R10887City Council Meeting 6 -23 -15 ATTACHMENT C1 Santa Monica, California RESOLUTION NO.��� (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA REVISING PORTIONS OF THE CITY'S SCHEDULE OF VARIOUS PERMIT AND USER FEES AND CHARGES IN THE PLANNING AND COMMUNITY DEVELOPMENT, PUBLIC WORKS, POLICE, FIRE, RECORDS AND ELECTION SERVICES, FINANCE, COMMUNITY AND CULTURAL SERVICES AND HOUSING AND ECONOMIC DEVELOPMENT DEPARTMENTS, IN THE CITY MANAGER'S OFFICE AND FOR THE SANTA MONICA PUBLIC LIBRARY, AND ESTABLISHING CERTAIN PERMIT AND USER FEES AND CHARGES IN THE PLANNING AND COMMUNITY DEVELOPMENT, PUBLIC WORKS, RECORDS AND ELECTIONS SERVICES AND COMMUNITY AND CULTURAL SERVICES DEPARTMENTS WHEREAS, it is the policy of the City of Santa Monica (the "City ") to charge for the full costs of services provided by City Staff when such services benefit individual users, rather than members of the community as a whole; and WHEREAS, Ordinance Number 1754 (CCS) (the "Ordinance "), adopted July 12, 1994, governs the setting of the amount of user fees or fees for services provided to or for the benefit of particular individuals rather than the general public and allows such user fees or fees for services to be set by ordinance, by a resolution adopted by the City Council, or by any other means authorized by law; and WHEREAS, in accordance with the Ordinance, the City has previously adopted various resolutions setting the amount of user fees or fees for services provided by various City departments to or for the benefit of particular individuals rather than the general public; and 1 ATTACHMENT C1 WHEREAS, it is the policy of the City to charge for the use of City facilities when such use benefits individuals rather than the community as a whole; and WHEREAS, pursuant to Section 2.72.010 of the Santa Monica Municipal Code, the City has the authority to establish and set the amount of fees or charges for the private commercial use of public property; and WHEREAS, the City has the authority to charge market rates for private use of public resources; and WHEREAS, the Santa Monica Municipal Airport facilities are the property of the City and open to the public for its use; and WHEREAS, the City has calculated the cost of making various facilities available at the Santa Monica Municipal Airport available for use by individuals and groups; and WHEREAS, the City makes various hangar, light aircraft covers, tie -down and aircraft parking site spaces and overnight parking spaces (outside of hangar, light aircraft covers or tie -down spaces) available for use at the Santa Monica Municipal Airport; and WHEREAS, the limited overnight vehicular parking used in conjunction with the use of aviation facilities is limited and assessment of a fee for use of such space is appropriate; and WHEREAS, on June 12, 2007, the City Council adopted Resolution Number 10221 (CCS) ('Resolution 10221 ") setting the amount of rental to be charged for the use of Santa Monica Municipal Airport property for hangar and light aircraft cover spaces, tie - downs, aircraft parking and overnight vehicle parking at Santa Monica Municipal Airport; and 2 ATTACHMENT C1 WHEREAS, on June 15, 2004, in order to preserve public resources for the benefit of the community as a whole and to avoid diverting those resources to the benefit of individuals, the City Council adopted Resolution Number 9951 (CCS) ('Resolution 9951 ") setting fees for Emergency Medical Services provided by Santa Monica Fire Department paramedics; and WHEREAS, Section 7.20.060 of the Santa Monica Municipal Code provides that the City Council may, by resolution, establish the price for all property, goods and services sold or provided at Woodlawn Cemetery, Mausoleum and Mortuary; and WHEREAS, on July 12, 2011, the City Council adopted Resolution Number 10593 (CCS) ('Resolution 10593 "), to amend the price schedule for property, goods and services sold or provided at the Cemetery; and WHEREAS, to maintain safety and maximize public recreational opportunities, it is necessary for the City to regulate, through a permitting process, beach /water activities for groups with more than twenty (20) children seventeen years and younger; and WHEREAS, the City desires to establish such permit fees and charges are to recover the costs of administering the permit system and other costs arising from group beach and water activities and for authorization for groups to conduct beach /water activity on Santa Monica State Beach in accordance with Santa Monica Municipal Code section 4.55.210; and WHEREAS, on June 25, 2013, after having completed a study of existing and proposed fees for various permits and for providing various services in the variou's City 3 ATTACHMENT C1 departments, the City Council adopted Resolution 10753 (CCS) ( "Resolution 