Recommended Action Staff recommends that the City Council adopt t he attached resolution approving Final Tract Map No. 72225. Executive Summary This report transmits for City Council approval a Final Parcel Map for a condominium project located at 1329 California Avenue . The Tentative Parcel Map was approved by the P lanning Commission on October 16, 2013. A timely filing of the Final Map was made to the County prior to the Map’s expiration date. According to Section 66452.6(d) of the Subdivision Map Act, once a timely filing is made to the County or City, subsequent actions of the local agency, including, but not limited to, processing, approving, and recording of a map, may lawfully occur after the map’s expiration date. TRACT MAP ADDRESS SUBDIVIDER UNITS 72225 1329 California Ave. 1329 California Avenue LLC 3 The following table provides a brief summary of the project: Zoning District R2 - Low Density Residential Parcel Area 10,000 square feet Parcel Dimensions 100’ x 100’ Existing On -Site Improvements Vacant Rent Control Status N/A - vacant property Historic Resources Inventory Status N/A - vacant property AHPP Compliance Payment of Fee Discussion A Vesting Tentative Parcel Map application (13TM -003 ) was submitted to the City 2 o f 3 Planning Division on August 22, 2013 to create 3 residential condomini um air space parcels on one land lot in the R2 Low Density Residential zoning district. After a public hearing and careful review of the record and staff recommendations, the Planning Commission approved the Vesting Tentative Parcel Map for the above proj ect on October 16, 2013. The action of the Planning Commission was based on its findings that the proposed subdivision would have no significant environmental impact and is in conformance with all state and local laws and regulations, and applicable Gener al Plan Elements. The Final Map conforms to the Tentative Map. As a vesting tentative parcel map application, its associated approval confers a vested right to proceed with development in substantial compliance with the ordinances, policies, and standar ds in effect at the time the vesting map is deemed complete by the City. In this case, the application was deemed complete on September 14, 2013, and therefore the development is subject to the development standards of the 1988 Zoning Ordinance (as amended ) in effect at that time and not the current Zoning Ordinance. A Design Compatibility Permit was not required for the project because the site is located within the R2 zoning district, and according to Section 9.04.20.15.020 of the 1988 Zoning Ordinance (as amended), such a permit is not required for condominiums in the R2, R3, and R4 districts. The developer will be required to show proof of payment of the condominium tax of $3,000 prior to issuance of a building permit. The Final Map has been approve d by the Los Angeles County Engineer’s office and certified by the City Engineer for conformance with the Tentative Map and conditions thereon, the Subdivision Map Act and local ordinances. The City Engineer’s office indicates that there are no required o ff - site public improvements. The City Attorney's office has approved the Covenants, Conditions and Restrictions for the Final Map as complying with the conditions of the Tentative Map and applicable laws. 3 o f 3 Financial Impacts and Budget Actions There is no immediate financial impact or budget action necessary as a result of the recommended action.
