SR-04-23-2013-3CQ City of City Council Report Santa Mouiea City Council Meeting: April 23, 2013 Agenda Item: 3" To: Mayor and City Council From: Andy Agle, Director of Housing and Economic Development Kathryn Vernez, Deputy City Manager Subject: Sale of a portion of City -owned property at 2525 Michigan Avenue Recommended Action Staff recommends that the City Council authorize the City Manager to negotiate and execute a purchase and sale agreement with the Exposition Construction Authority to sell a 19,389- square foot portion of City -owned property at 2525 Michigan Avenue for the construction and operation of the Exposition Light Rail Transit (EXPO LRT) station. Executive Summary To accommodate the EXPO LRT station at 26th Street and Olympic Boulevard, Expo must acquire a 19,389- square foot portion of City -owned property located at 2525 Michigan Avenue. City staff and Expo staff have agreed to recommend a sale price of $4,076,835, based on the property's appraised fair market value. Background Phase 2 of the EXPO LRT line will connect Downtown Los Angeles to Downtown Santa Monica with three stations in Santa Monica: Olympic Boulevard /26th Street Station (at Bergamot Arts Center); Colorado Avenue /17th Street Station (at Memorial Park), and; the Downtown Terminus Station (at Colorado Avenue /4th Street). Phase 1 of the EXPO LRT line connecting Downtown Los Angeles and Culver City opened in April 2012. Phase 2, extending from Culver City to Santa Monica, is scheduled to open in 2016. The City acquired the nine -acre parcel located at 2525 Michigan /2715 Exposition Boulevard /1800 Stewart Street (Attachment A, Map) from Southern Pacific Transportation Company in 1989. The eastern portion of the City -owned property 1 covering 1800 Stewart Street is approximately four acres and is leased to Agensys, Inc. under a long -term ground lease. The western portion of the site is approximately 5.4 acres and is leased to Bergamot Station, Ltd. This entity manages the Bergamot Station Arts Center, a complex comprised of over 30 art galleries, creative businesses, and a non - profit theater company. Discussion To accommodate the proposed EXPO LRT improvements at the Olympic Boulevard /26th Street station, the Exposition Light Rail Construction Authority (Expo) and its design - builder, Skanska- Rados, have determined that 19,389 square feet of land is needed from City -owned site at 2525 Michigan Avenue. This portion is located along the northern portion of the City -owned site, adjacent to the light rail line. It is semi - rectangular in shape (Attachment B, Property Impact Statement). Due to the EXPO LRT schedule, Expo filed a condemnation to acquire the property quickly, and took possession on December 6, 2012. The light rail station construction required the demolition of two existing structures on the site. Demolition of the buildings occurred on January 28, 2013. Another 12,821 square feet of land on the site will be used as a temporary construction easement (TCE) for 24 months. An additional 7,818 square feet of City - property was also required as a demolition access easement for one month, and was returned to the City after demolition occurred. The City and Expo each hired independent appraisers to determine the property's fair market value. The City's appraiser determined the value to be approximately $4,435,000, including temporary construction easements. Expo's appraisal determined the value to be approximately $3,718,000. City, Metro, and Expo staff have exchanged appraisals and reviewed the underlying assumptions of the appraisals. Based on review of both appraisals, City, Expo and Metro staff recommend a settlement of $4,076,835 as fair compensation for the acquisition. 2 Financial Impacts & Budget Actions Proceeds in the amount of $4,076,835 will be deposited into account 41642.401801. Metro will be responsible for ongoing maintenance of the station itself. Metro's existing ROW is not wide enough to accommodate the dual station platform in this area, thus requiring a partial take. CONSTRUCTION REQUIREMENTS AND TECHNIQUES The subject property has two buildings within the proposed station footprint that will require demolition. The first building is used as a maintenance storage closet and the second building is occupied bytwo art galleries. The larger art gallery called "Track 16" includes an art gallery, a theatre, a book store and a mail order internet business. The second business is a smaller art gallery. The duration of construction is anticipated to be intermittent for approximately 36 months. S. CONSTRUCTION IMPACTS a. DURING CONSTRUCTION 1. Construction activities will include periods where property is used as a lay -down area for equipment, materials and other contractor requirements related to the construction of the 26th Street Station. ii. Buildings, hardscape, and related improvements within the parcel take will be removed during construction. There are currently two (2) buildings located within parcel E2 -1001 that will need to be demolished. ill. Construction activities will disrupt normal vehicular parking and pedestrian traffic within the parcel take area and temporary construction area. Approximately sixty (60) parking spaces will be impacted during the building and hardscape demolition and station construction. (See "AFTER CONSTRUCTION" item ii. for permanent impacts to parking.) iv. Construction activities will be in accordance with City of Santa Monica standards for traffic management. v. Noise, dust, and visual impacts common to construction projects will exist for the duration of construction. Measures will be used to minimize these disruptions. vi. Trucks making deliveries and hauling excavated material may cause traffic congestion in the general area of the site. vii. Construction activity may require access to surrounding areas of the property in orderto protect adjacent structures. viii. Temporary utility disconnections maybe necessary as they will need to be reconfigured when the Track 16 building is demolished. b. AFTER CONSTRUCTION 1. A Metro Dual Platform at Grade Station will be located in the area acquired under parcel E2 -1001. The remaining portion of the parcel will be owned and maintained by the City of Santa Monica. H. The footprint of the existing building to be demolished exceeds the square footage needs of the permanent acquisition area. Approximately 8,100 square feet will be restored to the remaining property after construction is completed. iii. When construction is complete, approximately forty -nine (49) parking spaces will be permanently removed from the area. Additional parking spaces may be added to the 8,100 square feet mentioned in item (ii) above. 6. TYPE OF RIGHT OF WAY Acquisition of fee estate (E2- 1009.) will be required to accommodate the proposed 26`h Street Station. Acquisition of a Right -of -Entry Permit ( "ROE ") containing approximately 7,818 square feet will be required for building demolition. Use of the ROE shall cover a one (1) month time period.
