SR 09-13-2016 8A Ci ty Council Report City Council Meeting : September 13, 2016 Agenda Item: 8.A 1 of 10 To: Mayor and City Council From: Karen Ginsberg, Director , Community & Cultural Services Subject: Venue Guarantee Letters with LA 2024 Exploratory Committee (LA 2024) and International Olympic Committee (IOC) for Beach Volleyball during 2024 Olympics Re commended Action Staff recommends that the City Council : 1. A uthorize the City Manager to submit a venue guarantee letter to LA 2024 for use of Santa Monica State Beach for Beach Volleyball during the 2024 Olympics ; and 2. Authorize the Mayor to submit a letter in support of the Candidature Questionnaire for the City of Los Angeles to the International Olympic Committee . Executive Summary Los Angeles is one of four cities bidding to host the 2024 Olympic and Paralympic Games (Games). The LA 2024 Exploratory Com mittee (LA 2024) is seeking both a venue use guarantee letter from Santa Monica to stage beach volleyball on Santa Monica State Beach and a separate letter to the International Olympic Committee (IOC) agreeing to certain assurances as part of the Los Angel es Candidature Questionnaire. The guarantee letter provides conceptual approval on the part of the venue owner and agreement to minimum terms that would form the basis of the Venue Use Agreement that would be executed in the future, should LA be successf ul in winning the bid . The minimum terms specify the Exclusive Use Period, which would begin on April 1, 20 24 for a portion of the 1550 lot and on June 1, 20 24 for the beach area, and run through August 18, 2024 for both the 1550 lot and the beach. The re ntal fee would be based on the formula used for large events in the 1550 lot, as established by the 1550 Lot Cultural/Entertainment Policy, and the formula used to calculate the fee for private use of the beach. Based on the preliminary plan, the fee, base d on current rates, would be approximately $3.7 million and includes rental of the 1550 lot and the beach area as well as reimbursement for loss of parking revenue. Operational costs for other City departments would be negotiated as part of the Venue Use A greement. The IOC letter provides a number of commitments by the City such as not staging major public events du r ing the Games, protecting the marketing rights of the Organizing Committee for the 2024 Games (OCOG), providing basic public services during the 2 of 10 Games, and working cooperatively with the U.S. Department of Homeland Security, which is charged with providing security during the Games. LA 2024 has presented a preliminary plan to the City and has briefed a number of boards and commissions, beach r esidents, and the Pier lessees on the concept. The IOC will select the host city in September 2017; if LA wins the bid , detailed plans would be developed and a full planning process , similar to what has been used to successfully stage the LA Marathon, woul d be initiated to examine and address all challenges . Background Spearheaded by LA Mayor Eric Garcetti, Los Angeles officially launched its bid to host the 2024 Olympic and Paralympic Games (Games) on September 1, 2015 with a unanimous vote by the LA Ci ty Council in support of the city’s quest to host its third international Olympiad. Although Boston was initially selected as the preferred venue by the US Olympic Committee, their subsequent withdrawal cleared the way for LA to seek to bring the Summer Games back to the United States for the first time in what would be 28 years since the Atlanta Summer Olympics in 1996. Los Angeles is one of just four international finalists for the 2014 games along with Rome, Paris and Budapest. The LA 2024 Explora tory Committee (LA 2024) officially launched the two year effort to secure the bid at a ceremony at the Annenberg Community Beach House immediately following the LA City Council vote. The announcement was purposefully held on Santa Monica State Beach to hi ghlight the key role that beaches have played in the development of new and exciting sports and inspiring a new generation of athletes. The two year bid process culminates in September 2017 with the International Olympic Committee’s (IOC) selection of th e Host City. Over the next twelve months, LA 2024 will submit a number of documents and presentations to the IOC as well hosting an Evaluation Committee visit. The other three cities vying for the 2024 Olympic bid are Paris, Rome and Budapest. Discussion As part of the bid process, LA 2024 is required to submit a venue guarantee from each 3 of 10 of the proposed venues to the IOC in October 2016. The venue guarantee letter (Attachment A) establishes the minimum terms (dates of exclusive use , rental