R10202f. \atty \m un i\i aws \mj m\trib utesreso. doc City Council Meeting 3 -13 -07 Santa Monica, California RESOLUTION NUMBER 10202 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA GOVERNING THE PLACEMENT OF MEMORIALS AND TRIBUTES IN CITY PARKS WHEREAS, the City's parks promote the general health and welfare by providing opportunities for active recreation and the passive enjoyment of nature and its restorative powers; and WHEREAS, the City's parks are scarce and shared resources which must be preserved and enhanced in ways that benefit the entire community; and WHEREAS, members of the public wish to commemorate or pay tribute to loved ones by supporting parks and open spaces and by memorializing their loved ones in parks and open spaces; and WHEREAS, the Recreation and Parks Commission has recommended a policy which will permit members of the public to fulfill these wishes, protect shared use and enjoyment of the parks, and generate revenue for park, beach and open space improvements which will benefit the entire community; and WHEREAS, the City Council wishes to adopt the policy which will facilitate commemorations and thereby generate revenue but also protect the aesthetics of parks 1 and open spaces and ensure that they, and the amenities they include, serve the general welfare; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. A commemoration program is hereby established whereby members of the public may pay tribute to others through donations used to support the enhancement of public open spaces in Santa Monica. SECTION 2. The program shall include the provision of special tribute certificates to all persons who make a minimum contribution of $25 to the City for use in funding open space improvements. SECTION 3. The commemoration program shall include the opportunity for community members to donate the total cost of the City acquiring and installing open space amenities, such as benches or water fountains, which the City has previously identified and listed as necessary or desirable. Donors who contribute the total cost of acquiring and installing an amenity of significant value will be acknowledged with a plaque; other donors will receive a special tribute certificate. For purposes of this program, a significant amenity shall be one valued at more than $750.00. This amount effectuates the goals of facilitating commemorations, protecting and enhancing open space aesthetics, and generating revenue for needed open space amenities. SECTION 4.The commemoration program shall also include the opportunity for community members to donate the total cost of acquiring, planting and caring for a new K tree in a public open space. Donations of trees will be acknowledged with a special tribute certificate. Donations of trees planted in streetscapes or park improvements specifically designed for plaque holders will be acknowledged with plaques. SECTION 5. In order to implement this program, City staff shall formulate regulations Those regulations shall, among other things: (a) insure that the selection and placement of all public improvements, including trees and park amenities, is made solely at the City's discretion and solely for the purpose of promoting the general health and welfare rather than individual preferences; (b) make clear that plaques are available on a limited basis and only in conjunction with the total funding of either a tree in an area designed for plaques or an open space amenity which meets the threshold of "significant" and which the City has determined, in its sole discretion, will enhance a public space by benefiting the public; (c) establish standard designs for plaques and standardized options for the language appearing on them; (d) require City staff to maintain and publicize a list of needed open space amenities which may be funded through the commemoration program and specify which items on the list have a significant value; and (e) ensure that the City maintains complete discretion and control over the selection and placement of all plantings and other amenities in its open spaces, including the right to relocate or remove any amenity. SECTION 6. City Council Resolution Number 8758 (CCS) is hereby repealed. 3 SECTION 73he City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
