13.D Request of Mayor Vazquez and Mayor Pro Tempore Winterer that the
Council direct staff to add the attached labor peace standard, modeled on
the LAX food service standard, to the leasing policies for City -owned
properties at the Promenade and the Pier, as was done for the SMO leasing
policy
In order to protect the City of Santa Monica’s i nterest in ensuring that food service operations
produce the expected revenues to the City , Lessee shall supply to the appropriate City
administrator a fully -executed labor peace agreement between Lessee (or the entity which will
operate the food service establishment) and any labor organization that is actively engaged in
representing and attempting to represent food service workers. The labor peace agreement must
be a valid and enforceable agreement whi ch prohibits the labor organization and its members
from engaging in any picketing, work stoppages, boycotts, or any other economic interference
with the food service operation for the duration of the lease and must cover all operations at the
food service establishment (other than construction, alteration or repair of the premises)
including those conducted by sublessees or under management agreements, other than non -food
retail sales.
