SR-02-27-1979-6MSanta Monica, California February 14, 1979M TO: Mayor and City Council ' FROM: City Staff FEB 2 7 1979 SUBJECT: Recommendation to waive competitive bidding and to authorize direct negotiation for a tree root cutter. Introduction This report concerns the recommendation to waive competitive bid procedure and to authorize the City Manager to negotiate directly for a tree root cutter for use by the Street Division. This cutter will be used to limit root growth that would damage adjacent side- walks and curbs. Funds are available in account number 01- 500 -421- 000 -950, Street Division Capital Outlay. Background The Staff has checked carefully in all appropriate directories in the City's technical reference library and has found only one supplier of this type of machine, Calls to knowledgeable suppliers of land- scape and tree service equipment substantiated the Staff's findings, It is considered that issuing a formal call for bids would entail delay and additional cost with no assurance that competition would develop. Recommendation It is recommended that competitive bid procedure be waived and that the City Manager be authorized to negotiate directly for a tree root cutter, and that the accompanying Resolution be adopted. (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA WAIVING COMPETITIVE BID PROCEDURE AND AUTHORIZING DIRECT NEGOTIATION FOR PURCHASE OF A TREE ROOT CUTTER. WHEREAS, damage to curbings and sidewalks can be reduced by limiting tree root spread with a tree root cutter; and WHEREAS, only one (1) manufacturer in the United States is known to produce this specific type of equipment; and WHEREAS, to solicit bids for this machine would entail additional expense and delay with no assurance of tangible benefit. NOW, THEREFORE, THE CITY COUNCIL OF THE,CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1: That the City Council finds that the need exists for a tree root cutter. SECTION 2: That this specialized machine is available from only one (1) source. SECTION 3: That to call for bids would entail expense and delay with no assurance of tangible benefit. SECTION 4: That the City Manager is authorized to negotiate directly for this tree root cutting machine without calling for bids. APPROVED AS TO FORM: City Attorney
