Peter, Director of Human Resources Subject: Resolution Approving a Side Letter of Agreement between the City of Santa Monica (CSM) and the Santa Monica Municipal Employees Association (MEA) pertaining to Shift Differential payment for permanent Library employees. Recommended Action Staff recommends that the City Council adopt the attached Resolution approving a Side Letter of Agreement between the City and the Santa Monica Municipal Employees Association (MEA) regarding the clarification of an existing shift differential benefit for permanent Library employees covered by the MEA Memorandum of Understanding (MOU). Executive Summary Approval of the Side Letter of Agreement clarifies an existing type of compensation paid to certain Library employees as a shift differential for working on Sundays. This clarification is made consistent with regulations for reporting compensation to the California Public Employees Retirement Systems (CaIPERS). There is no additional cost to the City associated with this approval. Discussion The current memorandum of understanding (MOU) between the City and MEA provides additional compensation to Library employees as an incentive to work Sundays as part of their regular work schedule. The City has been paying this compensation to employees for many years and has been reporting it to CalPERS as a shift differential. However, the language in the MOU includes this compensation in Section 2.03 Overtime. In order to clarify the intent of this form of compensation and to reflect the method and manner of how this compensation is provided, a Side Letter of Agreement 1 amending the existing MOU was negotiated between the City and MEA. CalPERS has requested that this amendment to the MOU be approved by the City Council. Resolution 2 Forwarded to Council: Rod Gould City Manager SIDE LETTER OF AGREEMENT THE CITY OF SANTA MONICA AND SANTA MONICA MUNICIPAL EMPLOYEES ASSOCIATION The City of Santa Monica (City) and the Santa Monica Municipal Employees Association (SMMEA) hereby agree that for employees covered herein who hold permanent positions at the Library, a 50 % shift differential shall be paid for all hours worked on a Sunday assignment. It is the Intent of the City to assign Sunday work on a volunteer basis. However, in the event there are not enough volunteers to staff the Sunday work at the Library, the work will be assigned on an equitable basis among employees. Furthermore, the following language will be removed from Section 2,03 Overtime of the SMMEA Memorandum of Understanding; "For employees covered herein who hold permanent positions at the Library, the full time work week shall be defined as forty (40) hours, Monday through Saturday, as scheduled be the City Librarian or his /her designated representative. Overtime shall be paid for hours worked on Sunday, it is the intent of the City to assign Sunday work on a volunteer basis. However, In the event there are not enough volunteers to staff the Sunday work at the Library, the work will be assigned on an equitable basis among employees. Peter, Director of Human Resources City Council Meeting: July 08, 2014 Santa Monica, California RESOLUTION NO. 10820 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA APPROVING A SIDE LETTER OF AGREEMENT BETWEEN THE CITY OF SANTA MONICA AND THE SANTA MONICA MUNICIPAL EMPLOYEES ASSOCIATION WHEREAS, the City administration and representatives of the Santa Monica Municipal Employees Association have met and conferred under the terms of Ordinance No. 801 (CCS) and have reached agreement on wages, hours and other terms and conditions of employment; and WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) of the City of Santa Monica requires preparation of a written agreement between the administration and employees if an agreement can be reached; and WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) further provides that any such agreement shall not be binding unless and until presented to the governing body for determination; and WHEREAS, the purpose of the agreement is to promote and provide harmonious relations, cooperation, and understanding between the City and the Santa Monica Municipal Employees Association; and 1 Adopted and approved this 8th day of July, 2014.
