r10707City Council Meeting: October 2, 2012 RESOLUTION NUMBER 10707 (City Council Series) Santa Monica, California (CCS) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE STATE OF CALIFORNIA, OFFICE OF ENVIRONMENTAL HEALTH HAZARD ASSESSMENT FOR RISK ASSESSMENT SERVICES WHEREAS, the protection, preservation and restoration of the natural environment is a guiding principal of the Santa Monica Sustainable City Plan; and WHEREAS, the protection and enhancement of environmental and public health by minimizing; and WHEREAS, the possibility of eliminating the level of pollutants entering the air, soil, and water has been identified as a goal of the Sustainable City Plan; and WHEREAS, the City is authorized to enforce corrective action requirements in response to unauthorized releases; and WHEREAS, following full and satisfactory characterization of a site with confirmed subsurface contamination, an accepted remedial option is demonstration that the contaminated soil, if left in place, would not present a potential public health or environmental hazard by conducting an environmental fate and risk determination 1 analysis for the contaminants at a site, including an evaluation of the potential for movement of the contaminants into adjoining soil or groundwater and the associated public health or environmental effects; and WHEREAS, the City desires technical assistance in risk assessment services; WHEREAS, the City has determined that it is in its best interest to utilize the services available through the State of California, Office of Environmental Health Hazard Assessment to assist in making its final determination with respect to site closure. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Manager or designee is hereby authorized to execute in the name of the City of Santa Monica a Professional Services Agreement for On -Call Risk Assessment with the State of California, Office of Environmental Health Hazard Assessment. SECTION 2. The City Clerk shall certify to the adoption of this Resolution, and henceforth and thereafter the same shall be in force and effect. F Adopted and approved this 2nd day of October, 2012.
