Discussion SB 775 was introduced on February 27, 2015 by Senator Allen and amended on April 23, 2015. The bill, as introduced, is included in the original staff report for item 3 -J for the April 28, 2015 Council meeting. The bill has been significantly revised. The revised bill is now presented to Council (Attachment A). Tenancy — SB 775 SB 775 offers a technical clean -up so that cities do not have to certify rent amounts that they cannot know to be true. Under this proposal, the rent certification process would not apply to any tenancies where the landlord may freely set the initial rent pursuant to the Costa - Hawkins Act. Neither landlords nor tenants could "game the system" by attempting to have a legal rent certified at a level that is too high or too low. The bill author is working with the Santa Monica Rent Control Board on this proposal. It is likely that the rent control boards in the Cities of West Hollywood and Berkeley will support the measure. Past Council guidance indicates City support for efforts to provide vulnerable tenants with additional rights and protections from landlord abuses. And, 1 of 2 good governance measures promote transparency and trust. Therefore, staff recommends that the Council support SB 775 in its current form. Executive Summary The Council has historically taken positions on proposed state legislation of interest to Santa Monica because of the City's location, economy, programs, policies, or other experiences. Staff is now presenting a package of current State Assembly and Senate bills for the Council's consideration. Background Every year members of the California State Assembly and Senate introduce hundreds of bills. This year, the Legislature has until Sept. 11, 2015 to send measures to Gov. Jerry Brown for his signature or veto. For years, City staff in consultation with professional legislative advocacy firms have analyzed and tracked individual pieces of legislation of interest to Santa Monica because of the City's location, economy, programs, policies, or other experiences. Staff have regularly recommended that the Council support or oppose specific bills. In some cases, groups of related bills have been presented for the Council's consideration. At other times, individual bills have been brought forth. Members of the Council have also 1 of 5 identified relevant legislation and the Council has directed staff to take specific action. The City's historical support or opposition of legislative policy has, over time, created a record of policy authorization. The Council's legislative policies and actions are compiled in a compendium. Staff relies on the compendium to draft letters of support or opposition to similar legislation for the Mayor's signature without direct Council action. So far this year, the Mayor has signed approximately 10 letters in opposition or support of bills introduced into the 2015 -2016 session to communicate the Council's previously articulated policy. Additionally, staff has been in contact with Senator Allen's and Assemblymember Bloom's offices to communicate the City's prior policy position on proposed bills. Discussion Over the past few months, the City's legislative advocacy firm, staff, Councilmembers, intergovernmental, and community partners have highlighted proposed legislation that may be of interest to the City based on its location, economy, programs, policies, or other experiences. Staff considered a number of bills with the City's consultants and identified the following 18 current State Assembly and Senate bills. While the City may have supported or opposed similar or related legislation in the past, staff recommends that the Council consider these bills and take formal action. Detailed information about each bill, including staffs proposed position for the City, as well as the position of the League of California Cities, can be found in Attachment A. Sustainability - AB 585, AB 603, AB645, SB 32, SB 350, SB 687, SB788 These seven bills would incentivize water efficiency in outdoor landscaping, promote renewable energy production, set long -term greenhouse gas emission reduction targets for the State congruent with Santa Monica's policy for municipal operations, establish renewable gas standards for the production of natural gas, and enact the California Coastal Protection Act of 2015, which would prohibit offshore drilling in areas that are designated to protect and conserve marine life. All reinforce Santa Monica's sustainability goals and policies; therefore staff recommends that the City support all seven. Short-Term Rentals -AB 1220. SB 761, SB 593 AB 1220 would have prohibited cities from levying a transit occupancy tax (TOT) on short-term rental units. This bill was introduced in late February. On April 14, 2015 its 2 of 5 first hearing was cancelled at the request of the author, effectively killing the bill. Had the bill been viable, staff would have recommended opposing it as it would have resulted in an unfair advantage and eliminate local jurisdictions' ability to collect tax revenues. Staff is watching two other bills regarding short -term rentals, SB 761 and SB 593. SB 761 