parking to be as requested. No parking overnight from 6 PM to 7 AM, and two hour parking from 7 AM to 6 PM. I do hope, however that you consider the employees and make provisions for them to park at the beach lots for something they can afford. The staff report outlines many of the reasons for this, including Main Street employees and shoppers, beach goers a nd bicycle riders who park their cars and ride their bike s to the beach or elsewhere. Commercial vehicles used by Main Street businesses are also parked here during the day and overnight. Fourth Street is the first non-perm itted street with access to the beach an Main Street, so we are th e first choice for all-day street parking. As I get older, and hope to remain in my current reside nce, I’m becoming concerned a bout arriving home late at night - I attend classe s three nights a week arriving home at 11:00 pm, and about the difficulty of unloading groceries and other things and carryi ng them from several blocks away. We have worked hard to get this proposal this far, and I hope you will complete the process so that finding a parking spot will no longer be a major concern in our lives. I thought it would be beneficial to share my personal observations of non-resident parking:  Workers from nail salons and restaurants pa rk their cars and walk to Main Street  Commercial vehicle from a Main Street business park on 4 th Street  Beach goers park their cars for extended periods of time  People living in their vehicl es that are parked on 4 th Street Main Street customers and beach goers have multiple transportation options today that range from the Expo line, Breeze Bike Program, Uber and Lyft. The City ma intains a website outlining Main Street parking options (https://www.smgov.net/Departments/PCD/Transpor tation/Motorists-Parking/Where-to-Park/) for business customers and visitors who wish to drive their vehicles. I encourage you to accept the proposal so that 4 th Street residents can enjoy wh at is a “luxury”, and that is, parking on the block on which they resi de and not having to gauge their trip s to and from home by the parking situation. Also, given our very close proximity to Hotchkiss Park, we have noticed that many of the vehicles parked along our stretch of 4th Stre et are actually homes for the increasing transient population and therefore, very rarely move their vehicles. It is a somewhat frustrating daily or deal that is made worse by facing s kyrocketing rent, when we cannot even park near our homes (and sometimes ]fear for our safety having to walk several blocks at night knowing the crime is also increasing in the area) yet we pay $3200/m onth for a 1 BR. Not an ideal place for to park if there are groceries to unload, fo r instance. I'd much rather park around the corner on Bay St., between 4th and 6th. This is where my back alley lets out actu ally. It falls under Zone U. When I tried to purchase a reside nts parking pass for use there, I was turned away, since my address around the corn er is technically not in the zone. Is it possible to file a petition to initiate a preferential pa rking zone that is specific to on e side of the street, rather than the whole block? Is a petition even really even n ecessary, for blocks that don't have any park ing to begin with? (If our side of the str eet was designated part of the zone, there would be no need for expenditures for new signage.) I would be so pleased if you could just a dd the odd numbered addresses on the 1900 block of 4th street to the parking office's database, so I would have the privileged of purchasing a pass for use within 2 blocks of my home.
