R10791City Council Meeting December 17, 2013 Santa Monica, California RESOLUTION NUMBER 10791 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING INTERIM USES FOR THE SANTA MONICA CIVIC AUDITORIUM WHEREAS, on February 28, 1967, the City Council of the City of Santa Monica (the "City Council ") adopted Resolution No. 3579 (CCS) ( "Resolution 3579 ") setting forth the regulations for the administration of the Santa Monica Civic Auditorium (the "Civic") and the rentals to be charged for the use of the Civic; and WHEREAS, on August 14, 2012, due to the loss of redevelopment funds, the City Council authorized the suspension of a previously- approved renovation and seismic retrograde project for the Civic and further authorized the closure of regular Civic operations; and WHEREAS, on October 23, 2012, the City Council affirmed its intent to suspend the renovation project and the closure of regular Civic operations; and WHEREAS, on June 11, 2013, the City Council reviewed and commented on an interim plan for use of the Civic after the closure of regular Civic operations; and WHEREAS, regular Civic operations ceased on June 30, 2013; and WHEREAS, to serve community and government purposes, the City now desires to operate the Civic in an interim mode until such time as the renovation and seismic retrograde project may be undertaken (the "Interim Use Period "); and WHEREAS, the City desires to establish interim uses for the Civic during the Interim Use Period. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. During the Interim Use Period, the Civic will operate in a limited capacity as a City rental venue. The Civic may be rented and used for the defined range of activities described in this resolution. SECTION 2. The Community and Cultural Services Department will manage the Civic, and the Manager of the Cultural Affairs Division will serve as the Acting Manager of the Civic during the Interim Use Period. Subject to the supervision and control of the City Manager and the Director of Community and Cultural Services (the "Director "), the Acting Manager is hereby vested with the authority, and it shall be his or her duty, to supervise and manage the Civic, and the City Manager, or his or her designee, shall have the authority to permit for the rental thereof, consistent with the provisions of this resolution. SECTION 3. During the Interim Use Period, the Civic shall be available for the following uses: A. East Wing Meeting Room (includes use of East Patio): City recruitment activities, department meetings and workshops; film and photo shoots; recordings; product displays, launches and unveilings; and public assembly uses that are not otherwise prohibited herein, including, but not limited to, community, school and non- profit events and meetings. 2 B. Main Hall, Stage and Lobby: Any non - public assembly use that is not otherwise prohibited herein, including, but not limited to, entertainment industry uses such as recordings, photography and filming, closed rehearsals, theatrical technical production work; and product displays and demonstrations not open to the general public. The Main Hall may also be used as an ancillary storage or staging facility to support any authorized event in the Main Hall, the East Wing Meeting Room, or the Civic Exterior Spaces as defined in Subsection C, below. The Main Hall may not be used for general public assembly, meetings, exams, or any performance before a general admission or similar audience. C. Exterior Spaces — Canopy, Front Lawn, East and West Patios, East Lawn (excluding the Civic Center Surface Parking Lot): Film shoot basecamps, and other uses in conjunction with and in support of any rental of either the Main Hall or the East Wing Meeting Room. D. Civic Center Surface Parking Lot: The Civic Center Surface Parking Lot may be available in conjunction with a rental of either the East Wing Meeting Room or the Main Hall no more than twelve (12) times per year, including City sponsored and co- sponsored events. Any rental of the Civic Center Surface Parking Lot shall be approved by the Acting Manager as well as City staff managing the City's parking resources. Applications for events that include the Civic Center Surface Parking Lot may be denied if: 1) there is conflict with a pre- existing activity; or 2) if the event will unduly impede, obstruct or interfere with emergency vehicles or other vital governmental functions. SECTION 4. Gambling, casino games, or "casino night" events; private social events, such as personal parties, engagement parties, rehearsal dinners, weddings, 3 religious celebrations, birthday parties, wedding anniversary parties, bar and bat mitzvah celebrations, Quinceaneras, reunions, etc.; or any other uses prohibited by City ordinance, State or Federal law; are prohibited at all times. SECTION 5. During the Interim Use Period, the Civic will operate with minimal staff and resources. The City reserves the right to request alternate dates for an event or deny an application if the City's minimal staff and /or resources will not support the proposed use. SECTION 6. The Director may adopt rules and regulations for use of the Civic consistent with this resolution. SECTION 7. This resolution shall not be construed to authorize activities otherwise prohibited by law. SECTION 8. This resolution shall not be construed to limit the City's ability to use the Civic for its governmental purposes. SECTION 9. Resolution 3579 (CCS) is hereby repealed in its entirety. SECTION 10. If there are any conflicts between the provisions of this resolution and the provisions of any prior resolution governing the use of the Civic, the provisions of this resolution shall control. SECTION 11. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
