R10900City Council Meeting: July 28, 2015 Santa Monica, California RESOLUTION NUMBER WWO (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING OVERTIME AND PORTAL -TO- PORTAL PAY FOR FIRE DEPARTMENT EMPLOYEES RESPONDING AWAY FROM THEIR OFFICIAL DUTY STATION WHILE ASSIGNED TO MUTUAL AID EMERGENCY INCIDENTS WHEREAS, the City of Santa Monica (the "City ") is a public agency located in the County of Los Angeles, State of California; and WHEREAS, it is the City's desire to provide fair compensation to all of its employees for time worked; and WHEREAS, the Santa Monica Fire Department ( "SMFD "), a department of the City, employs fire response personnel with the following classifications: Fire Chief, Deputy Chief, Assistant Chief, Division Chief, Battalion Chief, Fire Captain, Engineer, Firefighter /Paramedic, Firefighter /EMT, and Firefighter (collectively, "Fire Response Personnel "); and WHEREAS, the City has historically compensated its Fire Response Personnel portal -to- portal, including any applicable overtime rates, in accordance with associated Memoranda of Understanding ( "MOUs "), while in the course of their employment and away from their official duty station and assigned to a mutual aid emergency incident, in 1 support of a mutual aid emergency incident, or pre - positioned for a mutual aid emergency response; and WHEREAS, the City desires to memorialize this practice. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. Fire Response Personnel will be compensated portal -to- portal and at any applicable overtime rates in accordance with their associated MOUs, including any side letter agreements approved in connection therewith, while in the course of their employment and away from their official duty station and assigned to a mutual aid emergency incident, in support of a mutual aid emergency incident, or pre - positioned for a mutual aid emergency response, beginning at the time of initial dispatch until the time of return to their official duty station, when equipment and personnel are in service and available for agency response. SECTION 2. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