fee , municipa l services, merchandising, broadcasting rights, exclusive concession rights ) that would form the basis of the Venue Use Agreement that would be executed in the future, should Los Angeles be awarded the bid. As part of the Candidature Questionnaire that LA 2024 must submit to the IOC, each venue has been asked to submit an accompanying letter that provides assurances of commitments required by the IOC. The IOC letter (Attachment B) includes the following commitments:  City would not stage major events during the period that would conflict with the Games  City would take reasonable measure s to protect the marketing rights of the OCOG  City would provide the normal base level of public services during the Games  The City would require that all construction would co mply with local planning, environmental, health and safety, labor and anti -corruption laws  The City would make the operations of the City’s Transportation Management Center available to support the Games transport and traffic solution s  The City would work cooperatively with the Department of Homeland Security which is charged with providing security during the Olympic Games Since the Games are eight years away, the proposal for beach volleyball on Santa Monica State Beach has been presented as a guarantee of minimum terms , with the details and solutions to the many challenges to be addressed during the seven years of planning prior to the Games . In an effort to mitigate concerns that the Council might have making this commitment so far in advance, LA 2024 h as provided a side letter (Attachment C) that makes clear that absent a mutual agreement on the definitive venue use agreeme nt, the venue use guarantee would be rendered null and void years prior to 2024. LA 2024 has proposed having the definitive agreemen t completed by December 31, 2018. LA 2024 Beach Volleyball Proposal Beach volleyball is the only Olympic activity proposed for Santa Monica. The Games are scheduled to begin on July 19, 2024 and run through August 4, 2024; the Paralympic Games are held t wo weeks after the Olympic Games, however, beach volleyball would not be part of the Paralympic Games and would not be held in Santa 4 of 10 Monica. LA 2024 is proposing to stage the beach volleyball venue on the beach, north of the Santa Monica Pier, between Li feguard Stations 14 and 15; the proposed concept plan is shown in Attachment D . The proposed 12,000 seat temporary stadium would be built on the sand, just north of the 1550 lot and would include a center competition court. Additional warm up and practice courts would be located on the sand as well as tents for the athletes. The entire 1550 lot would be used during the month of July and throughout the Games to stage operational and broadcast components. Additional highlights of the proposed plan include the following: There would be two volleyball sessions per day during the two week run of the Games, including night games; spectators would be expected to arrive at staggered times to enjoy the Olympic festival atmosphere Ticket holders would enter the ve nue at the beach level after walking down the Pier; LA 2024 would build an additional set of stairs from the Pier south of the existing stairs and would build an accessible ramp from the Pier to the venue entrance on the beach The entire site, including the 1550 lot and sand area, would be surrounded by a 10’ security fence; the proposed plan shows the fence in front of three residences A temporary bike path would be constructed on the sand to go around the site and under the Pier to meet the existing b ike path south of the Pier A portion of the 1550 lot would remain open next to the Pier and controlled to provide access for deliveries to Pier businesses and the northeast portion of the lot would be open for parking for the nearby residents; the Broadw ay overpass would also remain open No onsite parking would be available to Olympic ticket holders; all attendees would be expected to arrive at all venues by public /alternative transportation  Security within the venue would be under the direction of the federal government, which is charged with providing security at the Olympic Games The preliminary construction plan would phase the closure of the 1550 lot and the beach area as follows: o April and May 2024: 400 spaces in 1550 lot would be occupied o Ju ne 2024: 800 spaces in 1550 lot would be occupied as well as the beach construction area o July 1, 2024 - August 4, 2024: entire 1550 lot (1175 spaces except for controlled areas) and entire beach area fenced off o August 5, 2024 - August 18, 2024: tear d own; 800 parking spaces occupied in 1550 lot The rental fee would be based on established