R10924City Council Meeting: November 10, 2015 Santa Monica, California RESOLUTION NUMBER /012A (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA SETTING THE TAXICAB FRANCHISE FEES AND TAXIMETER RATES WHEREAS, the City of Santa Monica manages taxicab franchises to ensure an effective and efficient taxicab fleet that meets a common standard of care; and WHEREAS, the City Council of the City of Santa Monica ("Council') is authorized to set annual taxicab franchise fees, annual taxicab vehicle permit fees, and annual taxicab driver permit fees; and WHEREAS, Council is authorized to set taximeter rates by resolution; and WHEREAS, the annual taxicab permit fees are set at an amount that covers the City's administrative costs to manage the taxicab franchises; and WHEREAS, on November 9, 2010, Council adopted Resolution No. 10542 (CCS) establishing annual taxicab franchise fees and taximeter rates, and WHEREAS, on June 28, 2011, Council adopted Resolution No. 10591 (CCS), modifying the taximeter rates; and WHEREAS, on September 27, 2011, Council adopted Resolution No. 10615 (CCS), modifying the taximeter rates; and WHEREAS, on June 25, 2013; Council adopted Resolution No. 10753 (CCS), setting forth the annual taxicab franchise fees and taximeter rates; and WHEREAS, authorizing franchisees to offer set mileage rates, fiat rates or other 1 negotiated rates pursuant to exclusive arrangements with any business establishments for the specific purpose of providing pre -arranged transportation services for events, employee shuttle services, or carpooling services creates much need flexibility to serve the ever changing modern transportation market place and promotes the general welfare; and WHEREAS, experience in administering the taxicab franchise program and the results of a fee study have shown that certain fees should be adjusted to more accurately reflect actual costs. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The following annual taxicab franchisee fee, vehicle permit fees, and taxicab driver's permit fees are hereby adopted: Franchise Pee: Annual base franchise fee per taxicab company $5,000.00 Annual franchise fee per vehicle in taxicab fleet $1,100.00 The per vehicle franchise fees are in addition to the base franchise fee. Vehicle Permit Pees: New vehicle permit fee $119.86 Transfer vehicle permit fee $119.86 Renewal vehicle permit fee $ 54.58 Replacement vehicle permit fee $ 38.53 Vehicle re -inspection fee $ 29.97 Taxicab Driver's Permit Fees: New and renewal taxicab driver's permit application fee $208.69 Taxicab driver's permit re-examination fee $ 66.35 Taxicab driver's permit transfer fee $ 66.35 Taxicab driver's permit replacement fee $ 29.97 Although permit fees cover the full cost of processing the permit, new taxicab driver permit fees shall be prorated monthly based on the number of calendar months remaining 4 until the permit expires in accordance with Section 6.49.070 (e) of the Santa Monica Municipal Code. SECTION 2. The following taxicab taximeter and flat rates are established: Mileage Rates: $2.85 flag drop (first 119th mile) $0.30 for each additional 119th mile ($2.70 per mile) $0.30 for each 37 seconds waiting/delay ($29.19 per hour) Airport Flat Rates: North of 1-10 to Los Angeles International Airport $35 maximum South of 1-10 to Los Angeles International Airport $30 maximum Santa Monica to Bob Hope Airport $75 maximum Except as otherwise set forth in this Resolution, a taxicab company may establish flat rates to any destination, however, said flat rate may not exceed the maximum that would otherwise be paid at the mileage rate established by this resolution. Notwithstanding the foregoing, a taxicab company may set mileage rates, flat rates or other negotiated rates pursuant to an exclusive arrangement with any business establishment that is for the specific purpose of providing prearranged transportation services for events with multiple participants, employee shuttle services, carpooling services, or other arrangements. Any such rates shall be filed with the City five business days prior to their implementation. SECTION 3. Senior citizens (persons age 65 and older) and persons with disabilities (including persons with a Los Angeles County Transit Operators Association 3 Metro Disabled Identity Card) shall be given 10% taxicab fare discount. The discount shall apply to all destinations and trips. SECTION 4. Resolution No. 10615 (CCS), adopted on September 27, 2011, is hereby repealed. SECTION 5. If there are any conflicts between the fees and rates adopted in this Resolution and any adopted prior resolution or schedule, the fees and rates adopted through this Resolution shall take precedence. SECTION 6. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
