Council Vote: Affirmative: Councilmembers Yannatta Goldway, Jennings, Reed, Scott and Mayor Bambrick Negative: Councilmember Rhoden Absent: Councilmember van den Steenhoven CITY COUNCIL MEETING - March 4, 1980 Santa Monica, California TO: Mayor and City Council F '7B/9 3 2 6 19II0 February 19, 1980 FROM: City Staff SUBJECT: Public Hearing on Weed Abatement and Award of Contract Introduction This report requests the City Council to hold a Public Hearing on the Intention to abate weeds in Santa Monica and to award the contract to abate weeds. Background On January 8, 1980, the City Council set a Public Hearing for February 26, 1980, on the intention to abate weeds in Santa Monica (Item 6L). On January 17, 18, and 21, 1980, each parcel described in the Resolution of Intention was posted announcing the date, place, and hour of the public hearing. Attached is the Staff Report of December 28, 1979, and Resolution No. 5466 setting the date of the Public Hearing. Funds to abate these weeds are available in the amount of $33,000 in the Weed Cleaning Abatement Fund. A notice inviting bids was published in the "Evening Outlook" on January 21 and 22, 1980. Bid proposals were mailed to four contractors on January 21, 1980. Bids were opened publicly on February 13, 1980, at 3:00 p.m. in the Council Chambers. The bids were as follows: ELCO Weed Control ............ $ 28,480.00 Gary's Lot Cleaning .......... $ 31,900.00 In the usual instance, staff would recommend that the contract be awarded to ELCO Weed Control. However, the City is now engaged in active litigation with ELCO as a result of the 1978 Weed Abatement Contract. Elissauge Corporation ern 0 n 9onn To: Mayor and City Council -2- February 19, 1980 was awarded the 1978 contract, but many problems arose because of their equipment breakdowns and untrained laborers. As a result of Elissauge's irresponsible and unprofessional manner, the program was delayed and the City was eventually forced to perform much of the weed abatement program itself. The City adjusted the payment to Elissauge according to the square footage it actually cleared. Elissauge was bought by ELCO Weed Control and the ELCO Eli.ssauge Corporation filed suit over the alleged lack of full payment. Trial is now set for June, 1980. The City Attorney's Office recommends that the contract not be awarded to ELCO Elissauge in that it could be construed as approval of the quality of work performed by ELCO Elissauge, thus jeopardizing the outcome of the present litigation. Section 39576.5 of the Government Code, Title IV, Chapter 13, Weed and Rubbish Abatement, states that the contract shall be awarded to the "lowest responsible bidder." In the case West vs. City of Oakland, 159 P. 202, 30 C.A. 556, the Court states: "The term 'lowest responsible bidder' has been held to mean the lowest bidder whose offer best responds in quality, fit- ness, and capacity to the particular requirements of the proposed work, and that where, by the use of these terms, the council has been invested with discretionary power ... such discretion will not be interfered with by the courts, in the absence of direct averments or proof of fraud." Gary's Lot Cleaning performed the work in both 1977 and 1979. The work was performed in a professional and timely manner. Staff, therefore, believes that Gary's Lot Cleaning qualifies as the "lowest responsible bidder." Recommendation It is recommended that the City Council 1. Hold the public hearing; 2. Close the public hearing; To: Mayor and City Council -3- February 19, 1980 3. Overrule any objections and approve, by motion, the work to be done; and 4. Award the contract to Gary's Lot Cleaning. Beckett Cacciatore Attachments: Staff Report of Jan. 8 meeting Resolution No. 5466 (CCS) Santa Monica, California, December 28, 1979 TO: Mayor and City Council FROM: City Staff SUBJECT: Annual Weed Abatement, Rubbish and Refuse Removal Program Introduction This report consists of information relating to the 1980 Annual Weed Abatement, Rubbish and Refuse Removal Program. The program is carried out in accordance with the requirements of Chapter 13, Section 39500 to 39588, Title 4 of the Government Code. The code requires the adoption of a resolution declaring weeds and rubbish on vacant lots, improved lots, parkways, sidewalk, and dirt upon sidewalks to be a public nuisance. Each parcel upon which work is to be done must be included in the Resolution of Intention. Background The Weed Abatement Program in Santa Monica has been in operation for many years. Sealed bids are solicited from private contractors for the abatement of weeds and rubbish and award is made to the lowest responsible bidder. In 1979, weeds and rubbish were abated from 131 parcels and 63 parkways at an actual cost of $18,069.03. This year there are approximately 340 parcels upon which work will be done. In addition, there are approximately 187 parkways, fronting upon improved property, upon which work must be done. The estimated cost for this work is $38,716.33, including indirect costs of clerical.support, inspection and supplies. The costs are assessed against the property owners and collected through the property tax bills by the County on the City's behalf. WHEREAS, there are weeds growing upon the streets, sidewalks, and upon certain lots in the City of Santa Monica, which bear seeds of a wingy or downy nature or attain such a large growth as to become a fire menace when dry and are otherwise noxious and dangerous, and WHEREAS, there are accumulations of rubbish, refuse, and dirt upon certain streets, sidewalks, and lots in the City of Santa Monica, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA RESOLVES AS FOLLOWS: SECTION 1. All weeds growing upon the streets, sidewalks, or upon certain lots in the City of Santa Monica, which bear seeds of a wingy or downy nature or attain such a large growth as to become a fire menace when dry or which are otherwise noxious or dangerous are hereby declared to be a public nuisance, and SECTION 2. All rubbish, refuse, and dirt accumulated upon streets, sidewalks or upon certain lots in the City of Santa Monica are hereby declared to be a public nuisance. SECTION 3.