formulas that are used to calculate the rent for large scale events in the 1550 lot and for the permitted use of portions of the 5 of 10 public beach by the private beach c lubs and properties along Palisades Beach Road. The use of formulas would allow adjustments to be made to preliminary projections as conditions change over the next eight years. Based on the preliminary plan and construction schedule, the rental fee would be approximately $3.7 million in 2016 dollar as shown below. Site Rental 1550 lot 1,330,027.00 $ Beach 562,733.00 $ Total Site Rental 1,892,760.00 $ Potential Parking Revenue Loss 1,825,239.00 $ Total 3,717,999.00 $ Rental Calculation Summary This is based on the established rates for use of the 1550 lot as part of the 1550 Lot Cultural/Entertainment Policy that are currently set at $1.37 per square foot for timed events and $1.08 per square foot for untimed events plus the potential parking revenue loss. The rental rate for the 475,765 square foot area of the beach is based on the $5.50 per square foot per year rate that was established in the 2012 appraisal for beach recreation u se. The rental fee would be adjusted by the Consumer Price Index for all Urban Consumers (CPI -U) for the Los Angeles -Orange -Riverside County area published by the U.S. Bureau of Labor Statistics, for the cumulative increase from December 2016 through Dece mber 2023 . Since these rates are for property rental, they are not tied to a cost of service limit and market rates may be charged. Given that parking rates are expected to increase during the next eight years and additional parking spaces are planned as p art of the Deauville site underground storm water project, there would need to be adjustments in the parking revenue loss calculation for the 1550 lot that would be possible under the proposed formulas . Additional operating and staff costs for City departm ents would be determined as part of the Venue Use Agreement. Closing the 1550 lot for the month of July and reducing capacity during the months 6 of 10 preceding the Games would be a major impact. Although traffic and circulation patterns may be different in 2024 , a major initiative would be planning for alternative parking and transportation options along with the communication plan for informing residents and visitors of how best to access the Pier and beach area prior to and during the Games. These options , whi ch might include shuttles from the south beach lots and use of satellite parking lots close to Expo stations at the east end of the city, as well as communication strategies, would b e considered during negotiation of the Venue Use Agreement. Public Outre ach Staff worked with the LA 2024 Communications Team to schedule a number of presentations to beach residents, several Boards and Commissions, and the Pier lessees to solicit feedback on the proposal to hold beach volleyball on Santa Monica State Beach as part of the 2024 Olympic Games. The following is a summary of these community discussions. Beach residents All residents living north and south of the proposed site and businesses on Ocean Avenue were sent postcard invitations to attend a presentation o n July 11, 2016. Only a handful of residents attended the meeting and related their neighbors’ view that they did not attend since this is so far off in the future. Those in attendance were very supportive of the Games and thought the impacts would be mana geable for the nearby residents. Planning Commission LA 2024 made a presentation to the Planning Commission on July 13, 2016. Commissioners were generally supportive and excited by the possibility of the Games in 2024. Comments included a reminder that the Pier is a local landmark so that any temporary additions would need to be done sensitively as well as seeking assurance that all traces of the Games would be removed. LA 2024 was asked if the location could be moved further north or if south beach had been considered. Moving further north would impact more residences and south beach would be too far from the Expo station, which would be the primary transit mode for visitors. Commissioners also asked what 7 of 10 kind of permit process would be required and staf f noted that a Coastal Permit would be necessary as well as State Department of Parks and Recreation review since the beach is State owned. Santa Monica Pier Corporation There was a lively discussion at the Pier Board meeting on July 18, 2016. Many Board members expressed concern about the impact the closure of the 1550 lot would have on Pier businesses and asked LA 2024 if there was provision for helping tenants who are negatively impacted or providing for a minimum guarantee for proven business