R10863City Council Meeting: February 10, 2015 Santa Monica, California RESOLUTION NUMBER /Ocd (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER TO APPLY FOR GRANT FUNDS FOR A LAND AND WATER CONSERVATION GRANT, AND TO NEGOTIATE AND TO ENTER INTO A GRANT AGREEMENT WITH THE STATE OF CALIFORNIA DEPARTMENT OF PARKS AND RENOVATION AND ANY AMENDMENTS THERETO WHEREAS, the Congress under Public Law 88 -578 has authorized the establishment of a federal Land and Water Conservation Fund Grant -In -Aid program, providing matching funds to the State of California and its political subdivisions for acquiring lands and developing facilities for public outdoor recreation purposes; and WHEREAS, the City is currently in the process of renovating approximately 1.0 acre open grass area in the northeast quadrant of Reed Park ('Reed Park Project "); and WHEREAS, the City seeks to apply for a grant from the State of California Department of Parks and Recreation for the Land and Water Conservation Fund Grant- In-Aid program in an amount ranging from a minimum request of $300,000 to a maximum request of $600,000_ which, if granted, would be applied towards the costs of the Reed Park Project. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Santa Monica approves the filing of a grant application for Land and Water Conservation Fund assistance for the Reed Park Project to the State of California Department of Parks and Recreation in an amount ranging from a minimum of $300,000 to a maximum of $600,000. SECTION 2. If the City is awarded the grant and the parties enter into a grant agreement, the City agrees to abide by Section 6(f)(3) of Public Law 88 -578 which states: "No property acquired or developed with assistance under this section shall, without the approval of the National Secretary of the Interior, be converted to other than public outdoor recreation uses. The Secretary shall approve such conversion only if he finds it to be in accord with the then existing comprehensive statewide outdoor recreation plan and only upon such conditions as he seems necessary to assure the substitution of other recreation properties of at least equal fair market value and of reasonably equivalent usefulness and location." SECTION 3. The City certifies that it has Matching funds from eligible source(s) and can finance 100% of the Project, which up to half may be reimbursed pursuant to this grant. SECTION 4. The City Council authorizes the City Manager or Manager's designee to conduct all negotiations and to execute and submit all documents, including, but not limited to, the applications, contracts, amendments, payment `a requests, and compliance with all applicable current state and federal laws which may be necessary for the completion of the aforementioned Reed Park Project. SECTION 5. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
