Recommended Action Staff recommends that City. Council authorize the City Manager to negotiate and execute a settlement agreement with El Camino Community College District (District) for Fire Fighter In- service Training Program in which the City will receive a total amount of $19,707. Executive Summary The Fire Department has a relationship with El Camino Community College District to collaboratively provide Fire Fighter In- service Training Programs for current Fire Department employees. The Fire Department provides City Fire employees training opportunities for which participants receive college credit for the trainings and both the District and the City receive state funding. The City is reimbursed by the District for a portion of the training costs. Due to a reduction in the State's funding the District is offering a settlement agreement in the amount of $19,707 to close out the funding owed to the City for FY 2011 -12. Discussion The Fire Department currently has an agreement with El Camino Community College District to collaboratively provide Fire Fighter In- service Training Programs for current Fire Department employees. The Fire Department provides City Fire employees training opportunities for which firefighter participants receive college credit for the trainings and both the College and the City receive state funding. Under the terms of the agreement with the District, the District reimburses the City for the City's administrative costs using a portion of the District's State funding associated with the program. 1 In FY 2011 -12, the El Camino Community College District was audited by the State regarding the adequacy of their attendance records that are required to be maintained as a condition of receiving State apportionment. As a result of the audit, the State reduced the District's funding for the fall semester, which, in turn, affected the District's ability to reimburse the City for its administrative costs under the terms of the Agreement. The District was unable to provide staff with training courses for the spring semester and unable to make payments on the fall semester invoice. The District has, however, made a reasonable offer to the City, in an amount equal to $19,707, to cover the City's administrative costs associated with the training program for the fall semester. The amount represents 92% percent of what the City projected to receive for the fall semester. This amount is equivalent to the prior years' average actual revenue received which is based on actual training hours. The District has asked that the City enter into a Settlement Agreement whereby acknowledging that it will not seek further reimbursement from the District for the fall semester. The District is currently in the process of developing changes to the program to comply with State requirements so that this program can continue. Staff and the District are currently working together to ensure the program complies with all State requirements in the future. Currently the program is not active and staff is awaiting direction from the District regarding reinstatement. E Financial Impacts & Budget Actions The revenue received from El Camino College District is budgeted in account 01312.400490. In FY 2011 -12 the projected revenue budget for training provided was $63,824; $38,872 was received. This settlement in the amount of $19,707 is for training provided from 9/26/2011 to 1/27/2012 in FY 2011 -12; this amount is only slightly lower than originally projected revenue. The settlement revenue will be deposited into account 01312.400490.
