A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA AMENDING THE CITY OF SANTA MONICA'S LAND USE AND
CIRCULATION ELEMENT OF THE GENERAL PLAN
WHEREAS, on April 23, 2015, DK Broadway LLC, a Delaware limited liability
company, hereinafter "Developer," filed a text amendment application (15ENT-0232) to
amend the 1984 Land Use and Circulation Element ("LUCE") to authorize an unlimited
number of stories provided there is at least one level of residential use and an FAR of 4.0
(the "Text Amendment") in conjunction with Developer's application for a development
agreement at 500 Broadway; and
WHEREAS, on March 9, 2016, the Planning Commission held a duly noticed public
hearing on the Text Amendment, among other items, and at such hearing, the Planning
Commission recommended that the City Council adopt the proposed Text Amendment
based on the written findings in the staff report for that date and as reflected in the April 20,
2016 Statement of Official Action; and
WHEREAS, the proposed amendment is consistent in principle with the goals,
objectives, policies, land uses, and programs specified in the adopted Land Use and
Circulation Element. Specifically, the proposed increase in allowable FloorArea Ratio from
3.5 to 4.0 within the Downtown Core area further reinforces the Downtown as the focus of

the City, supporting the greatest concentration of activity, consistent with LUCE Objective
1.3; and
WHEREAS, consistent with this objective, the proposed amendments would allow
additional commercial and residential floor area in the Downtown Core area adjacent to the
Bayside District that would be appropriate, supported by the anticipated growth in this
transit -adjacent area in proximity to the future Expo light rail station and Colorado
Esplanade; and
WHEREAS, the proposed amendment to allow no limitations on the number of
stories of any structure containing at least one floor of residential uses, so long as the
height does not exceed the maximum height in number of feet, provides a housing
incentive and would provide projects with greater design flexibility in achieving allowable
floor area; and
WHEREAS, the amendment supports residential mixed-use development and would
result in increased housing opportunities, consistent with Policy 1.3.5 which encourages
residential uses in the Downtown on upper floors and neighborhood commercial uses for
the Downtown residential community; and
WHEREAS, the public health, safety, and general welfare require the adoption of
the proposed amendments in that the general welfare of the City is enhanced when the
development of new mixed-use housing projects in the Downtown area is encouraged.
LUCE Objective 1.3 seeks to reinforce the Downtown as the focus of the City, supporting
the greatest concentration of activity. The proposed amendments would allow for greater
density in an area of the Downtown where appropriate, supported by the anticipated growth

in this transit -adjacent area in proximity to the future Expo light rail station and Colorado
Esplanade.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to Santa Monica Municipal Code Section 9.04.20.18.100, the
City Council of the City of Santa Monica does hereby amend the City of Santa Monica
Land Use and Circulation Element as set forth in Exhibit 1, attached to this Resolution and
incorporated herein by reference.
SECTION 2. The Clerk of the City of Santa Monica shall certify to the adoption of
this Resolution, which shall be in full force and effect immediately.

The 1984 LUCE Policy 1.3.6 is hereby amended to read as follows:
1.3.6 Until a Third Street Mall and Downtown Core Area Specific Plan is adopted,
allow in the Downtown area a maximum of:
Core Area: 4 stories (56'); 3.6 FAR
Frame: 4 stories (56'); 2.5 FAR
and permit by site review up to:
Core Area: 6 stories (84'); 4.0 FAR
Frame: 6 stories (84'); 3.0 FAR
There shall be no limitation on the number of stories of any structure
containing at least one floor of residential uses so long as the height does not
exceed the maximum hei ht in number of feet.
