R10792City Council Meeting December 17, 2013 Santa Monica, California RESOLUTION NUMBER 10792 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING INTERIM RENTAL FEES TO BE CHARGED FOR INTERIM USE OF THE SANTA MONICA CIVIC AUDITORIUM WHEREAS, on February 28, 1967, the City Council of the City of Santa Monica (the "City Council') adopted Resolution No. 3579 (CCS) ( "Resolution 3579 ") setting forth the regulations for the administration of the Santa Monica Civic Auditorium (the "Civic ") and the rentals to be charged for the use of the Civic; and WHEREAS, on August 14, 2012, due to the loss of redevelopment funds, the City Council authorized the suspension of a previously- approved renovation and seismic retrograde project for the Civic and further authorized the closure of regular Civic operations; and WHEREAS, on October 23, 2012, the City Council affirmed its intent to suspend the renovation project and close regular operations; and WHEREAS, on June 11, 2013, the City Council reviewed and commented on an interim plan for use of the Civic after the closure of regular Civic operations; and WHEREAS, the Civic ceased regular operations on June 30, 2013; and WHEREAS, to serve community and government purposes, Council desires to operate the facility in an interim mode until such time as the renovation and seismic retrograde project may be undertaken (the "Interim Use Period "); and WHEREAS, pursuant to Section 2.72.010 of the Santa Monica Municipal Code, the City has the authority to establish and set the amount of fees or charges for the private commercial use of public property; and WHEREAS, the City has the authority to charge market rates for private use of public resources, including the Civic; and WHEREAS, the City desires to establish interim rental fees for use of the Civic during the Interim Use Period. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. Except as may be otherwise provided for herein, the following fees shall be the interim Base Rental Fees charged for use of the Civic during the Interim Use Period. A. East Wing Meeting Room (includes use of East Patio) Half day (four hours or less): $800 Full day (five to eight hours): $1,600 B. Main Hall, Stage and Lobby Photography: 2 Large Crew and Cast (over 25): $5,000 per day. Small Crew and Cast (under 25): $2,500 per day. All other permitted uses: $10,000 per 12 -14 hour day. $5,000 per 6 hour day. C. Other Exterior Event Spaces — Canopy, Front Lawn, East and West Patios, East Lawn (available in conjunction with the rental of the East Wing Meeting Room or the Main Hall only and not including Civic Center Surface Parking Lot): Canopy (non - public assembly only) rates are full canopy at $800 per day and half canopy at $400 per day. Front Lawn at $1,200 per day. East and West Patios at $500 each patio per day. East Lawn at $400 per day. Exterior Roaming in conjunction with parking lot rental for filming and photo shoots at $1,500 per day. D. Civic Center Surface Parking Lot (available in conjunction with the rental of the East Wing Meeting Room or the Main Hall only): 69,500 square feet - $5,600 per day = 282 spaces @ $19.50 per space reserved. 51,680 square feet - $4,200 per day = 212 spaces @ $19.80 per space reserved. 34,240 square feet - $2,800 per day = 140 spaces @ $20.00 per space reserved. Cleaning Deposit: $1,500 per event 3 SECTION 2. The Acting Manager may reduce the Base Rental Fees for use of the Civic during the Interim Use Period, not including the adjacent Civic Center Surface Parking Lot as follows: A. Nonprofit Rental Fees. Only non - profit organizations with documented tax - exempt status shall be eligible for nonprofit rental fees. Nonprofit rental fees shall be offered for no more than two (2) events per month. 1. When Admission is Charged. Base Rental Fees may be reduced by 20% when admission is charged, collection or pledges taken, space or merchandise sold, or revenue derived directly or indirectly. 2. When Admission is Not Charged. Base Rental Fees may be reduced by 40% when no admission is charged, no collection of pledges taken, no space or merchandise sold, and no revenue of any character is derived, either directly or indirectly. Failure to qualify under this section by charging admission or taking of collections or pledges, whether within or away from the Civic premises, shall result in the charge of the full established Base Rental Fees, which shall be due and payable as provided herein. B. Santa Monica - Malibu Unified School District. Base Rental Fees may be reduced by 40% for the Santa Monica - Malibu Unified School District ( "SMMUSD "). C. Preference for the use of the Civic shall be given to the applicants who apply for use of the Civic at Base Rental Fees rather than in favor of an applicant who applies for the use thereof at any lesser rate. Uses based on Special Base Rental Fees will be confirmed no earlier than 45 days prior to the event. Iv SECTION 3. Additional fees may be charged for services, supplies or equipment required for an event. Any such additional fees shall be charged at the City's applicable rates as set by resolution of the City Council. SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. 5 Adopted and approved this 17th day of December, 2013. am O'Connor, Mayor I, Sarah P.
