r10715City Council Meeting 10 -23 -2012 RESOLUTION NO. 10715 (CCS) (CITY COUNCIL SERIES) Santa Monica, California A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA SETTING VARIOUS FEES IN THE PLANNING AND COMMUNITY DEVELOPMENT DEPARTMENT WHEREAS, the City of Santa Monica recently completed a fee analysis of existing and proposed City fees charged for various permits and for providing various services in the Planning and Community Development Department; and WHEREAS, it is the policy of the City of Santa Monica to charge for the full costs of services provided by City Staff when such services benefit individual users rather than members of the community as a whole; and WHEREAS, Ordinance Number 1754 (CCS) (the "Ordinance "), adopted July 12, 1994 governs the setting" of the amount of user fees or fees for services provided to or for the benefit of particular individuals rather than the general public and allows such user fees or fees for services to be set by ordinance, by a resolution adopted by the City Council, or by any other means authorized by law; and WHEREAS, the City desires to revise and establish permit and user fees charged by the Planning and Community Development Department by this resolution in order to preserve public resources for the benefit of the community as a whole and avoid diverting these resources to the benefit of individuals; and WHEREAS, the City has calculated the cost of providing various Planning and Community Development Department permits and services; and WHEREAS, the fees established by this Resolution are no more than necessary to recover the cost of the service provided. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1: Resolution No. 10487 (CCS) adopted June 15, 2010 is hereby amended to set user fees for services provided by the Planning and Community Development Department, as shown in the attached Tables. SECTION 2: All fees adopted by Resolution 10487 (CCS) and all other resolutions will remain in effect except for the new and revised fees set by this resolution. SECTION 3: Commencing on July 1, 2013 and on July 1 of each fiscal year thereafter, all fees established by this resolution, unless noted otherwise, shall be administratively revised and increased annually by a factor equal to the difference in the Los Angeles- Anaheim - Riverside Consumer Price Index for Wage Earners and Clerical Workers for the twelve (12) month period February through February of the prior fiscal year, except that any such administrative revision shall not be less than any annual cost of living adjustment provided to the employees of the City of Santa Monica through Memorandums of Understanding entered into between the City and the employees' bargaining representatives for the comparable fiscal year, and in no event shall the annual administrative revision be less than zero percent (0 %). SECTION 4: The fees governed by Section 66013 of the State Government Code (the Mitigation Fee Act) and the permit and processing fees for services governed by Section 66014 of the Mitigation Fee Act set by this resolution shall be effective on January 1, 2013, which is at least sixty (60) days after adoption, in accordance with Government Code section 66017. SECTION 5: The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
