SUBJECT: Request for Approval of Sub -Lease
Beach Concessions
Introduction
This report recommends that the four city -owned beach concessions
currently being leased to John Altamura and Harold Frank, dba:
Zeppy's Pizza be sublet as follows: two shops located in the
1100 and 1200 blocks of Pacific Coast Highway to be sublet to
Nancy Lindsey of 1444 15th Street, Santa Monica, California, and
current manager of those two shops located in the 2400 and 2600
blocks of the Promenade, to Picea, Incorporated, a corporation
formed of the three current managers of those shops, Melody Chacker
and Richard Chacker of 1203 2nd Street, Hermosa Beach, California,
and Hy Fleming of 1617 N. Poinsetta Place, Los Angeles, California.
Background
Nancy Lindsey has been an investor in and manager of the subject
concessions for approximately two years, and has maintained and
operated them in a credible and businesslike fashion. Although a
Dun and Bradstreet report on Ms. Lindsey proved neutral due to
imcomplete history, response from a list of her creditors was
excellent. (Attached Exhibit A)
Picea, Incorporated has successfully maintained and operated the
two shops in the 2400 and 2600 blocks of the Promenade for approximately

two years. Mr, and Mrs. Chacker formerly owned and operated two
refinishing businesses and one antique store. Hy Fleming has
worked as consultant in the area of restaurant and food manage-
ment and operations, and is the sole owner and operator of Hy
Fleming Sales Company. Credit was checked on the members of Picea
Corporation, and was confirmed as excellent. (Attached Exhibit B)
Lease Terms
The subject concessions are covered in Concession Agreement #2166
(CCS) between the City of Santa Monica and John Altamura and Harold
Frank. The agreement, commencing April 1, 1975, and ending
December 21, 1981, allows for the sale of food products from the
four concession stands, with an original monthly payment of $1,700
for each stand payable in advance on the first day of each of the
months of May, June, July, August and September of each year. A
Consumer Price Index adjustment is made yearly. The current adjusted
rate is $2,074.40, paid on the first of each of the months of May,
June, July, August and September, for a total annual payment of
$10,372 per stand.
The concessionaire furnishes equipment and pays all utilities. The
quality of foodstuffs is regulated by the City, and the sale of
intoxicating liquors is prohibited.

Concessionaire shall not assign or transfer this Concession
Agreement or any interest therein by operation of law or otherwise,
without first obtaining the written consent of the City to one
such assignment, transfer, by the City. The City shall not authorize
such auction by Concessionaire, his successors or assigns in the
future. It is understood, however, that the City will not withhold
its consent to any assignment, transfer by Concessionaire without
reasonable cause thereof.
Alternatives
The following alternatives may be considered by Council:
1. To deny the request for sublease and maintain current
lessees only.
2. To approve the attached sublease arrangements.
Recommendation
It is recommended that the City Council approve Alternative No. 2,
to approve a sublease (Attached Exhibit C) of the four city -owned
beach concessions currently being leased to John Altamura and
Harold Frank, dba: Zeppy's Pizza as follows: two shops located in
the 1100 and 1200 blocks of Pacific Coast Highway to be sublet to
Nancy Lindsey of 1444 15th Street, Santa Monica, California, and
two shops located in the 2400 and 2600 blocks of the Promenade, to
Picea, Incorporated, a corporation formed of Melody Chacker, Richard

PERSONAL BACKGROUND,- Born August 8, 1947 in Glens Falls,
New York. Resided in Lake George, New York (a summer resort
town) until graduation from high school in 1965. After
attending college, I migrated to California to work and
continue my education.
EDUCATIONAL BACKGROUNDi In 1965, I attended Green Mountain
College in Vermont with acheivements as counselor of incoming
students and vice- president of the student body. I graduated
with an A.A. Degree in Liberal Arts and transferred to St.
Lawrence University to acheive a B.A. degree in Sociology in
1969. After moving to California in 1969, I matriculated at
Cal -State Long Beach with a standard teaching credential in
Elementary Education. I continued my studies at El Camino
College and Cal -State Dominguez Hills with courses in account-
ing and real estate while obtaining a salesperson's license
in real estate and working on a broker's license.
WORK EXPERIENCE: Being a resident of a resort town allowed
me opportunitites to work in the restaurant business. I
worked two summers in a coffee shop and four summers in an
exclusive German restaurant as a waitress. After moving to
California, I obtained a job in my field of study for the
Department of Public Social Services from September 1970 to
June 1973 as an eligibility and food stamps worker. My
duties consisted of taking applications, interviewing, de-
termining eligibility, filing, record keeping, and trouble
shooting problem cases. After obtaining a teaching creden-
tial:in 1973, my efforts went into substitute teaching for
Redondo Beach City Schools for four years dealing with children
from kindergarden through eighth grade. Simultaneously, I
managed Zippy's Pizza (a fast food establishment in Manhattan
Beach) starting in 1974 for three years. My duties consisted
of completely running the operation from hiring and firing
employees, doing payroll, ordering, maintaning inventory,
preparing food, controlling the quality of the product and
the efficiency of the operation. In the beginning of 1977,
I started working with my husband for Zeppy's Pizza in Santa
Monica as an operating manager with the same duties as my
previous experience. At this time, we became partners in
this operation which has since become incorporated as Picea,
Inc. and operates under the name of Hy's Perry's Pizza.

