SR-07-28-2015-3S 603-007/603-010City Council Regular Meeting: July 28, 2015 Agenda Item: 3.S To: Mayor and City Council From: Donna Peter, Director, Human Resources Department Subject: Resolution Authorizing the City Manager to Execute Memorandum of Understanding with the Public Attorneys Union (PAU), the Public Attorneys Legal Support Staff Union (PALSSU) & Supervisory Team Associates (STA) , revisions to the Executive Pay Plan (EPP) and establishment of the Confidential Unrepresented Employees (CUE) Pay Plan Recommended Action Staff recommends that the City Council: 1. Adopt the attached resolution accepting the tentative agreements and authorizing the City Manager to execute Memoranda of Understanding (MOU) between the City and the Public Attorneys Union (PAU), the Public Attorneys Legal Support Staff Union (PALSSU), the Supervisory Team Associates (STA), and to execute revisions to the Executive Pay Plan (EPP), and establish the Confidential Unrepresented Employees (CUE) Pay Plan. 2. Approve the attached revised salary schedule effective as a result of the negotiated tentative agreements reached for the classifications represented by PAU, PALSSU, STA, EPP and CUE. Executive Summary Negotiations for successor MOU between the City and the following bargaining units have resulted in tentative agreements: PAU, PALSSU and STA. The terms of the tentative agreements are summarized below. Revisions are also being proposed to the Executive Pay Plan (EPP) as well as a memorialization of the terms and conditions of employment for the CUE. The total cost of the negotiated changes is approximately $393,745 for FY 2015 -16. The budget impact of these changes was included in the General Fund FY 2015 -16 through FY 2019 -20 Five Year Financial Forecast. Background The MOU's with PAU, PALSSU and STA expired June 30, 2015. Per the terms and conditions of the MOU's, negotiations with PAU, PALSSU and STA for successor MOD's have resulted in tentative agreements on the terms for new MOU's. The Executive Pay Plan (EPP) establishes terms and conditions of employment for 1 of 5 Department Heads and other at -will employees who receive EPP benefits as part of separate employment contracts. There is no expiration date for the EPP; terms are amended as needed and typically occur as changes are made to agreements with other non -sworn employee bargaining units. The establishment of the CUE pay plan memorializes and establishes the past - practice setting forth salary, benefit and additional terms and conditions of employment for employees in classifications not represented by a bargaining unit, covered by the EPP, or covered by separate employment agreements. Discussion The substantive terms of the tentative agreements are summarized for each bargaining unit or group as follows: PAU Term of the Agreement A one -year extension of.the current agreement has been negotiated with PAU effective July 1, 2015, through June 30, 2016. Significant Negotiated Changes An extension of the current MOU includes a 1.5% cost of living adjustment effective July 2015 as a result of the current "me -too' clause, an extension of the sunset clause relating to performance bonuses, and non - substantive language revisions PALSSU Term of the Agreement A three -year agreement has been negotiated with PALSSU effective July 1, 2015, through June 30, 2018. Significant Negotiated Changes 1. 1.5% cost of living adjustment effective July 2015 2 of 5 2. 1.5% cost of living adjustment effective July 2016 3. "Me -too" clause pertaining to any salary increase effective July 2017 4. One additional non - cashable leave day effective July 2015 5. One additional non - cashable leave day effective January 2016 STA Term of the Agreement A two -year agreement has been negotiated with STA effective July 1, 2015, through June 30, 2017. Siqnificant Negotiated Changes 1. 1.5% cost of living adjustment effective July 2015 2. 1.5% cost of living adjustment effective July 2016 3. Restructure vacation cash out program, effective July 2016 4. Ability to carry over three management leave days effective July 2015 5. Implement $75 /month cell -phone stipend for certain classifications 6. Bonus pay for certain desirable professional certifications 7. Increase to Tuition Reimbursement to $2,750 1year 8. One -time $350 boot allowance EPP Term of the Agreement While there is no contract expiration for the EPP, this amendment would set salaries for EPP covered employees for a one -year period through June 30, 2016. Revisions 1. 1.5% cost of living adjustment effective July 2015 CUE Term of the Agreement While there is no contract expiration for the CUE pay plan, this resolution would set 3 of 5 salaries for CUE employees for a one -year period through June 30, 2016. Significant Terms 1. 1.5% cost of living adjustment effective July 2015. 2. Employees shall have the benefits and privileges of employment as set forth in the MOU between the City and the bargaining unit for which they have been determined to be aligned to, and may be amended from time to time. Those benefits shall include, but shall not be limited to, annual COLA's, recognition of exceptional performance, management incentive pay, sick leave, vacation leave, management leave, bereavement leave, family leave, and paid holidays. Retirement and health benefits are outlined in the umbrella agreement between the City and the Coalition of Santa Monica Employees. The CUE Pay Plan sets forth terms and conditions of employment for employees occupying the following confidential unrepresented classifications: • Executive Administrative Assistant (Human Resources), aligned to M EA • Human Resources Analyst, aligned to ATA • Senior Human Resources Analyst, aligned to ATA • Human Resources Manager, aligned to MTA • Human Resources Information Systems Analyst, aligned to ATA • Assistant City Treasurer, aligned to MTA • Budget Manager, aligned to MTA Attached is a resolution for Council consideration approving the tentative agreements and authorizing the City Manager to execute Memoranda of Understanding for PAU, PALSSU and STA bargaining units, a revised EPP and CUE Pay Plan, and a resolution approving the revised salary schedule effective as a result of the negotiated tentative agreements reached with the various bargaining units. 4 of 5 Financial Impacts and Budget Actions The total cost of the negotiated changes contained in the new agreements is approximately $393,745 for FY 2015 -16. The budget impact of these changes was included in the General Fund FY 2015 -16 through FY 2019 -20 Five -Year Financial Forecast. FY 2015 -16 appropriations for all funds will be included in the FY 2015 -16 Midyear Budget for Council approval.
