Roll Call: Present: Mayor Kevin McKeown Mayor Pro Tem Tony Vazquez (arrived at 5:37 p.m.) Councilmember Gleam Davis Councilmember Sue Himmelrich (arrived at 5:35 p.m.) Councilmember Pam O'Connor Councilmember Terry O'Day Councilmember Ted Winterer Also Present: Interim City Manager Elaine Polachek City Attorney Marsha Jones Moutrie City Clerk Sarah P. Gorman CONVENE/PLEDGE On order of the Mayor, the City Council convened at 5:31 p.m., with all members present, excepting Mayor Pro Tem Vazquez and Councilmember Himmelrich. Councilmember O'Connor led the assemblage in the Pledge of Allegiance. CLOSED SESSIONS There was no one present for public comment on closed sessions. Councilmember Himmelrich On order of the Mayor, the City Council recessed at 5:32 p.m., to consider arrived at 5 :35 p. m. closed sessions and returned at 6:33 p.m., with all members present, to report the following: Mayor Pro Tem Vazquez arrived at 5:37 p.ni. I-A: Conference with Labor Negotiator. City Negotiator: Donna C. Peter, Director of Human Resources Bargaining Units: California Teamsters Local 911 (Teamsters) Management Team Associated (MTA) Public Attorneys Union (PAU) Public Attorneys' Legal Support Staff Union (PALSSU) Supervisory Team Associates (STA) 1 April 14, 2015 The City Attorney advised this matter was heard with no reportable action taken. 1 -B: Conference with Legal Counsel — Anticipated Litigation: Anticipate significant exposure to litigation pursuant to Government Code Section 54956.9 (d)(2) —1 case: 1) Claim of Dunn and Robhana The City Attorney advised this matter relates to the workout of problems with Craig Jones' default on affordable housing obligations in the downtown. The City Attorney recommended settlement of releasing certain affordable housing restrictions under certain parameters. Motion by Councilmember Davis, seconded by Councilmember O'Connor, to approve Settlement No. 10050 (CCS) as described by the City Attorney. The motion was approved by the following vote: AYES: Councilmembers Davis, Himmelrich, Winterer, O'Day, O'Connor, Mayor Pro Tern Vazquez, Mayor McKeown NOES: None ABSENT: None SPECIAL AGENDA 2 -A: Recognition of April 2015 as Fair Housing Month ITEMS: Proclamation, was presented by Mayor McKeown. REPORT ON MEETING Pursuant to State law, City Clerk Sarah Gorman announced that Council COMPENSATION will receive $50 for meeting as the Housing Authority. CONSENT CALENDAR: There being a Consent Calendar each for the City Council and the Housing Authority the Council convened to a joint meeting with the Housing Authority at 6:40 p.m., and the two Consent Calendars were heard concurrently, with all members present. All items were considered and approved in one motion unless removed by a Councilmember for discussion. Members of the public Denise Barton and People of California commented on various Consent Calendar items. Motion by Mayor /Chair Pro Tern Vazquez , seconded by Councilmember /Authority Member Winterer, to approve the Consent Calendar, reading resolutions by title only and waiving further reading thereof. TRANSIT BUSES 3 -13: Authorize a Notice to Proceed to Gillig LLC to Purchase Four 30 -foot and Twenty -Five 40 -foot Compressed Natural Gas Buses — recommendation to authorize the City Manager to negotiate and execute a modification in reference to Agreement #9855 to include the purchase of 30 -foot Compressed Natural Gas (CNG) powered transit buses and authorize a notice to proceed to Gillig LLC, in reference to Agreement 49855, to furnish and deliver four 30 -foot CNG transit buses in an amount not to exceed $2,653,026; authorize a notice to proceed to Gillig LLC, in reference to Agreement #9855, to furnish and deliver twenty -five 40 -foot CNG powered transit buses in an amount not to exceed $16,767,086; and authorize budget changes, was approved. MICHIGAN AVENUE 3 -C: Authorize Additional Funds for the Michigan Avenue Traffic TRAFFIC CIRCLES Circles Construction Project — recommendation to authorize budget changes as outlined in the Financial Impacts and Budget Actions section of this report to cover the City's $20,000 cost for water meter fees for irrigation and landscaping, and additional public outreach associated with the Michigan Avenue Traffic Circles Project, was approved. HOUSING AUTHORITY 3 -D: Housing Authority Draft Administrative and Annual Plan — recommendation that the Housing Authority Board: 1) Approve the Housing Authority's Draft FY 2015 -2016 Administrative Plan and Annual Plan provided in Attachments A and B, respectively; and 2) Authorize the submission of the Administrative and Annual Plans to the United States Department of Housing and Urban Development (HUD), was approved. ADJOURNMENT OF On order of the Mayor /Chair, the special joint meeting was adjourned at SPECIAL JOINT 6:47 p.m., and the regular City Council meeting reconvened with all MEETING members present. STUDY SESSION: 4 -A: Study Session on the Draft Zoning Ordinance, Proposed Land DRAFT ZONING Use and Circulation Element Amendments, Draft LUCE Land Use ORDINANCE AND LUCE Designation Map Amendments, LUCE Amendments and Designation Map Appeals, and Draft Official Districting Map - recommendation that CityA ttorney Moutrie uvas the City Council hold a public hearing study session to review, comment, excused at 10:02 p.m. and provided direction on the following: (1) Draft Zoning Ordinance Assistant City Attorney (Zoning Ordinance Update Redline Public Review Draft, as modified by Joseph Lawrence joined the the Greenline Changes to Redline Public Review Draft Zoning Ordinance meeting. As Recommended By the Planning Commission on March 4, 2015); (2) 3 April 14, 2015 Proposed Land Use and Circulation Element (LUCE) Amendments; (3) Draft LUCE Land Use Designation Map Amendments (112 Parcels as identified in Exhibit A of Attachment K 3); (4) Appeals of Planning Commission Denials of Specified LUCE Amendments and LUCE Land Use Designation Map Amendments; (5) Draft Official Districting Map; (6) Land Use and Zoning Related Provisions (Division 6); and (7) Initial Study/Negative Declaration (State Clearinghouse #2013121053); and City Council is further recommended to direct staff to return on May 5, 2015 with a Zoning Ordinance and related provisions for I" reading, LUCE amendments, LUCE Land Use Map amendments, and the Official Districting Map, was presented. Motion by Mayor McKeown to provide priority speaking this meeting for students high school age and under and those at the meeting with children. The motion was approved by a unanimous voice vote, with all members present. On order of the Mayor, the public hearing was closed, and deliberations were continued to Wednesday, April 15, 2015. COUNCILMEMBER 13 -A: Recommendation to accept Carter C. Rubin's resignation from DISCUSSION ITEMS: the Housing Commission and authorize the City Clerk to publish the HOUSING COMMISSION vacancy, was continued to April 15, 2015. SISTER CITY 13 -B: Request of Mayor McKeown that the Council authorize the use CELEBRATION of Council travel funds for attendance at the 40th Annual Sister City partnership celebration August 11th through 17th in Fujinomiya, Japan, for the purpose of continuing our long - standing cultural ties with Santa Monica's third sister city, was continued to April 15, 2015.
