R10875RESOLUTION NO. ] (City Council Series) RESOLUTION OF • OF OF ZONING MCA ORDINANCE WHEREAS, a Notice of Intent to Adopt an Initial Study and Negative Declaration for the Zoning Ordinance Update (the project) was published in the Santa Monica Daily Press and City Planning Website on December 17, 2013, in compliance with the California Environmental Quality Act (CEQA) and the City of Santa Monica CEQA Guidelines; and, WHEREAS, the draft Initial Study and Negative Declaration was made available for public comment for 33 -days, beginning on December 17, 2013 and ending on January 20, 2014. WHEREAS, as detailed on pages 2-4, the draft Initial Study and Negative Declaration tiers with and incorporates, by reference, the City's previously certified Program Environmental Impact Report [EIR] (June 2010) prepared for the LUCE pursuant to CEQA Guidelines Sections 15150, 15152, and 15168. WHEREAS, on April 14 -15, 2015 and May 5, 2015, the City Council, as Lead Agency, reviewed the final Initial Study and Negative Declaration. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council finds that the Initial Study and Negative Declaration identified that the project would not permit land uses of greater density or height than permitted under the LUCE and would not allow new development in areas where such development is prohibited under the LUCE. Therefore, based on the substantial evidence in the record, the project would not result in new significant environmental impacts related to Aesthetics, Agriculture and Forestry Resources, Air Quality, Biological Resources, Cultural Resources, Geology and Soils, Greenhouse Gas Emissions, Hazards and Hazardous Materials, Hydrology and Water Quality, Land Use and Planning, Mineral Resources, Population and Housing, Public Services, Shadows, Transportation/Traffic, Utilities, and Mandatory Findings of Significance that have not been previously examined or adequately addressed in the LUCE Program EIR. Additionally, the forthcoming Downtown Specific Plan and Memorial Park Plan will be subject to their own environmental review in compliance with CEQA. SECTION 2. The City Council has reviewed and considered the Initial Study and Negative Declaration, and the Mitigation Monitoring Program, together with the comments received during the public review process, prior to acting on the project. SECTION 3. The City Council finds, based on the whole record before it, including the Initial Study and Negative Declaration and any comments received that the Negative Declaration reflects the City's independent judgment and analysis. Therefore, the City Council hereby adopts the Negative Declaration. SECTION 4. Consistent with Public Resources Code Section 21081.6 (a) (2), the documents which constitute the record of proceedings for approving this project are located in the Planning and Community Development Department, 1685 Main Street, Room 212, Santa Monica, California. SECTION 5. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM: MARSH A J..
