SUBJECT: Ferry Service -- CalTrans Agreement
Introduction
This report conveys the terms and conditions of the proposed agreement between
the City of Santa Monica and CalTrans to dock a passenger ferry boat at the
Santa Monica Pier and recommends approval of the attached resolution authorizing
said agreement.
Background
At the May 15, 1979 Council meeting, Council authorized the staff to negotiate
a new agreement with CalTrans for docking the ferry boat from Malibu at the
Santa Monica Pier.
Subsequent to that time CalTrans has discontinued that service, but staff and
CalTrans feel it proper to enter into an agreement to allow for any future
need for this service due to the closure of the Pacific Coast Highway in the
Malibu area.
Terms of the Agreement
Duration: Commencing at 12:00 a.m., July 1, 1979, and terminating
at 12:00 p.m. on December 31, 1979, or upon notice of
termination given by either the City or the State.
Fee: $20 per docking, maximum 5 per day.
Hold
Harmless: CalTrans holds Santa Monica harmless.
Damage to
Pier: CalTrans is responsible for repair in case of damage.

Permitted
Use: Only passenger ferry service in a water taxi - -no excursions.
Alternatives
1. Council may approve the contract on terms presented in the document and
approve the resolution.
2. Council may madify terms of the contract and approve the resolution.
3. Council may disapprove the contract.
Recommendation
Staff recommends alternative no. 1, that Council approve the contract on
terms presented in the document and approve the attached resolution.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
GRANTING A LICENSE TO THE STATE
OF CALIFORNIA TO OPERATE A
WATER TAXI SERVICE DOCKING AT
THE SANTA MONICA PIER IN THE EVENT
OF A DECLARED EMERGENCY.
WHEREAS, State Route 1 in the Malibu area of the
County of Los Angeles, was closed to thru traffic on
April 19, 1979, due to severe land slides and other hazards
to the public; and
WHEREAS, the State of California contracted with
the City of Santa Monica for the implementation of a water
taxi service between Malibu and the City of Santa Monica,
docking at the Santa Monica pier; and
WHEREAS, such service ended on June 8, 1979; andri
WHEREAS, it is desirable to provide for the implementation
of such water taxi service in the event that State Route
1 is again closed to traffic as a result of a declared
emergency; and
WHEREAS,.it is the intent of the City Council to
grant a license to the State that specifies the amount
of compensation, indemnification, and methods of operation
arising from the implementation of the said water taxi
service;
THE CITY COUNCIL OF THE CITY OF SANTA MONICA RESOLVES
AS FOLLOWS:

SECTION 1
The City Manager is authorized to execute, on
behalf of the City, a certain license for the use of property,
attached to this Resolution as Exhibit "A ", by which the
City of Santa Monica, in consideration of the stated mutual
covenants, licenses the State toy operate a water taxi
service docking at the Santa Monica pier.
SECTION 2, The City Clerk shall certify to the
adoption of this resolution, and thenceforth and thereafter
the same shall be in full force and effect.
ADOPTED AND APPROVED this 26th day of June , 1979.