loss. Oth ers questioned whether crowd modelling would be done and if there is precedent for making temporary improvements more permanent or if improvements could be made earlier than the Games. Several Board members acknowledged the once in a generation event and t he long -term visibility and exposure that the Games would bring to the Pier. There was discussion of the need to better understand the economics of the Pier businesses and to do advanced planning to help mitigate potential losses. Recreation and Parks Com mission The Recreation and Parks Commission was briefed on the plan at its meeting on July 21, 2016. Commissioners asked if the location could be moved further south and if some of the improvements could be left behind. Commissioners voiced support for hav ing a legacy of the Games remain , such as the practice courts along with a plaque. Following a generally positive discussion, the Commission voted to unanimously support Olympic beach volleyball on Santa Monica Beach with a recommendation that some permane nt structures remain. Santa Monica Pier Lessees Association LA 2024 presented the proposed plan to the Santa Monica Pier Lessees Association (SMPLA) on August 31, 2016. The lessees voiced serious concerns about the impact eliminating public parking in the 1550 lot would have on their businesses and asked if the venue could be moved further south and not take up the parking lot. The issue of sufficient capacity on the Pier to handle the additional crowds coming to the beach volleyball venue was also mention ed. Several suggestions to mitigate the impacts on 8 of 10 the Pier businesses include having the City ask for more money to give to the lessees in the form of rent credit or business loss recovery, working with the Pier on cooperative concession opportunities, an d providing City resources to expand capacity on the Pier to accommodate more pedestrians . State Department of Parks and Recreation The State, acting through its Department of Parks and Recreation, is the fee owner of Santa Monica State Beach (“the Beach”). The City is the exclusive operator of the Beach in accordance with the Operating Agreement between the State and the City. Because the Operating Agreement requires the State to consent to the use of the Beach for other than use and enjoyment by the gene ral public, the City has obtained the State’s consent to allow the use of the Beach for the 2024 Olympic beach volleyball event. Alternatives The City Council could chose to not approve the v enue u se g uarantee letter and take Santa Monica out of consider ation as the beach volleyball venue. During the public outreach process, this question was raised by a number of people and LA 2024 responded that if Santa Monica passes, there are many other beach cities that would be interested in hosting beach volleybal l. Environmental Analysis Conceptual approval for the Olympic Games is statutorily exempt from CEQA pursuant to Section 15272 of the State CEQA Guidelines, which states that “CEQA does not apply to activities or approvals necessary to the bidding for, ho sting or staffing of, and funding or carrying out of Olympic Games under the authority of the International Olympic Committee, except for the construction of facilities necessary for such Olympic Games ”. If awarded the Olympic Games, the construction of th e temporary stadium on the beach would be subject to further review to determine the level of environmental clearance necessary . 9 of 10 Next Steps The selection of the host city will be made by the IOC on September 13, 2017. If Los Angeles is successful, the next step would be the negotiation of the Venue Use Agreement, which would be brought to the City Council for approval. As part of the negotiations, which would confirm the dates and rental terms, quantify the other costs for the use of the beach and the 1 550 lot, and all other legal issues, the details of the plan and its challenges would be addressed. A citywide review by departments and other stakeholders would cover all aspects of the plan and consider the questions and concerns that have been raised by the boards and commissions. This planning effort would be similar to the process used to stage the successful LA Marathon over the past six years. At the time Council would review the Venue Use Agreement, staff would also bring any changes to the Commun ity Events Ordinance that would be needed to permit the Games on the beach, similar to the temporary changes that were approved for Glow. A coastal permit would also be required and that would be the responsibility of OCOG to secure. Although there are ma ny complexities involved, staff has confidence that there would be adequate time