SR-10-14-1977-6CSanta Monica, Califor -', October 14, 1977' ( C TO: 'Mayor and City Council FROM: City Staff SUBJECT: Renewal of Theta Cable Television Franchise, Introduction This report transmits information on the Theta Cable Television of California franchise in Santa Monica and recommends its franchise with the City be renewed. Background Theta Cable of California was granted a franchise to operate a cable television system in the City of Santa Monica by Ordinance No. 756 (CCS) on October Z4, 1967. This franchise will expire on November Z3, 1977. All major cable TV companies in the Los Angeles area were contacted by telephone and letter with regard to applying for the franchise in Santa ,Monica. They are: American TV and Communications, Calabasas Communications Co., Century . Cable of Southern California, Falcon Communications, Inc., King Videocable Co. , Kinneloa TV Systems, Lake Hughes CATV Service, Listronics, Sammons Commu- nications, Inc., Storer Cable TV, Inc., Telesystems Co., Warner Cable Corp., W. G. N. Electronic Systems, and Palos Verdes Peninsula Cable. 9 None of these systems provide more than 'sixteen channels to their subscribers (two o provide sixteen; most provide twelve channels). Of the nine largest companies (American TV and Communications, Century Cable, Falcon Communications,. King Videocable, Palos Verdes Peninsula Communications, Sammons Communications, Mayor and Council -L- ctober 14, 1977 j Storer Cable TV, Warner Cable, and W. G. N. Electronic Systems) in the Los Angeles area'(excluding Theta), one has the capability to provide thirty channels to subscribers, one could provide twenty channels, and one presently can provide thirteen channels. The remaining six can provide twelve channels to their. sub- scribers. When an individual wishes to subscribe to cable television, the company must con- nect the person's TV to their system, This is called an original installation and there is a basic charge involved. The original installation charge, for the nine largest companies ranges from $12. 50 to $25. 00. The average installation charge for these companies is $18. 00 All cable TV companies bill subscribers on a monthly basis for services. Basic monthly charges range from $5. 00 to $9. 00. The average monthly charge for ser- vices (without a movie channel) is $6. 79 for the nine largest companies in the Los Angeles area, Cable Television, companies usually pay a percentage of their gross annual revenues to the Gity(ies) in which they operate. This figure is usually two or three percent. The maximum amount allowed (by FCC regulations, Volume 37, No. 30, February 9 12, 1972, page 3277 - -Title 47, Chapter 1, paragraph 186) is three percent which Theta pays, Of the nine largest companies, five pay the City(ies) in which they operate . two percent of their gross annual revenues; two pay three percent; and one pays five percent according to FCC regulations. (Two percent of that is put towards local origination broadcasting and three percent is given to the City). Mayor and Council 6 -4- Ott ber 14, 1977 Overall, Theta (wholely owned by Hughes Aircraft Company of Culver City, Cali- fornia) provides cable TV to 80, 917 subscribers in the Los Angeles area, malting it the second largest cable TV in the country. 1 Of these subscribers, 7, 062 are in Santa Monica. Theta employs 275 people in its Santa Monica office (thirty -five of whom are Santa Monica residents) and has connected and provided service with- out cost to City schools and other facilities upon request. Theta's basic original installation charge is $15. 00; and its montlil.y charge (without the movie channel) is $7. 50. By the terms of the franchise agreement, the City waived its right to a business license fee in lieu of Theta paying three percent.of its gross annual revenues to the City (in 1916 Theta, paid $36, M. 41 to the City as noted above). Since the franchise ZI began in 1967, Theta has paid $101, 717. 83 in franchise and other fees to Santa Monica. FCC Standards The Federal Communications Commission has outlined certain guidelines and standards that cable TV companies of Theta's size must follow (part 76 of Chapter I of Title 47 of the code of federal regulations). By June 21, 1986, a cable TV company with Theta's number of subscribers must have a twenty channel capacity. Theta has complied with this regulation as it now has a thirty channel capacity. 9 In order to operate legally, a cable TV system must obtain a Certificate of Com- pliance from the FCC. The FCC's Certificate of Compliance Division has advised City staff that Theta met all FCC requirements in being granted its Certificate of Compliance. /M`Yor and Council f -5- O'jh 14,.1977 Franchise Agreement Among the 7riore important items required of Theta by the City are the construction of a system with a twelve channel capacity and solid state components; and a con- struction of a city -wide facility. Technical advances made it possible for Theta to provide twenty -eight channels to its subscribers and a city -wide facility has been built. Theta's system is now of a more advanced design and construction than would have been possible if the Santa Monica system were not part of Theta's larger over- all system in the Los Angeles area. The franchise requires that any change in rates be approved by the City Council. Adjustments in subscriber rates were made last in 1976 and were approved as re- quired by City Council. Technical Standards .Pursuant to conversations with various cable television consultants, staff found that Theta's technical specifications and equipment are of the highest quality. Its anten- nae, headend (control center of the cable TV system), electronics, distribution system cable and conduit, distribution system electronics, and distribution to subscribers' TV are all termed "excellent' by such consultants as James DeFriend, the chief engineer of Coachella Valley Cable ITV and Martin Malarkey, the senior partner of Malarkey, Taylor and Associates, Cable TV Consulting.F irm in Washington, D.-C. According to these consultants, when a cable TV company strives for high system. ,quality, it should attempt to: 1) possess outstanding gain control (the loss of power as the signal travels through the cable should be offset by the use of amplifiers); and 2) compensate for temperature changes (shifts in temperature may affeci the system's cables). Transfer of Franchise Of the fourteen cable TV companies contacted by staff, none expressed intere$t in applying for the Santa Monica franchise., because of the large costs involved 4eX. securing and operating a cable television franchise. .Theta originally invested approximately $4. 3 million in their Santa Monica operation. Due to inflation, con- sultants agreed that an expenditure of approximately $12 million would be nec� -ssarY to purchase Theta system at "fair market value ". None are willing and /or al%le to make this investment. System Plans During the present year, Theta's plans provided for system iiiaprovements st has the installation of transient voltage suppressor units (to decrease damage to iC,00tronic units), the capability of simultaneous systems sweep (this allows Theta to in,;4re the- best possible signal transmission), and an improved triple shielded drop cabI4 to connect its system to subscribers' sets. Theta's long range plans include th� im- plementation of its two -way cable communication system.