10753 ") which revised and established permit and user fees charged by various City departments in order to preserve public resources for the benefit of the community as a whole and avoid diverting these resources to the benefit of individuals; and WHEREAS, Resolution 10753 further consolidated fee resolutions previously adopted by the City Council in order to streamline the process for adopting and charging City permit and user fees and to allow the public to more easily gather information about such fees; and WHEREAS, on October 22, 2013, the City Council adopted Resolution Number 10778 (CCS) ('Resolution 10778 ") in order to: include previously- omitted fees, repeal a fee previously adopted pursuant to Resolution 10753, establish two new fees, and correct minor irregularities found within the fee schedule adopted by Resolution 10753; and WHEREAS, on February 11, 2014, the City Council adopted Resolution Number 10800 (CCS) ('Resolution 10800 "), in order to revise portions of the fee schedule adopted pursuant to Resolution 10753 and revised by Resolution 10778 for purposes of amending certain fees to be consistent with amounts set forth in the fee study, and correct minor irregularities in certain fee descriptions; and WHEREAS, on June 24, 2014, the City Council adopted Resolution Number 10816 (CCS) (`Resolution 10816 "), in order to: remove a waiver for plan check fees for seismic retrofitting activities; repeal certain police permitting fees and making other revisions as required by Ordinance Number 2458 (CCS); establish two new fees and revise another; increase certain fees set by and passed through to the County of Los H ATTACHMENT C1 Angeles and the State of California; incorporate the fees adopted by the Library Board and Resolution Number 10779 (CCS) into the City's comprehensive fee schedule; exempt certain fees from the annual administrative revision and increase; and making other minor corrections as necessary; and WHEREAS, on October 28, 2014, the City Council adopted Resolution Number 10845 (CCS) ( "Resolution 10845 ") establishing private and semi - private uses and rental rates for the Santa Monica Pier Carousel; and WHEREAS, on May 5, 2015, the City Council considered for first hearing an ordinance repealing the existing Zoning Ordinance, Chapter 9.04 of Article 9 of the Santa Monica Municipal Code, and adding a new Zoning Ordinance, Chapter 9.01 through Chapter 9.52, to Article 9 of the Santa Monica Municipal Code to adopt a comprehensive Zoning Ordinance; Repealing Chapters 9.08 through 9.72 of Article 9 of the Santa Monica Municipal Code and adding new Chapters 9.53 through 9.68 to Article 9 of the Santa Monica Municipal Code to establish land use and zoning - related provisions, and implementing the new Zoning Ordinance by repealing the existing official districting map and adopting the new final official districting map (the "2015 Zoning Ordinance "); and WHEREAS, the City recently completed a Cost of Services study of existing and proposed fees charged for various development and construction - related permit application user fees and services in the Planning and Community Development Department in association with the 2015 Zoning Ordinance (the "Cost Study "); and WHEREAS, the 2015 Zoning Ordinance establishes new permit types, services, and different review procedures for these development and construction - related permit 5 ATTACHMENT C1 applications, compared to the permit types and services provided in conjunction with the City's current Zoning Ordinance, as set forth in the City's current fee schedule; and WHEREAS, on May 12, 2015, the City Council adopted Resolution Number 10879 (CCS) ( "Resolution 10879 "), establishing new fees in order to revise a variety of user fees for development and construction - related permit applications and services in the Planning and Community Development Department in association with the 2015 Zoning Ordinance and to incorporate the Cost Study's findings regarding the future cost to provide services associated with these development and construction - related permit applications to be established in conjunction with the 2015 Zoning Ordinance; and WHEREAS, although not established by Resolution 10879, the Cost Study included fees for Event Permit: Parking Specialist and Event Permit: Parking Administrator; and WHEREAS, all fees and charges set forth in Resolutions 9951, 10753, 10778, 10800, 10816 and 10845, are now in full force and effect; and WHEREAS, the fees adopted pursuant to Resolution 10879 shall be effective on the effective date of the 2015 Zoning Ordinance or July 13, 2015, whichever is later; and WHEREAS, on May 7, 2015, the Library Board, pursuant to the authority granted under Section 1010 of the City's Charter, adopted a resolution setting