A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA AUTHORIZING THE SUBMITTAL OF AN
APPLICATION TO THE CALIFORNIA COASTAL COMMISSION LOCAL COASTAL
PROGRAM PLANNING GRANT PROGRAM FOR FUNDING IN FISCAL YEAR 2013-
14 AND THE EXECUTION OF DOCUMENTS NECESSARY TO PARTICIPATE IN THE
PROGRAM
WHEREAS, the City of Santa Monica, a municipal corporation, wishes to apply
for and receive an allocation of funds through the California Coastal Commission
( "Coastal Commission ") Fiscal Year (FY) 2013 -14 Local Coastal Program (LCP)
Planning Grant Program; and
WHEREAS, the Budget Act of 2013 provides an appropriation of $1 million for
Coastal Commission grants in FY13 -14 to local governments to support LCP planning,
and
WHEREAS, the California Coastal Commission, under the authority of the
California Coastal Act, may provide financial assistance to support coastal planning and
has approved a competitive grant program to provide such financial assistance for LCP
planning; and
WHEREAS, the goal of the grant program is to develop new or updated LCPs in
conformance with the California Coastal Act and to reflect current circumstances and
new scientific information, including new understandings and concern for the effects of
climate change, and
WHEREAS, grant proposals submitted under this grant program must provide for
the completion of land use planning and /or zoning work to either achieve submittal for
certification of a Local Coastal Program (LCP) or an Area of Deferred Certification
(ADC) or of an LCP Amendment to significantly update a certified LCP or LCP
segments, including with special emphasis on effects of climate change and sea -level
rise;
WHEREAS, the City of Santa Monica's LCP Land Use Plan was adopted in 1992
and the City does not yet have an effectively certified LCP; and
WHEREAS, the City of Santa Monica desires to pursue a project that would
update the LUP based on new access created by the Exposition Line Light Rail project
and new General Plan policies and would result in the completion and submittal for
certification by the California Coastal Commission of an LCP and desires to assume
permit issuing authority,
WHEREAS, the City of Santa Monica commits to and agrees to fully support a
planning effort intended to complete a certified LCP pursuant to the provisions of the
California Coastal Act, with full public participation and coordination with the Coastal
Commission staff.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Manager or Manager's designee is authorized to submit to
the Coastal Commission an application to participate in the LCP Planning Grant
Program in response to the invitation for applications for FY13 -14, requesting a funding
allocation in the amount of $250,000 to update the LCP -LUP and develop an
Implementation Plan based on new transportation access and for consistency with
current City policy as expressed in the General Plan Land Use & Circulation Element
(LUCE) and specific plans within the City's Coastal Zone.
SECTION 2. If the application for funding is approved, the City of Santa Monica
hereby agrees to the conditions contained in the grant application package and to use
the LCP Planning Grant Program funds for eligible activities in the manner presented in
the application as approved by the Coastal Commission and in accordance with
program Guidelines.
SECTION 3. The City Manager or Manager's designee is authorized to conduct
all negotiations and to execute in the name of the City of Santa Monica all necessary
applications, contracts and agreements and amendments thereto required by the
Coastal Commission for participation in the Grant Program.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
