r-10733Council Meeting: February 26, 2013 RESOLUTION NUMBER Santa Monica, California l o73j (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING RESPONSIBILITY FOR PAYMENT FOR ANNUAL FIRE INSPECTIONS OF COMMERCIAL BUILDINGS WHEREAS, California Health and Safety Code Sections 13217, 13145, 13146, 13146.1, 13146.2, 13146.3, 17921, 17951, 17962, and California Fire Code Sections 104 and 106 authorize local Fire Departments to conduct regular fire inspections and recover the costs associated with such inspections; and WHEREAS, Chapter 2.72 of the Santa Monica Municipal Code authorizes the establishment and imposition of fees for City inspections; and WHEREAS, consistent with State and local law, the City of Santa Monica Fire Department regularly conducts annual inspections of various buildings and structures to determine compliance with applicable Fire Code or Building and Safety requirements; and WHEREAS, the City conducted a fee study in 2010 to determine the fees to be charged for inspection services provided by the Fire Department; and WHEREAS, the City fees derived from the study included a tiered fee for commercial inspections and a tiered fee, based on the number of units, for residential inspections; and 1 WHEREAS, tiered fees are appropriate for commercial structures and more equitably reflect the actual cost of undertaking particular inspections. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The fees described in Exhibit A attached to this Resolution are established for the Fire Department. SECTION 2. Consistent with the legal authorities cited above, the owner of the structure subject to annual fire inspections shall be responsible for the payment of the fire inspection fees as set forth in this Resolution. SECTION 3. Any provision in Resolution Number 10620 (CCS), and any other resolution adopting, amending, or relating to Fire Department fees, which is inconsistent with this Resolution is hereby repealed in its entirety. SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