to develop solutions and craft a workable and sustainable plan. While the impact of closing the 1550 lot for five weeks in the middle of summer and limiting its public use for several months is very significant, the proposed location for the stadium takes advantage of one of the widest sections of Santa Monica State Beach and is situated on a portion of the beach that is rarely used by visitors. The close proximity to the Expo line is another plus for the location. Many improvements are planned for the area around the Pier and beach and are expected to be completed well in advance of the 2024 Games. The replacement of the Pier bridge is expected to be under construction by 2020 and would provide a much more accessible pedestrian entry to the Pier. Improvements are slated for Ocean Front Walk north of the Pier as well as the expansion of the beach bike trail around the 1550 lot, at the north end of the beach, and between the Pier and Bay Street, and are 10 of 10 expected to be completed in 2019. The Deauville site, which is currently an unsightly storage area adjacent to the 1550 lot, will house underground storm water storage tanks and be paved to provide additional parking for the Pier a nd the beach; the project is anticipated to be open in 2017. Financial Impacts and Budget Actions There is no immediate financial impact or budget action necessary as a result of the recommended action. The Venue Owner also agrees to abide by the terms of the Host City Contract (including the Olympic Charter) as it may apply to this G uarantee (the “Guarantee”) and any other definitive documentatio n relating to the Host City Contract or this Guarantee (including any Venue Use Agreement (as defined below) as to which Candidature Committee and Venue Owner mutually agree in writing). We are honored to have the opportunity to host a Games event in our designated venue (“Venue ”), as further depicted in the red bounded -areas identified on Appendix A (“Venue Map”). The State of California (“State”), acting through its Department of Parks and Recreation, is the owner of Santa Monica State Beach (“Beach”). I n accordance with an Operating Agreement between the Venue Owner and State, Venue Owner is the managing operator of the Beach through 2051. As managing operator of the Beach , vested with all powers of representation required, Venue Owner’s governing body hereby guarantees the use of the Venue for the purposes of the preparation for and conduct of the Games, including the relevant Test Events consistent with the Minimum Terms of Guarantee (as defined below), and agrees to take all measures and grant all con sents that are within the authority or control of the Venue Owner as may be necessary to fulfil this Guarantee. This Guarantee relates to the requirements of the IOC as specified in G 2.20 as set forth in Stage 2 of the Candidature Questionnaire Olympic Games 2024. In this Guarantee: i) The Venue Use Agreement shall, at a minimum, include the following terms: a) EXCLUSIVE USE PERIOD means the periods identified in Appendix B as well as other period(s) for the holding of test events (“Test Events ”). b) NON -EXCLUSIVE USE PERIOD means the period from April 1, 2024 to June 1, 2024 for implementing a phased move -in t o the Venue; provided, however, such non -exclusive access shall not materially disrupt or otherwise interfere with the normal and customary use of the Venue as further defined under the terms of the Venue Use Agreement . ii) This Guarantee includes the exclusive use of the Venue for the Games for the EXCLUSIVE USE PERIOD, in consideration for such payments, reimbursements and/or offsets as further described in Appendix C. iii) The consideration described in Appendix C is inclusive of : a) the gener al provision of the normal and customary level of municipal services (e.g., cleaning, maintenance, police, fire, transportation, public works, and building and safety) appropriated in the Venue Owner’s Budget, at the time of the Games, b) a non -exclusiv e , irrevocable and unlimited license to the OCOG and the IOC to be provided in the Venue Use Agreement , including a right to sub -license, to use the name, image, branding and/or designs (including any material derived therefrom) of the Venue for commercial and non -commercial purposes in any and all current and/or future media directly connected with the Games, free from any third party rights and/or any further charges. iv) Event -related o perational costs of the Venue , which shall include, but not be limited to, utility expenses (electricity, water, etc.), construction costs associated with any Venue improvements, event insurance, security, and any municipal services (e.g., cleaning , maintenance, police, fire, transporta tion, public works, and building and safety) above and beyond the general provision of the normal and customary level of municipal services appropriated in the Venue Owner’s Budget during the use Casey Wasserman, Chairman Los Angeles 2024 Exploratory Committee August ___, 2016 Page 3 periods contemplated herein, are not included in the conside ration and will be payable separately by the OCOG under the terms of the Venue Use Agreement . v) This Guarantee further includes the non -exclusive access to the Venue, at no cost for the OCOG, during the NON -EXCLUSIVE USE PERIOD . vi) The Venue Owner’s governing body agrees that it will take the following actions : a) facilitate site and infrastructure visits during the period commencing upon the election of the Host City through the conclusion of the Games, for the IOC, IPC, International Federations and the host broadcaster of the Games “Olympic Broadcasting Service (OBS)” (and/or their duly authorized partners, consultants and contractors) to check the readiness of any sites and infrastructure; b) facilitate the access of OCOG staff and other rep resentatives, and other Games delegations (including Athletes and National Olympic Committees representatives) to the Venue for specific period(s) of training and venue familiarization; and c) grant all rights and take all actions as required to ensure that the terms of the “Clean Venue Appendix” attached as Appendix D is fully respected during the EXCLUSIVE USE PERIOD. vii) The Venue will be handed over to the OCOG in a clean and operational condition (including any currently planned upgrades as determ ined at the time of issuing this Guarantee and which are described in Appendix E to this Guarantee) and the terms or effect of this Guarantee will not be affected by any upgrading or reconstruction projects. viii) The Venue Owner 's governing body shall n ot circumvent Appendix D by contracting with other persons or entities (such as concessionaires, contracto rs, sports leagues, clubs etc.) and the Venue Owner agrees to take all reasonable steps to ensure any such third parties comply with the terms of the Venue Use Agreement . ix) The Venue Owner 's governing body guarantees that, should the ownership of the Venue change prior to the conclusion of the Exclusive Use Period, all terms of this G uarantee will be transferred to , assumed by and fully binding upon the future owner(s)/operator (s ). x ) The Venue Owner’s governing body further agrees the following: Casey Wasserman, Chairman Los Angeles 2024 Exploratory Committee August ___, 2016 Page 4 a) T his letter shall constitute a binding and legally enforceable commitment for the benefit of the Candidature Committee and the O COG to the Minimum Terms of the Guarantee subject in all respects to the final terms and conditions of the Venue Use Agreement . b) The entry into force of this Guarantee is conditioned upon the election of the City as Host City for the Games. In case the City is not elected, all terms contained herein shall become automatically null and void and the Venue Owner shall be released from all its obligations hereunder and the Candidature Committee shall not be liable for any compensation to the Venue Owner. c) The Venue Owner acknowledges that the OCOG will be formed after the election of the City as Host city of the Games and that all rights of the Candidature Committee and all obligations of the Venue Owner pursuant to this Guarantee shall be automatically transferred to the benefit of the OCOG without any modification upon the formation of the OCOG. Signage The Venue Owner grants the OCOG the right to have within the boundaries of the Venue and subject to applicable laws :  Exclusive use of all indoor and outdoor signage at the Venue under the control of the Venue Owner  Exclusive control of all Venue naming rights and signage (including but not limited to the right to re -brand or cover existing signage). The undersigned furt her undertakes to comply with the IOC’s requirements related to naming rights (including rules related to the treatment of non -commercial names, names of individuals, and commercial or corporate names) for the Venue used in the Games of the Olympiad from t he date of election of the Host City to the conclusion of the Paralympic Games. However, nothing herein shall be deemed to apply to any naming rights and signage related to Santa Monica State Beach, Santa Monica Pier, or any other facilities owned or oper ated by Venue Owner in the vicinity of the Venue, independently of the Games. 2. Retailing and C oncessions Venue Owner grants the OCOG the right to:  Be the sole and exclusive manager and operator of merchandise retail outlets and food/beverage concess ions within the boundaries of the Venue .  