certain fees for bulk purchase student non - resident library cards, annual and facility and meeting room use for the Pico Branch Annex; and (.1 ATTACHMENT C1 WHEREAS, the City desires to incorporate changes made by this resolution into the fee schedule adopted by Resolution 10753 and revised by Resolutions 10778, 10800 and 10816 for purposes of: incorporating the fees adopted by Resolutions 9951, 10845 and 10879 and the Library Board into the City's comprehensive fee schedule; establishing certain fees for the Santa Monica Municipal Airport and Woodlawn Cemetery, Mausoleum and Mortuary; establishing fees for Event Permit: Parking Specialist and Event Permit: Parking Administrator, Overnight Delivery, Activity Passport Replacement Card: Employee Fitness Pass Fee, establishing rental rates for Large Community Meeting Room, Reed Park – Residents, Large Community Meeting Room, Reed Park - SM Based Non - Profit Orgs., Large Community Meeting Room, Reed Park - SM Based Non - Resident and Facility Filming Rental Rates for Euclid park, East or West Room (motion); establishing Youth Group Beach/Water Activity Fees and Charges; revising the fees for Oversized Load – One Way, Oversized Load —Two Way, Returned Check Processing Fee (First NSF) and Returned Check Processing Fee (Subsequent NSF); repealing fees for DUI response – accident/injury, Newsrack Permit: Annual Renewal First Rack, Newsrack Permit: New Install First Rack, Plan Renewal, Annenberg Community Beach House, Sunset Swim – Adult, Annenberg Community Beach House, Sunset Swim — Senior, Annenberg Community Beach House, Pool Day Pass — Family Pass; clarifying exemptions from the annual administrative increase provided for herein; and making other minor revisions and corrections and administrative changes as necessary. ►/ ATTACHMENT C1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The fees for Event Permit: Parking Specialist and Event Permit: Parking Administrator are hereby established as set forth in Exhibit C, Transportation Planning and Management. SECTION 2. The fee for Overnight Delivery is hereby established as set forth in the attached Exhibit J, Records and Elections Services. SECTION 3. Rates for Large Community Meeting Room, Reed Park – Residents, Large Community Meeting Room, Reed Park - SM Based Non - Profit Orgs., Large Community Meeting Room, Reed Park - SM Based Non - Resident, are hereby established as set forth in Exhibit P1, Park Building Rental Charges. SECTION 4. Rates for Facility Filming Rental, Euclid Park, East or West Room (motion) are hereby established as set forth in Exhibit P4, Facility Filming Rental Charges. SECTION 5. Youth Group Beach/Water Activity Permit Fees and Charges are hereby established as set forth in Exhibit S, Surf Instruction and Youth Group Beach/Water Activity Fees and Charges. SECTION 6. Fees for the Santa Monica Municipal Airport are hereby established as set forth Exhibit W, Airport. SECTION 7. Fees for Woodlawn Cemetery, Mausoleum and Mortuary are hereby established as set forth in Exhibit V, Cemetery. SECTION 8. The fees for Advanced Life Support Assessment and Code -3 Response— Lights and Sire, established by Resolution 9951, as set forth in Exhibit I, 0 ATTACHMENT C1 Fire, are hereby incorporated into the City's comprehensive fee schedule. SECTION 9. The fees for Bulk Purchase Student Non - Resident Library Cards, annual and Room Rental, Pico Branch Annex as established by the Library Board and set forth in Exhibit T, Library, are hereby incorporated into the City's comprehensive fee schedule. SECTION 10. The fees established by Resolution 10845, as set forth in Exhibit X, Pier Carousel, are hereby incorporated into the City's comprehensive fee schedule. SECTION 11. The fees for Oversized Load – One Way and Oversized Load — Two Way are hereby revised as set forth in Exhibit C, Transportation Planning and Management. SECTION 12. The Returned Check Processing Fee (First NSF) and Returned Check Processing Fee (Subsequent NSF) are hereby revised as set forth in Exhibit K, Miscellaneous. SECTION 13. The fees for DUI response – accident/injury, Newsrack Permit: Annual Renewal First Rack, Newsrack Permit: New Install First Rack, Plan Renewal, Annenberg Community Beach House, Sunset Swim – Adult, Annenberg Community Beach House, Sunset Swim— Senior, Annenberg Community Beach House, Pool Day Pass — Family Pass, are hereby repealed. SECTION 14. The fees previously established and now in full force and effect, and fees established by this resolution, and as set forth in Exhibit P5, Santa Monica Swim Center – Rental Charges; Exhibit P7, Miles Memorial Playhouse – Rental Charges; Exhibit Q, Beach House; Exhibit S, Surf Instruction and Youth Group Beach/Water Activity Fees and Charges; Exhibit T, Library; and Exhibit