SUBJECT: Recommendation To Waive Further Formal Bidding and To
Authorize Direct Negotiation for Purchase Gas Chromato-
graph.
Introduction
This report concerns purchase of one (1) gas chromatograph breath
alcohol analyzer. Funds, in the amount of $3,900.00, are budgeted
in account number 01- 300 - 301 - 000 -950, Police Department Capital
Outlay.
Background
Requests for proposals for this breath alcohol analyzer were mailed
to eight (8) scientific apparatus companies and notices were ad-
vertised in accordance with city charter and municipal code pro-
visions. No bids were received by the scheduled bid opening date,
October 20, 1977.
The City has its alternatives:
(1) To issue a call for new bids. This will entail
additional expense and delay and will not assure
that additional suppliers will respond.
(2) To waive further formal bidding and authorize the
City Manager to negotiate directly for purchase
of the chromatograph. This will expedite acquistion

A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF
SANTA MONICA WAIVING FURTHER CALL FOR FORMAL BIDS
AND AUTHORIZING DIRECT NEGOTION FOR PURCHASE OF
A GAS CHROMATOGRAPH
WHEREAS, the Santa Monica Police Department has need of a
gas chromatograph breath alcohol analyzer; and
WHEREAS, the City has issued a formal call. for bids to supply
this equipment and has received no response; and
WHEREAS, to further advertise for bids would be to no avail
and would cause unnecessary delay and expense.
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council finds that the requirement
exists for this gas chromatograph for Police Department and that to
further advertise formally for bids would be to no avail and would cause
unnecessary expense and delay. s,
SECTION 2. That the City Manager is authorized to negotiate
directly for purchase of this equipment on the open market without
calling for additional formal. bids.
SECTION 3. The City Clerk shall certify to the adoption of
this resolution and thenceforth and thereafter the same shall be in full
force and effect.
