SR-11-26-2013-3HCity Council Meeting: November 26, 2013 Agenda Item: To: Mayor and City Council From: David Martin, Director of Planning and Community Development Subject: Reject Bids for the Real -Time Beach Parking Project Recommended Action Staff recommends that the City Council: 1. Reject all bids received on October 30, 2013 for the Real -Time Beach Parking Project. 2. Direct staff to reissue a bid in order to obtain the best bidder for the Real -Time Beach Parking Project. Executive Summary On October 30, 2013, one bid was received for the construction of the Real -Time Beach Parking Project. However, the bid did not meet the minimum 12.5% Disadvantaged Business Enterprise (DBE) federal requirement, as outlined in the bidding documents. Staff recommends rejecting all bids and reissuing the request for bids in order to obtain the best bidder for this project. Discussion The Real -Time Beach Parking Project would construct real time parking and travel information signs for motorists traveling to Santa Monica beach parking lots adjacent to the Pier, on Ocean Avenue and Palisades Beach Road. Signs placed near the Santa Monica Freeway off -ramps would also display parking information for garages in the Downtown area. All signs would display clear and concise parking information at the entrance to each parking lot and at key gateways to the City. When central parking lots fill up, the signs would help to distribute traffic, increase the efficiency of existing parking resources, and reduce traffic congestion. On October 10 and 12, 2013, the City published a Notice Inviting Bids in the Santa 1 Monica Daily Press. The bid documents were posted on the City's online bidding system. More than 30 contractors requested the bid documents. The City Clerk's Office received one formal bid that was publicly opened by the Deputy City Clerk on October 30; 2013. The Real Time Beach Signs Project is federally funded which requires a minimum of 12.5% DBE participation in the project. Staff's review of the bid documents showed only a 5.76% DBE participation. If the bidder does not meet or exceed the 12.5% DBE goal, "Good Faith Effort" documentation must be submitted. According to federal regulations, the bidder has four additional business days to resubmit their "Good Faith Effort" documentation. The bidder did not submit the "Good Faith Effort" documentation before November 5, 2013. Since the bidder did not meet the federal DBE goal and did not provide their Good Faith Effort documentation, the bid is considered nonresponsive. Staff recommends rejecting the bid and immediately reissuing the request for bids in order to obtain the best bidder for this project. The rejection of bids incurs a 3 month project delay. Project completion is now anticipated in June 2014. Financial Impacts & Budget Actions There is no immediate financial impact or budget action necessary as a result of the recommended action.