X, Pier Carousel, are hereby exempt from the annual administrative revision and increase set 9 ATTACHMENT C1 forth in Section 20, below. SECTION 15. The fees previously established and now in full force and effect, and fees established by this resolution, and set forth in the attached Exhibit C, Transportation Planning and Engineering, Exhibit E1, Public Works – Civil Engineering; Exhibit E4, Public Works – Water Resources; Exhibit K, Miscellaneous; Exhibit M, Planning and Community Development - Taxis; Exhibit P1, Park Building and Rental Charges; Exhibit P2, Ken Edwards Center Rental Charges; Exhibit Pia, Sports Facilities Rental Charges; Exhibit P6, Miscellaneous Facilities; Exhibit O, Community and Cultural Services Program Fees; Exhibit R, Community Event Fees; and Exhibit W, Public Works — Airport, are hereby exempt from the annual administrative revision and increase set forth in Section 20, below, where indicated. SECTION 16. The minor clarifications and revisions are hereby incorporated to the City's comprehensive fee schedules as follows: 1. The attached Exhibit C, Transportation Planning and Engineering, is hereby revised to clarify that the fees for Oversized Load – One Way and Oversized Load —Two Way are not subject to the annual administrative revision and increase set forth in Section 20, below. 2. The fee descriptions for Newsrack Permit: Annual Renewal and Newsrack Permit: New Install each additional, as set forth in Exhibit E1, Civil Engineering, have been revised to reflect repeal and consolidation of certain newsrack permit fees. 3. The descriptions for Plan Checks Review Fees for Over -the Counter, Taken In, Offsite, Plan Revisions, Street Vacation, Water/Waste, and Water Service as set forth in Exhibit E1, Civil Engineering, have been consolidated for ease of 10 reference. ATTACHMENT C1 4. The fee description for Tiebacks and /or Solder Beams, as set forth in Exhibit E1, Civil Engineering, has been consolidated for ease of reference. 5. The fee description for Utility Excavation Permit: Permit Renewal as set forth in Exhibit E1, Civil Engineering has been revised for clarity. 6. The fees for Landscape & Irrigation Plan Check Fees: For Residential Property, and Landscape & Irrigation Plan Check Fees: For Multi - Family and Commercial Property, although otherwise unchanged, have been transferred to the attached Exhibit E1, Civil Engineering, from Exhibit L, Office of Sustainability and the Environment, to reflect an administrative change. 7. The description for Administrative Costs —each hour or fraction— Urban Forester as set forth in Exhibit F, Public Landscape, is hereby revised to reflect an administrative change. 8. The attached Exhibit H1, Police, is revised to clarify that the fees for Records – other reports, thefts and Records – traffic accident reports are not subject to the City's annual administrative revision and increase set forth in Section 20, below. 9. The fee descriptions for CUPA – state underground storage tank administrative charges and CUPA State Administrative Surcharge are hereby revised as set forth in the attached Exhibit I, Fire, in order to clarify that the charges are passed by the State of California. 10. The attached Exhibit Q, Beach House Programs and Classes, is revised to make minor administrative clarifications. 11. The attached Exhibit P8, Facility User Categories, is hereby revised to remove Collaborative and Sponsored Programs in to reflect an administrative 11 change. ATTACHMENT C1 12. The attached Exhibit O, Community and Cultural Services Program Fees, is revised to add clarifying language related to Program titles and fee notations. 13. The attached Exhibit T, Library, has been revised to clarify that the fees are not subject to annual administrative revision and increase set forth in Section 20, below. 14. The attached Exhibit U, Commercial Fitness of Athletic Instruction, Classes or Camps at City Parks and at the Santa Monica Beach, is revised to add clarifying language and reflect administrative changes. SECTION 17. Charges for the use of community and recreational facilities which are not listed in the attached fee schedule shall be determined by the Community and Cultural Services Director and shall be based upon the costs incurred in providing the facility or program. SECTION 18. Organizations using City recreational facilities may be charged additional costs beyond those listed in the attached fee schedule when: 1. Use of the facility by any organization requires facility coverage or maintenance beyond that normally provided. 