Subject: Establishment of Speed Limits
Recommended Action
Staff recommends that the City Council introduce for first reading an ordinance of the
City Council of the City of Santa Monica establishing speed limits for certain City streets
pursuant to the California Vehicle Code and amending Santa Monica Municipal Code
( "SMMC") section 3.12.490.
Executive Summary
By adopting this ordinance, the City Council will be acting under the authority granted to
the City by California Vehicle Code section 22358, which authorizes local authorities to
decrease local speed limits and California Vehicle Code section 22358.4, which
authorizes local authorities to decrease local speed limits near schools, based upon the
results of an engineering and traffic survey.
If adopted, this ordinance would set speed limits for 103 street segments within the City,
based upon an engineering and traffic survey ( "Survey ") conducted for the City by
Kimley -Horn and Associates, Inc. The Survey was conducted from November 2013
through December 2013. If this ordinance is adopted, SMMC section 3.12.490 would be
modified to change existing local speed limits for the survey locations included in the
Survey.
This proposed ordinance strengthens SMMC section 3.12.490 by: a) providing a
reduction of the speed limit along six street segments, b) authorizing the posting of
speed limits on street segments without existing posted speed limits, c) authorizing
speed reductions on additional street segments where the City has not previously
surveyed and d) authorizing speed reductions along 18 street segments adjacent to
schools.
Background
California Vehicle Code section 22357 provides that whenever a local authority
determines on the basis of an engineering and traffic survey that a speed greater than

25 miles per hour would facilitate the orderly movement of vehicular traffic and would be
reasonable and safe upon any street other than a state highway otherwise subject to a
prima facie limit of 25 miles per hour, the local authority may by ordinance determine
and declare a prima facie speed limit of 30, 35, 40, 45, 50, 55, of 60 miles per hour or a
maximum speed limit of 65 miles per hour, whichever is found most appropriate to
facilitate the orderly movement of traffic and is reasonable and safe.
California Vehicle Code section 22358 provides that whenever a local authority
determines on the basis of an engineering and traffic survey that the limit of 65 miles
per hour is more than is reasonable or safe upon any portion of any street other than a
state highway where the limit of 65 miles per hour is applicable, the local authority may
by ordinance determine and declare a prima facie speed limit of 60,55, 50, 45, 40, 35,
30, or 25 miles per hour, whichever is found most appropriate to facilitate the orderly
movement of traffic and is reasonable and safe.
California Vehicle Code section 222358.4(b)(1) provides that a local authority may, by
ordinance or resolution, determine and declare prima facie speed limits as follows:
(A) A 15 miles per hour prima facie limit in a residence district, on a highway with a
posted speed limit of 30 miles per hour or slower, when approaching, at a distance of
less than 500 feet from, or passing, a school building or the grounds of a school
building, contiguous to a highway and posted with a school warning sign that indicates a
speed limit of 15 miles per hour, while children are going to or leaving the school, either
during school hours or during the noon recess period. The prima facie limit shall also
apply when approaching, at a distance of less than 500 feet from, or passing, school
grounds that are not separated from the highway by a fence, gate, or other physical
barrier while the grounds are in use by children and the highway is posted with a school
warning sign that indicates a speed limit of 15 miles per hour.

(B) A 25 miles per hour prima facie limit in a residence district, on a highway with a
posted speed limit of 30 miles per hour or slower, when approaching, at a distance of
500 to 1,000 feet from, a school building or the grounds thereof, contiguous to a
highway and posted with a school warning sign that indicates a speed limit of 25 miles
per hour, while children are going to or leaving the school, either during school hours or
during the noon recess period. The prima facie limit shall also apply when approaching,
at a distance of 500 to 1,000 feet from, school grounds that are not separated from the
highway by a fence, gate, or other physical barrier while the grounds are in use by
children and the highway is posted with a school warning sign that indicates a speed
limit of 25 miles per hour.
The declared prima facie speed limits shall only be effective when appropriate signs
giving notice thereof are erected upon the street and the limits shall not be revised
except upon the basis of an engineering and traffic study.
SMMC section 3.12.490 currently sets speed limits for certain City streets based upon
an engineering and traffic survey completed in 2006. Section 28.13 of the California
Manual on Uniform Traffic Control Devices requires that a new engineering and traffic
survey be conducted every five to ten years; as such, the Survey was completed by a
registered engineer from Kimley -Horn and Associates, Inc. (KHA) in 2013 and certified
by KHA in May 2014. The Survey provides justification for Council to set reasonable
and safe limits to facilitate the orderly movement of traffic.
The proposed revisions to SMMC section 3.12.490, which are set forth in Attachment A,
adopt speed limit recommendations included in the Survey. The proposed revisions: a)
reduce existing limits on some street segments, b) set new speed limits on other street
segments without existing posted speed limits, c) authorize speed limit reductions on
additional street segments where the City has not previously reduced speed limits, d)
increase speed limits where justified, and e) reduce speed limits near schools.

