m-102613CITY OF SANTA MONICA CITY COUNCIL MINUTES OCTOBER 26, 2013 A special meeting of the Santa Monica City Council was called to order by Mayor O'Connor at 9:37 a.m. a.m., on Saturday, October 26, 2013, at City Council Chambers, 1685 Main Street. Roll Call: Present: Mayor Pam O'Connor Mayor Pro Tern Terry O'Day Councilmember Gleam Davis Councilmember Kevin McKeown Councilmember Tony Vazquez Councilmember Ted Winterer Absent: Councilmember Robert T. Holbrook Also Present: City Manager Rod Gould City Attorney Marsha Jones Moutrie City Clerk Sarah P. Gorman CONVENE/PLEDGE On order of the Mayor, the City Council convened at 9:37 a.m., with Councilmember Holbrook absent. Estela Rodriguez and Sonia Ramos led the assemblage in the Pledge of Allegiance. CLOSED SESSIONS Member of the public Denise Barton commented on closed sessions. On order of the Mayor, the City Council recessed at 9:39 a.m., to consider closed sessions and returned at 12:07 p.m., with Councilmember Holbrook absent, to report the following: 1 -A: Public Employee Evaluation. Title of Employees: City Manager The Mayor reported that the Council completed the City Manager's evaluation. STUDY SESSION: 4 -A: Changes to Boards and Commission Processes - recommendation COMMISSIONS AND that City Council: 1) review and comment on potential revisions to the BOARDS PROCESSES current application, recruitment, screening and recommendation process for new board and commission members for Council consideration and direct staff to implement the proposed changes; and 2) direct staff to evaluate October 26, 2013 current boards and commissions and return with recommendations regarding meeting frequency and strategies to reduce duplication and strengthen roles and responsibilities, was presented. Members of the public Ravenous Catalyst and Patricia Hoffman commented on the item. Discussion ensued on the merits of the recommendation including, but not limited to the evaluation of commissions and questions on commission applications. Motion by Councilmember Winterer, seconded by Councilmember Davis, to provide staff direction. The motion was approved by the following vote: AYES: Councilmembers McKeown, Winterer, Davis, Vazquez, Mayor Pro Tern O'Day, Mayor O'Connor NOES: None ABSENT: Councilmember Holbrook STAFF 8 -A: Public Speaker Time — recommendation that City Council retain ADMINISTRATIVE the current practice requiring public speakers to speak on their own behalf, ITEMS: and not permitting donation of time from one speaker to another, was PUBLIC SPEAKER TIME presented. Members of the public Denise Barton, Ravenous Catalyst, and Zina Josephs spoke generally in opposition of the recommendation. Considerable discussion ensued on topics including, but not limited to current methods of public speaker input, coordination of presentations, practical considerations regarding donation of time. Motion by Councilmember McKeown, seconded by Councilmember Winterer, to direct staff to draft a procedure for allowing voluntary consolidation of public testimony and to return to Council with that procedure. The motion failed by the following vote: AYES: Councilmembers McKeown, Winterer, Vazquez NOES: Councilmember Davis, Mayor Pro Tern O'Day, Mayor O'Connor ABSENT: Councilmember Holbrook Motion by Councilmember Winterer, seconded by Councilmember McKeown, for a one year pilot to allow speakers to yield their time to one other speaker and have no more than 4 minutes total. 2 October 26, 2013 Councilmember Winterer clarified that under his motion, the 6 minute maximum per person per meeting would still apply, so if a person spoke for 4 minutes, they would only have 2 minutes left for speaking on other items. He also clarified that the person who donated their time would be required to be there personally and make the representation regarding donation to the clerk. Motion to amend by Councilmember Davis, to require the City Clerk during the pilot program to keep track of the number of donations of time and the overall time taken by the donors to help determine if the process allows for more or less efficient use of time. The proposed amendment was accepted as friendly to the maker and seconder. The motion was approved by the following vote: AYES: Councilmembers Vazquez, Davis, Winterer, McKeown NOES: Mayor Pro Tem O'Day, Mayor O'Connor ABSENT: Councilmember Holbrook AGENDA 8 -B: Agenda Management Practices and Council rules of Order and MANAGEMENT Procedure — recommendation that City Council: 1) review and comment on the proposal to calendar agenda items for the next available meeting date; 2) review and comment on the proposed process to request that items be pulled from the agenda; 3) review and comment on the proposed pilot to establish a set time for the Council to engage in agenda management; 4) consider adopting a resolution amending the Rules of Order and Procedure for the Conduct of City Council meetings to modify the procedure for continuing past 11:00 p.m.; 5) repeal Resolution No. 10643 (CCS) which established the present rules; 6) review and comment on the practice of hearing of continued items; and, 7) review and comment on options for scheduling second readings and ordinances, was presented. Members of the public Denise Barton, Ravenous Catalyst, Catherine Eldridge, Zina Josephs and Patricia Hoffman spoke generally in opposition to the recommended action. Considerable discussion ensued on topics including scheduling items, scheduling of second readings of ordinances, agenda management, continuing meetings past 11 p.m., and hearing continued items. Motion by Councilmember Winterer, seconded by Councilmember Davis, to approve the staff recommendation with the following changes: removing rules requiring a motion to continue the Council meeting after a certain time, continuing the current practice regarding continued items, and continue holding second readings at the next meeting. 3 October 26, 2013 Motion to amend by Councilmember McKeown, to add direction to the motion to evaluate when and if a sununer hiatus should take place. The motion as friendly to the maker and seconder.
