The City Council of the City of Santa Monica met in adjourned regular session at the above named time and place which meeting was adjourned from the regularly scheduled meeting in the Council Chamber, City Hall, Santa Monica, at 7:30 o'clock P.M. on October 23, 1973. The pledge of allegiance was given, after which Reverend Richard Baglein, St. Paul's Lutheran Church, gave the invocation. PRESENT: Councilmen: C10 Hoover, Fred M. Judson, Hilliard L. Lawson, John W. Grubb, City Clerk The Clerk reported that the notice of adjournment of the meeting held October 23, 1973 was posted on the Council Chamber door on October 24, 1973 and that the affidavit of posting was on file in the City Clerk's office. The minutes of the meetings held October 9 and 23, 1973 were approved as mailed. Councilman van den Steenhoven introduced members of Girl Scout Girl Scout Troop 149 Troop #49 who were in attendance in preparation of their government merit introduced badge. Mayor Hoover introduced Mr. James D. Williams, newly- appointed James D. Williams City Manager, and presented him with a pair of cuff links as a memento of introduced as newly- the occasion. She also presented a twenty -five year service pin to appointed City Patricia Terrell Brownell, a twenty -year service pin to William S. Montalto Manager and complimented them for their faithfulness to the City. The Clerk read the title to a resolution entitled: ON TO APPROVE AN AMENDMENT TO CNTRACT RF /TT.iF.FN TWIZ John Jurenka spoke in opposition to the proposed amendment to the State Employees' Retirement Contract and presented an initiative petition that is intended to be circulated in the City placing certain restrictions on Municipal Employees' retirement benefits. Several persons spoke, after which Mr. van den Steenhoven moved that the request be granted provided a rental fee of $125.00 be paid for the hangar proposed to be used for a portion of the activities, that a policy of insurance satisfactory to the City Attorney be obtained and that the Association agree to clean up the hangar after its use. The motion was seconded by Mrs. Swink and carried by the following vote: AYES: Councilmen: Swink, Trives, van den Steenhoven, Hoover NOES: Councilmen: Judson, Lawson, McCloskey ABSENT: Councilmen: None Resolution 4437 Subdivision map Tract No. 27752 Celebration to commemorate 50th Anniversary of the Airport to be held at Airport Mr. Trives moved to accept the recommendation of the Airport Civil Air Patrol Commission and grant the request of the Civil Air Patrol for free parking to get free parking for its command /facilities trailer at the Airport, provided insurance for its command/ satisfactory to the City Attorney is obtained and further that the permit facilities trailer be cancelable at any time. The motion was seconded by Mrs. Swink and at the Airport carried unanimously. Reverend Judson moved to accept the recommendation of the Personnel Board and approve the classification specifications of License Inspector Trainee, Parking Structure Watchman and Supervising Building Inspector. The motion was seconded by Mr. Trives and carried unanimously. Dr. Archie M. Morrison, Chairman, Beach Area Study Committee, submitted the Committee's final report and recommendations (36 pages), after which Mr. Trives moved to refer it to the City Manager for study, analysis, establishing priorities, and report within forty -five days. The motion was seconded by Mr. van den Steenhoven and carried unanimously. Reverend Judson moved to approve the recommendation of the Administration and direct the preparation of an ordinance adopting the 1973 Uniform Building Code (together with the 1973 Housing Code) and the 1973 Uniform Fire Code.. The motion was seconded by Mr. McCloskey and carried unanimously. Resolution 4438 Commends Beach Area Study Committee Reverend Judson moved to approve the requests to remodel an Remodel 1525 - 3rd St. office ($500.00) at 1525 - 3rd Street and repair fire damage ($10,000.00) Repair fire damage at at a hotel at 127 Broadway in the moratorium area. Nurseries Miya Plant Growers ($6,913.83) and Miya Plant Growers ($2,405.55), . reject the bid on New Zeland Christmas trees and purchase these on the open market. Councilmen: None ABSENT: Councilmen: None Mr. Lawson moved to accept the Administration's recommendation, dated October 23, 1973, and reject the bids (too high) for clearing and landscaping the Riviera Reservoir slopes and that bids for same be re- advertised later on. The motion was seconded by Mrs. Swink and carried unanimously. Mrs. Swink moved to accept the Administration's recommendation, dated October 16, 1973, reject the bids (only two were received) for the sale of used automotive vehicles and to dispose of them on a negotiated sales basis so that more favorable prices might be obtained. The motion was seconded by Mr. Trives and carried unanimously. Purchase communications Reverend Judson moved to accept the Administration's recom- eauioment from R.C.A. mendation, dated October 25, 1973, and purchase communications equipment Communications and from R.C.A. Communications and Electronics, Inc., lowest and best bidder, Electronics, Inc. in the amount of $37,288.00. M. C. Clunes commented on the administration and billing of billing of refuse the refuse collection service. collection service The Director of Public Works stated that the Municipal Code sections pertaining to and operation of the service were being studied and that a report would be forthcoming. Mr. Clunes also stated that he had an affidavit to the effect that City forces had picked up illegally twenty tons of refuse from one of the top administrators in the City but that he was not at liberty to publicly disclose the person's name. The members of the Council recessed to an executive session, with Mr. Clunes in attendance, to determine what, if any, legal action should be taken. The Council meeting was reconvened. Mrs. Frances Daly reviewed an offer, dated October 30, 1973, on behalf of DCB Associates (1323 - 12th Street, Santa Monica) to manage the Newcomb and Municipal Piers. Mr. Trives moved that the offer be accepted for file along with the others that are on file. The motion was seconded by Mrs. Swink and carried unanimously. In answer to a query from J. Ray Gallagher, the City Attorney and Fire Chief commented on the investigation, etc. of sections of the Fire Code. The Administration was requested to investigate and make recom- mendations regarding the installation of as well as the removal of meters, also the enforcement of the "No Parking" along various streets in the City as pointed out by Ulysses Gibson. Contract 2090 Mr. McCloskey moved to accept the proposal, dated October 18, Harry L. Nourse Audit 1973, from Harry L. Council to recognize Attorney Marvin Levin, representing the owners of the building, Old Public Library commented on the owner's desire to demolish the building and construct Building as a Santa another building in its place. Monica Landmark After William D. Rome, City Building Officer, again pointed out that the building had been declared unsafe for public assemblage, Mr. McCloskey moved to reaffirm the Council's position that the City has no interest in the building and further that the motion was again being made merely to emphasize the Council's position originally expressed, on September 25, 1973, when the matter had been put on the agenda but the person requesting same was not in attendance at that Council meeting. The motion was seconded by Mr. Lawson and carried with Councilman van den Steenhoven voting "NO ". Garth Sheriff, on behalf of The Santa Monica Centennial Landmark Protectors, reviewed an ordinance being considered by the Planning Commission proposing the creation of an architectural review board and urged the Council to consider it along with some suggested changes. Mr. Trives moved to refer the ordinance with the suggested changes to the City Manager for review and comment. The motion was seconded by Mr. Lawson and carried with Councilman McCloskey voting "NO ". Mr. McCloskey moved to instruct the City Attorney to prepare an City .Attorney to amendment to Resolution No. 4423 (CCS) (Council Rules of Order for the amend Resolution 4423 Conduct of Council Meetings) so that agendized items of a previous Council so that agendized meeting not taken up at that meeting will be considered at the beginning items of a previous of the next meeting.