Discussion
This proposed ordinance modifies SMMC 3.12.490 to incorporate the recommended
speed limits in the Survey which includes a reduction of the speed limit along six of the
surveyed segments. The Police Department and the Transportation Engineering and
Management Division support establishing and posting notice of these limits in order to
facilitate the orderly movement of traffic. This proposed ordinance strengthens SMMC
section 3.12.490 by: a) providing a reduction of the speed limit on some street
segments, b) authorizing the posting of speed limits on street segments without existing
posted speed limits, c) authorizing speed reductions on additional street segments
where the City has not previously surveyed and d) authorizing speed reductions
adjacent to schools.
On Olympic Boulevard between 20th Street and eastern City limit, the speed limit
currently established in SMMC 3.12.490 is 45 miles per hour. The speed limit that is
supported by the Survey and would be established by this ordinance is 40 miles per
hour, consistent with the other street segments along Olympic Boulevard.
On Ocean Park Boulevard between 14th Street and 23`d Street, the speed limit currently
established in SMMC 3.12.490 is 35 miles per hour. The speed limit that is supported by
the Survey and would be established by this ordinance is 30 miles per hour, due to the
proximity of several elementary schools and Fairview library.
On 4th Street and 5th Street between Wilshire Boulevard and Pico Boulevard, and on
Santa Monica Boulevard between Ocean Avenue and Lincoln Boulevard, the speed
limit currently established in SMMC 3.12.490 is 30 miles per hour. The speed limit that
is supported by the Survey and would be established by this ordinance is 25 miles per
hour along these segments, consistent with the other street segments in the downtown
area.
On Montana Avenue between 7th Street and 14th Street, the speed limit currently
established in SMMC 3.12.490 is 30 miles per hour. The speed limit that is supported by
the Survey and would be established by this ordinance is 25 miles per hour, and is
consistent with the other commercial areas within the City.
The following speed limit reductions are supported by the Survey and would be
established by this ordinance:
1. Olympic Boulevard between 20th Street and east City Limit — from 45 MPH to
40 MPH
2. Ocean Park Boulevard between 14th Street and 23rd Street — from 35 MPH to
30 MPH
3. 4th Street between Wilshire Boulevard and Pico Boulevard — from 30 MPH to 25
MPH
4. 5th Street between Wilshire Boulevard and Olympic Boulevard — from 30 MPH
to 25 MPH
5. Montana Avenue between 7th Street and 14th Street — from 30 MPH to 25 MPH
6. Santa Monica Boulevard between Ocean Avenue and Lincoln Boulevard — from
30 MPH to 25 MPH
Pursuant to the State of California Vehicle Code Section 22358.4(b)(1), the Survey
supports a 15 miles per hour prima facie speed limit in areas less than 500 feet from or
passing a school building or grounds, effective during school days only, and extending
the 25 miles per hour prima facie school zone limits up to 1000 feet from school
property.
The following 15 MPH prima facie speed limit and 25 MPH prima facie limits near
school property are supported by the Survey and would be established by this
ordinance:
1. 6th Street from Pico Boulevard to Bay Street (Santa Monica High School)
2. 14th Street from Idaho Avenue to Wilshire Boulevard (Lincoln Middle School)

WHEREAS, an engineering and traffic survey ( "Survey ") was conducted for the
City by Kimley -Horn and Associates, Inc. in 2013; and
WHEREAS, the Survey recommended certain changes to or new speed limits for
certain City streets, as set forth in Exhibit A; and
WHEREAS, the City Council has determined that the speed limits set forth in the
Survey are most appropriate to facilitate the orderly movement of traffic within the City
and are reasonable and safe; and
WHEREAS, this ordinance would modify Santa Monica Municipal Code section
3.12.490 by setting new or revised speed limits for certain City streets, based upon the
results of the Survey.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council hereby determines the speed limits set forth in the
Survey (attached hereto as Exhibit "A ") are most appropriate to facilitate the orderly
movement of traffic within the City and are reasonable and safe; and
SECTION 2. Santa Monica Municipal Code Section 3.12.490 is hereby amended
by deleting its text in its entirety and replacing the deleted text with the following:

The following speed limits are established pursuant to California Vehicle Code

SECTION 3. Any provision of the Santa Monica Municipal Code or appendices
thereto inconsistent with the provisions of this Ordinance, to the extent of such

inconsistencies and no further, is hereby repealed or modified to that extent necessary
to effect the provisions of this Ordinance.
SECTION 4. If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional by a decision of any
court of competent jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council hereby declares that it would
have passed this Ordinance and each and every section, subsection, sentence, clause,
or phrase not declared invalid or unconstitutional without regard to whether any portion
of the ordinance would be subsequently declared invalid or unconstitutional.
SECTION 5. The Mayor shall sign and the City Clerk shall attest to the passage
of this Ordinance. The City Clerk shall cause the same to be published once in the
official newspaper within 15 days after its adoption. This Ordinance shall become
effective 30 days from its adoption.