2. Use of the facility results in damage to the facility interior, exterior or its furnishings. SECTION 19. Unless otherwise provided, for accounts that are not paid by the due date, a late fee of ten percent (10 %) shall be charged on any unpaid balance, and an additional late fee of ten percent (10 %) shall be charged on any unpaid balance each month thereafter. The Director of Finance shall have the authority to settle disputes by reducing or waiving amounts due for penalties and interest on delinquent fees if such 12 ATTACHMENT C1 reduction or waiver serves to promote the City's fiscal welfare by expeditious payment, enhancing revenue or otherwise. SECTION 20. Commencing on July 1, 2015 and on July 1 of each fiscal year thereafter, all fees established and /or revised by Resolutions 10753, 10778, 10800, 10816 and this resolution, unless noted otherwise, shall be administratively revised and increased annually by a factor equal to the net change in City salaries and benefits costs for that fiscal year. Such net change is measured by comparing the total budgeted City salary and benefit costs for the fiscal year in which the change is to become effective to the total budgeted City salary and benefit costs for the prior fiscal year. Notwithstanding the foregoing, in no event shall the annual administrative revision set forth in this Section 15 be less than zero percent (0 %). Notwithstanding the foregoing, in no event shall the annual administrative revision described in this Section 15 apply to any fees and charges established by other agencies or as otherwise may be prohibited by applicable law. SECTION 21. Charges and fees set by Resolutions 9951, 10753, 10778, 10779, 10845, 10880, 10816 and as established by the Library Board as set forth in Exhibit T, Library, are currently and shall remain in full force and effect following the effectiveness of this resolution, excepting therefrom the fees for Oversized Load — One Way and Oversized Load —Two Way, as set forth in Exhibit C, Transportation Planning and Management; fees for Returned Check Processing Fee (First NSF) and Returned Check Processing Fee (Subsequent NSF) as set forth in Exhibit K, Miscellaneous which are revised as indicated by this Resolution. SECTION 22. Fees for Event Permit: Parking Specialist and Event Permit: Parking Administrator as set forth in Exhibit C, Transportation Planning and 13 ATTACHMENT C1 Engineering; the Overnight Delivery Fee, as set forth in Exhibit J, Records and Election Services; Returned Check Processing Fee (First NSF) and Returned Check Processing Fee (Subsequent NSF) as set forth in Exhibit K, Miscellaneous; the Youth Group Beach/Water Activity Fees and Charges, as set forth in Exhibit S, Surf Instruction and Youth Group Beach/Water Activity Fees and Charges, fees for the Santa Monica Municipal Airport as set forth in Exhibit W, Public Works — Airport; and fees for Woodlawn Cemetery, Mortuary and Mausoleum as set forth in Exhibit V, Public Works— Cemetery, shall be effective on July 1, 2015. Fees established by Resolution 10879, as set forth in Exhibits A, Planning Division, and C, Transportation Planning and Engineering, shall be effective upon the effective date of the 2015 Zoning Ordinance, or July 13, 2015, whichever is later, and which is at least sixty (60) days after adoption of Resolution 10879, in accordance with Government Code section 66017. SECTION 23. Resolutions 10221 and 10593 are hereby repealed in their entirety. SECTION 24. If there are any conflicts between the fees adopted in this resolution and fees adopted by any prior resolution or fee schedule, the fees adopted pursuant to this resolution shall take control. If there are any conflicts between the portions of the fee schedule set forth in this resolution and any prior fee schedule, the portion of the fee schedule attached to this resolution shall control. 14 ATTACHMENT C1 SECTION 25. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect. Beach House Facility Rental and Use Charges (1) The Director shall establish and update from time to time Facility Rental and Use Charges for private events or commercial filming that are commensurate with current market rates for comparable venues. (2) To maximize facility use by the public and revenue return to the City, the Director may fix any given rental rate at his or her discretion provided that such rate is commensurate with market rate for such rentals. (3) Charges for up to 25% of certain classes of private rentals may be reduced by up to 50% for non - profit 501(c)3 organizations. The Director shall establish and update from time to time the eligibility standards for this discount. The standards shall ensure that such discount opportunities are allocated fairly and without bias, shall specify the type of uses permitted, and shall list the facilities available. The policy regarding the amount of deposit and deposit return shall be established by the Director and revised from time to time in accordance with standard industry practices.
