Subject: Expo Compensation for City -owned property
Recommended Action
Staff recommends that the City Council authorize the City Manager to:
1. accept compensation of $44,800 from the Exposition Construction Authority
(Expo) for the City's grant of an easement for 160 square feet of City -owned
property located at 1800 Stewart associated with the Exposition Light Rail Transit
project; and
2. dedicate a 950 - square foot portion of City -owned property located at
502 Colorado Avenue as public right -of -way to address vehicular and pedestrian
access.
Executive Summary
To accommodate the alignment and improvements for the new Exposition Light Rail
Transit lines, Expo needs to compensate the City for granting an easement for 160
square feet of City property at 1800 Stewart. Based on comparable land values, City
staff and Expo staff have mutually agreed to recommend a total price of $44,800 as
compensation. Additionally, the City determined that a dedicated right -turn lane from
northbound Fifth Street onto eastbound Colorado Avenue was needed to address traffic
circulation in the area. To implement this roadway improvement, the City needs to
dedicate a 950 - square foot portion of the City -owned property located at 502 Colorado
Avenue as public right -of -way.
Background
Phase 2 of the Exposition Light Rail Transit (EXPO LRT) line will connect Downtown
Los Angeles to Downtown Santa Monica with three stations in Santa Monica: Olympic
Boulevard /26th Street Station (at Bergamot Arts Center); Colorado Avenue /17th Street
Station (at Memorial Park); and the Downtown Terminus Station (at Colorado
Avenue /4th Street). Phase 1 of the EXPO LRT line connecting Downtown Los Angeles
and Culver City opened in April 2012. Phase 2, extending from Culver City to Santa
Monica, is scheduled to open in 2016.

The City acquired the nine -acre parcel located at 2525 Michigan Avenue /2715
Exposition Boulevard /1800 Stewart Street from Southern Pacific Transportation
Company in 1989. The western portion of the site is approximately 5.4 acres and is
leased to Bergamot Station, Ltd. This entity manages the Bergamot Station Arts
Center, a complex comprised of over 30 art galleries, creative businesses, and a
non - profit theater company. The eastern portion of the City -owned property covering
1800 Stewart Street is approximately four acres and is leased to Agensys, Inc. under a
long -term ground lease.
The City -owned site at 502 Colorado Avenue consists of 44 low- income apartments.
The City leases the property to Community Corporation of Santa Monica (CCSM) under
a long -term ground lease in which the City does not receive any lease revenue since it
is an affordable housing development.
Discussion
In order to implement pedestrian safety measures, a pedestrian arm and emergency
swing gate needs to be built at the EXPO Light Rail crossing adjacent to 1800 Stewart
Street (Attachment A, Property Impact Statement).
At 502 Colorado Avenue, 950 square feet of land is needed to widen the corner radius
and provide a lane for cars turning from northbound Fifth Street to eastbound Colorado
Avenue. This modification will help cars avoid running directly into oncoming trains
(Attachment B, Property Impact Statement).
In order to accommodate the proposed EXPO LRT improvements, Expo and its
design - builder, Skanska- Rados, have determined that an easement on City -owned land
is needed to install Expo's pedestrian safety gate at 1800 Stewart and a dedication of
the City's property as right -of -way is needed to reconfigure the roadway at
502 Colorado.

The City and Expo evaluated comparable land values to determine the value of the
1800 Stewart easement. City staff and Expo staff have exchanged valuation analysis,
reviewed the data and have mutually agreed on a land value of $280 per square foot
which totals $44,800 for the 160 - square foot easement area to be recorded on the City
property at 1800 Stewart. Since the improvements on Colorado will remain a City
right -of -way property, no compensation is being requested from Expo.
Financial Impacts & Budget Actions
Compensation from the Exposition Construction Authority is $44,800.
Accepting compensation requires increasing the revenue budget at account
41642.401801 in the amount of $44,800.

1. LOCATION AND DESCRIPTION
Parcel Plat E2 -1101, containing 160 sq. ft. is a semi - triangular shaped parcel that is
located on the north /west corner of Stewart St. and the Metro ROW, in the City of Santa
Monica (see Exhibit C). The site is currently being developed as a parking lot to serve a
lease from the City of Santa Monica to a biotech company (Agensys).
2. NEED FOR THE PROPERTY
The existing City of Santa Monica's (CSM) property boundary limit is located along
Stewart Street near the back of the existing sidewalk. The proposed public right -of -way
is south of the existing Metro right -of -way. Please see Exhibit C for the locations of the
proposed right -of -way. The property is needed in order to construct the Project's .
pedestrian crossing arm and emergency access gate in order to comply with CPUC and
Metro Standards, thus requiring a permanent easement. Exhibit A, Legal Description,
Exhibit B, Plat, and Exhibit C, Plan and Profile Set Drawings, are attached.
3. DESIGN REQUIREMENTS
The EXPOSITION METRO LINE CONSTRUCTION AUTHORITY selected the EXPOSITION LRT
PROJECT PHASE 2 and the location of the alignment within the City of Santa Monica. A
vehicle crossing arm, pedestrian crossing arm, and an emergency exit swing gate is
required at all corners of Stewart Street.

4. CONSTRUCTION REQUIREMENTS AND TECHNIQUES
The subject property currently has a small concrete masonry unit (CMU) wall and
potential private water utility services. The current design will require the demolition of
a portion of the existing CMU wall and footing and the reconfiguration of the potential
private water utilities. SRJV has requested copies of the as -built plans multiple times for
the recently installed waterlines and has not received a response from the contractor.
The duration of construction is anticipated to be intermittent for approximately 36
months.
5. CONSTRUCTION IMPACTS
a. DURING CONSTRUCTION
i. Hardscape, utilities and related improvements within the parcel take will
be removed during construction.
ii. Construction activities may disrupt normal pedestrian traffic on Stewart
Street south of the Metro ROW within the public ROW. Proper
mitigations are required from the contractor during construction.
ill. Construction activities will be in accordance with City of Santa Monica
standards for traffic management.
iv. Noise, dust, and visual impacts common to construction projects will
exist for the duration of construction. Measures will be used to minimize
these disruptions.
V. Trucks making deliveries and hauling excavated material may cause
traffic congestion in the general area of the site.
vi. Construction activity may require access to private properties in order to
protect or install adjacent structures.
b. AFTER CONSTRUCTION
I. A 3' -6" emergency swing gate and a portion of a pedestrian swing arm
and walkway will be located in the area acquired under parcel E2 -1101.
The remaining portion of the parcel will be owned and maintained by the
City of Santa Monica and /or their lessee.
6. TYPE OF RIGHTOF WAY
Acquisition of a permanent easement (E2 -1101) will be required to accommodate the
proposed use for the widening of the Stewart Street sidewalk. The City of Santa Monica
will ultimately maintain the sidewalk and Metro will maintain the fencing, gates, and
crossing arms within the take area.
7. RECOMMENDED ACQUISITION
Acquisition of a permanent easement (E2 -1101) per the attached Exhibit A, Legal
Description, and Exhibit B, Plat, is recommended.