GENERAL BACKGROUND: Born February 9, 1946 in Buffalo,
New York. Age 32.
EDUCATION: .Graduated from Lancaster High School in 1964.
In 1965 I attended University of Buffalo at New York where
I majored in Physical Education. After a two year military
break, I attended °Miami Dade Junior College with the same
major. In 1968 I attended Cal -State Lon,- Beach and UCLA
for one year. At this time I changed my major to Psychology.
I continued for another year at UCLA. In 1971 -1972 I started
at El Camino College where I stayed for two years obtaining
an A.A. degree in Psychology. My varied college experience
totals five years.
MILITARY: In 1965 through 1967 I was in the U.S. Army. In
the service I. received my technique training in Cryptography
with a top secret clearance.. In 1966 I was sent overseas to
Vietnam for thirteen months. Upon my return and completion
of two years service I was given an honorable discharge.
EMPLOYMENT: My work history covers many odd jobs through
high school. In 1964 -1965 I worked for Lancaster Boys Club
for one and one -half years in a .counselling capacity. In
1968 I started with California Casulity Insurance Co. Here
I specilaized in taking care of teacher and policy group
coverage and public relations. After approximately one year
I took my leave to continue my education. In late 1969, to
to correlate with my educational endeavors I took a job with
Manhattan Beach Recreation Department for two and one -half
years. My main responsibility was setting up programs for
children of all age groups.
SELF - EMPLOYMENT: In 1972 I started South Bay Furniture
Stripping and Refinishing in Palos Verdes, California.
The next year I leased the building next door and started
an adjoining antique store. In 1975 I sold out and started a
new business - All Interior Refinishing, which I have owned
and operated successfully. In 1977 my wife and myself ob-
tained interest in Zeppy's Pizza, which has since evolved into
Hy's Perry's Pizza, which has now become Picea, Inc. In this
period of time vie have substantially improved this operation
from the public point of view and our own.

in considering signing a lease with Richard and Melody
Chacker. They (the Chackers) have asked me for a letter
of recommendation to the city of their behalf.
First a little background about myself. I have, over the
past ten years trained over 25 different owners as f4st
food operators® Many of these owners have gone on tbogpen
multiple businesses and become very successful in the fast -
food pizza business. As the chief advisor to the ,Santa
Monica beach shops for the past three years, I am in a
position to evaluate the progression of the business ex-
pertise and operation of these particular shops.
Richard and Melody Chacker have unquestionably performed as
the best manager these shops have ever seen. The Chackers
are very adament about a high standard of quality on all of
the products that they serve. They also show a keen sense of
customer awareness.in` that they have constantly altered their,
shops to serve more people during the peak hours., For instance,
they have at times set up 3 cash register lines at each shop
with complete backup and system flow of products to enable
them to handle up to 500 customers per hour. This was a
better serving rate than any other shop has done in the 10
years history of Perry's Pizza.
The fact that the Chacker's have done an extremely good job
at the Santa Monica Beach shops can be easily seen by the
gigantic increase in business shown over the last two years.
After all, business growth is the true measurement of custo-
mer satisfaction, and the true measurement of managerial
capability in any business.

I would like to introduce to you through a personal recom-
mendation Richard and Melody Chacker, who have been completely
operating the two concession stands located at 2410 & 2610
Promenade, Santa Monica-. They have proven to me that they
are highly capable of running a restaurant and making it more
and more successful, since they have worked closely with me for
five years. In the two years they have been operating the Santa
Monica stores,.many positive changes have been made by them to
enhance the business. Even though this is a business which is
continguent on the weather, certain changes such as physical ar-
rangement of equipment and product, organization of employee op-
eration, high standards of quality control and efficient methods
of.serving the customer have increased business tremendously.
Their expedient methods have definitely facilitated serving the
public.:- Their varied backgrounds and experiences at Zeppy's
Pizza in Manhattan Beach have enabled them to supervise large
numbers of employees and to successfully operate a most difficult
and irratic, business. They care about their product, their em-
ployees, and their customers.
Richard and Melody Chacker have assumed all the operating
duties of managing including the paperwork that accompanies the
operation. Theypay all the bills on time, order the product,
take inventory, hire and fire and train employees, handle the
cash and make the deposits, and control the quality of the pro-
duct. Since they have been operating the stores, they serve
quarter pound hamburgers, and all beef hot dogs, all of which is
prepared fresh daily and in accord with the original lease terms.
Also, they have upgraded and maintained the physical structure of
the shops as well as sustained very high standards of cleanliness.
I am especially pleased with the Chacker's skills as suc-
cessful and growing restaurant entrepenuers and endorse them as
competent operators.