would require short -term vacation rental websites, such as AirBnB and VBRO, to disclose that the listing could result in eviction if the occupant does not have the property owner's permission. Staff recommends revisiting this bill based on Council's policy direction regarding short-term rentals. SB 593 would require online listing companies to report information pertaining to units being offered for tourist use and allow cities to collect TOT directly from listing companies. The League of California Cities tentatively supports this SB 593, if amended to bolster local authority and ensure congruency with other TOT policies. If the bill is amended as such, staff may present it to the Council with a recommendation to support. Transportation - SB 767 SB 767 would allow LA Metro to place another half -cent transaction and use tax before the voters of Los Angeles County for the purpose of funding transportation projects and services. Staff recommends supporting the bill as it is now, as it does not currently list individual projects and services. Instead, it authorizes the LA Metro board to develop the project list. This approach would leave flexibility for local jurisdictions, including Metro, to determine how best to fulfill both local and regional needs. Should projects be amended into the bill, staff will bring the amended bill back to Council for reconsideration. Housing - AB 90, AB 1056 AB 90 would develop an allocation plan for the State's Housing Trust Fund. Given the City's historic support of programs that provide financing for affordable housing, staff recommends supporting this bill. AB 1056 would create a housing support program for the formerly incarcerated. While the City does not have standing policy specifically dealing with housing assistance for formerly incarcerated tenants, the City has established prior policy which supports state and federal programs that assist in providing financing for affordable housing as well as supports the provision of permanent housing coupled with supportive services. Staff recommends that the City support AB 1056 as well. 3 of 5 Lifelong Learning - AB 288 On a local level, this bill would allow for greater coordination between Santa Monica College and Santa Monica - Malibu Unified School District to expand access to concurrent enrollment programs, particularly for traditionally underserved students by allowing for limited, priority enrollment for such students. The City has long endorsed the concept of a Santa Monica as lifelong learning community, a community committed to strengthening educational planning for all ages and stages of life, therefore staff recommends supporting AB 288. Tenancy - SB 775 This bill would clarify when a landlord or his or her agent agrees that a tenant's payment for rent or deposit for security is accepted or rejected. Existing law requires a landlord or his or her agent to allow a tenant to pay rent or a security deposit by at least one form of payment that is neither cash nor electronic funds transfer, except as specified. This bill contains no substantive change in law and is therefore on not track to move through the legislative process. However, based on the stated intent, and the City's historic support of legislative efforts to protect renters' rights, staff recommends that the City support this bill in concept. Open Space - SB 317 SB 317 would place a $2.45 billion bond on the 2016 ballot to fund parks ($1.45b), waterways ($370m), coastal improvement ($350), and climate protection ($280m). If passed, voter approval would be required for the bond to be issued. Staff recommends supporting SB 317. Arts - AB 189 Under this bill, the Arts Council would establish a competitive application system, provide technical assistance and promotional support, and collaborate with other public agencies and private entities to maximize the benefits of state - designated cultural districts. As the City supports state funding for local arts activities, staff recommends supporting AB 189. 4 of 5 Ivory - AB 96 The sale of ivory products is illegal in California; however, those acquired prior to the enactment of a 1977 ban are permitted. Los Angeles is one of the U.S. cities with the highest proportions of potentially illegal ivory pieces and one of the largest ivory markets overall. There is widespread confusion among vendors about what constitutes the legal and illegal sale of ivory; this bill would close a loophole and strictly ban ivory sales. Staff recommends supporting AB 96. Next Steps Staff will communicate the Council's support, opposition, and /or direction on these bills to the City's state lobbyists who will assist with preparing letters to bill authors, co- sponsors, and members of related committees, as well as communicate the City's position in other ways. Staff will watch these and other bills as they evolve during the legislative session and may return to Council with additional or revised recommendations regarding the City's 2015 - 2016 legislative platform. Financial Impacts and Budget Actions There is no immediate financial impact or budget action necessary as a result of the recommended action.
