SR 08-25-2015 6L6-L AUG 1 1 1981 Santa Monica, California, July 29, 1981 TO: Mayor and City Council FROM: City Staff SUBJECT: Request to Alter Contract No. 3489 (CCS) K & D Beach Rentals Introduction This report requests City Council approval to modify Contract No. 3489 (CCS) between the City and K & D,Beach Rentals (Ilya Kleinman and Haim Dahan), through the Amendment to Contract No. 3489 (CCS).in form attached hereto. Background Contract No. 3489 (CCS) between the City of Santa Monica and K & D Beach Rentals (Ilya Kleinman and Haim Dahan) allows the operation of a beach equipment rental concession for the period June 25, 1980 through December 20, 1981. In accordance with the agreement, the concessionaire is to keep open "at all reasonable times" six stands at specified locations along the beach, from which are rented beach umbrellas, chairs, water floating objects, and other beach equipment as approved by the City. The stands are located in the beach parking lots as follows: foot of Ocean Park Boulevard adjacent to the Promenade, foot of Hollister Avenue adjacent to the Promenade, 1550 Ocean Front (northwest corner of lot), approximately 1100 and 1300 Pacific Coast Highway (2 stands), and 930 Pacific Coast Highway (westerly side of lot). The stands (actually wooden sheds approximately 8 feet by 16 feet) are owned and supplied by the City. Repairs to the stands are the responsibility of the concessionaire. (,) AUG 1 1 1981 TO: Mayor and City Council Santa Monica, California, July 29, 1981 s2a K & D Beach Rentals has operated at only three of the six locations during the entire current summer season. Staff requests that all six locations be opened in accordance with the concession agreement have gone unheeded by the concessionaire, who claims that it is not profitable to operate at all six of the locations. The three stands which are not being used by the concessionaire have become the subjects of constant break4ins and vandalism. Concern has been expressed by police personnel and by local residents at the resultant hazardous condition of two of the stands, which have recently been inhabited by transients during night hours. Staff proposes to modify the existing agreement to relieve K & D Beach Rentals of the obligation to operate at three of the six locations: Ocean Park Boulevard /Promenade, 1100 P.C.H., and 1300 P.C.H. These stands could then be removed from the beach area, in the interest of public safety. The proposed agreement will reduce the rent, in the amount of $2,168, based on the removal of three stands. Total rent due for the second year of the agreement will be $7,176 with this proposed reduction. Alternatives I. City Council may decide to approve the release agreement in form attached hereto, thereby modifying Contract No. 3489 (CCS) between the City of Santa Monica and K & D Beach Rentals. 2. City Council may decide not to approve the amendment to Contract No. 3489 (CCS) in form attached hereto, thereby maintaining as is Contract No. 3489 (CCS) between the City of Santa Monica and K & D Beach Rentals. Discussion was held, as introduced by Councilmember Reed. Councilmember Reed moved to approve the staff recommendation, amending Contract No. 3489 (CCS) with K & D Beach Equipment Rentals decreasing their operations to three beach locations.