Sell Olympic and Paralympic merchandise at retail outlets and food/beverage concessions services, facilities and outlets within the boundaries of the Venue  Access all merchandise retail outlets as well as food and beverage products in the Venue  Use staff of its choice and dress such staff in uniforms of its choice to operate the merchandise retail outlets and food/beverage concessions within the boundaries of the Venue 3. Ticketing and H ospitality The Venue Owner grants the OCOG the exclusive right to:  Manage and sell tickets and hospitality in relation to the Games for the Venue  Manage and sell suites and specialty seats in relation to the Games for the Venue  Throughout the term of the lease agreement, the Venue Owner shall not subject the OCOG to any taxes or parking charges that do not apply generally within the entire jurisdiction of the Venue Owner . 4. Broadcasting and Sponsorship Throughout the term of t he lease agreement, the Venue Owner agrees that the IOC and/or the OCOG has the exclusive right to sell broadcast, sponsorship or any other multimedia rights in relation to the Games being held at the Venue. 5. Exclusive U se of Olympic Marketing Partners’ P roducts The Venue Owner agrees that the OCOG shall have the right to exclusively use products and services of Games marketing partners at the Venue (and re -brand existing products and services, to the extent necessary to respect the exclusive rights gra nted to Olympic and Paralympic sponsors), including but not limited to the following product categories:  Payment systems (including but not limited to credit card acceptance, automated teller machines (ATMs) and telephone payment systems) in relation to a ll sales occurring at the Venue related to the Games  Non -alcoholic and alcoholic beverages  Audio -visual equipment including but not limited to video boards and speakers  Timing, scoring and on -venue results equipment including but not limited to scoreboa rds 6. No U se of Olympic marks The Venue Owner agrees that, at no time, shall it have the right to use any Olympic or Paralympic marks, symbols, terminology or derivatives thereof. 7. Brand Protection and Anti -Ambush A ssistance Throughout the term of the lease agreement, the Venue Owner agrees to assist the OCOG to combat attempts of ambush marketing by advertisers at the Venue who are not Olympic or Paralympic sponsors , including advertisements for use at the Venue that may, implicitly, misrepresent o r impliedly suggest sponsorship of the Games. APPENDIX E Currently Planned Upgrades Clean Beaches Project Grant at the Deauville Site The City of Santa Monica has received a Clean Beaches Initiative Grant that will capture all wet weather runoff from the 90 acre Pier Drainage Area. Two 2 sub -grades modular storage tanks will be installed in the Deauville site, adjacent to the 1550 parkin g lot. Specifically, Santa Monica Municipal Code 6.36.100 prohibits vending on beaches or in p ublic parks and Municipal Code 6.36.040 prohibits all other forms of vending without possession of a city - issued permit.  To the extent additional efforts or measures are required within its jurisdiction, the Venue City shall work with the Organizing Commi ttee for the 2024 Olympic and Paralympic Games to ensure protection of the IOC’s rights and interests in relation to the Games. With respect to Guarantee 2.11 of the IOC Questionnaire: The Venue City ’s governing body guarantees that it shall provide within the territorial limits of the Venue City, at the Venue City’s cost and expense within its appropriated budget , the normal and customary level and range of public services provided within the Venue City at large at the time of the Games . These includ e: i. police ii. fire iii. transportation iv. public works; and v. building and safety. With respect to Guarantee 2.13 of the IOC Questionnaire: The Venue City ’s governing body agrees that in cooperation with the City of Los Angeles , the Los Angeles 2024 Exploratory Commit tee, the OCOG and local, regional and national business, trade and service organizations, it will promote and encourage, to the extent permitted by law, the charging of ordinary and customary prices for goods and services associated with the 2024 Games wit hin its territorial limits (including, but not limited to, hotel rates, restaurants and related services) for anyone attending the 2024 Games, including non -accredited spectators. Under California Business and Professions Code Section 17200, the Venue City has broad authority to protect spectators and participants from unfair business practices that occur during the Games.
