SR-10-23-2012-3QCity Report City of Santa Monica' City Council Meeting: October 23, 2012 Agenda Item: 3 °Q To: Mayor and City Council From: Andy Agle, Director of Housing and Economic Development Kate Vernez, Deputy City Manager Subject: Expo Compensation for City -owned property at 1601 14th Street Recommended Action Staff recommends that the City Council authorize the City Manager to accept compensation of $1.41 million for the City's dedication of an 8,297- square foot portion of City -owned property at 1601 14th Street as public right -of -way associated with the Exposition Light Rail Transit project. Executive Summary The alignment of the new Exposition Light Rail Transit (EXPO) lines requires the dedication of 8,297 square -feet of City -owned property at 1601 14th Street as public right -of -way. Staff recommends a compensation amount of $1,410,000 based on the appraisals commissioned by the City and the Exposition Construction Authority (Expo). The 8,297 square feet is proposed to become public right -of -way (sidewalk and street) in order to facilitate the implementation of the EXPO line. Background The 127,971- square foot, City -owned site at 1601 14th Street is used by the City as a maintenance and facilities yard. On October 2, 2012, Council authorized the City Manager to negotiate and execute a compensation agreement for 8,297 square feet of land and to work with Expo to dedicate it as public right -of -way. Discussion In order to accommodate the proposed EXPO LRT station improvements near 17th Street and Colorado Avenue, Expo and its design - builder, Skanska- Rados, have determined that approximately 8,297 square feet of land located on the northeast portion of the City -owned site needs to be dedicated as right -of -way. The part dedicated 0 will be used for a portion of the eastbound lane along Colorado Avenue and the adjacent 10 -foot sidewalk. The City and Expo each hired independent appraisers to determine the property's fair market value. The City's appraiser, Grubb & Ellis, valued the entire site at $175 per square foot and calculated the value of the 8,297- square foot area to be $1,451,975. Metro's /Expo's appraiser, Norris Realty Advisors, valued the entire site at $165 per square foot and calculated a value of $1,370,000 for the dedicated area. City and Expo staff have exchanged the appraisals and reviewed the underlying assumptions of the appraisals. The appraisal reports differ in value by less than six percent. Based on review of both appraisals, staff believes that $1.41 million reflects fair compensation for the City's dedication of the property as public right -of -way. Financial Impacts & Budget Actions Compensation for City -owned property at 1601 14th Street in the amount of $1,410,000 will be deposited into account 01224.401870. Expo will be responsible for constructing the associated public improvements. LOCATION AND DESCRIPTION Parcel Plat E2 -0606, containing 8,297 sq. ft. is a semi - rectangular shaped parcel that is east of 14th Street and South of Colorado Ave., in the City of Santa Monica (see Exhibit C). The site appears to be developed with a multiple industrial buildings that face Colorado Avenue. The City of Santa Monica is currently using this property as a city maintenance facility. 2. NEED FOR THE PROPERTY The existing City of Santa Monica (CSM) right -of -way is located along Colorado Ave. near the back of the sidewalk. The proposed public right -of -way is south of the existing public right -of -way. Please see Exhibit C for the locations of the proposed right -of -way. The Project's rail line will transition around the 17th street station which causes the left track to shift south towards the E2 -0606 parcel. The property is needed in order to maintain the eastbound lane along Colorado Ave., thus requiring a partial take. Exhibit A, Legal Description, Exhibit B, Plat, and Exhibit C, Plan and Profile Set Drawings, are attached. 3. DESIGN REQUIREMENTS The EXPOSITION METRO LINE CONSTRUCTION AUTHORITY selected the EXPOSITION LRT PROJECT PHASE 2 and the location of the alignment within the City of Santa Monica. CONSTRUCTION REQUIREMENTS AND TECHNIQUES The subject property has three buildings along Colorado Ave. The current design will require the demolition of two existing buildings, avoiding the third building on the South /East corner of 14th St. and Colorado Ave. The duration of construction is anticipated to be intermittent for approximately 36 months. 5. CONSTRUCTION IMPACTS a. DURING CONSTRUCTION L Construction activities will include periods where property is used as a lay -down area for equipment, materials and other contractor requirements related to the construction of the overall project. ii. Buildings, Hardscape, and related improvements within the parcel take will be removed during construction. There are currently two (2) buildings located within parcel E2 -0606 that will need to be demolished. iii. Construction activities will disrupt normal vehicular and pedestrian traffic on Colorado Ave between 14th street and 16th Street. Proper mitigations are required from the contractor during construction. iv. Construction activities will be in accordance with City of Santa Monica standards for traffic management. v. Noise, dust, and visual impacts common to construction projects will exist for the duration of construction. Measures will be used to minimize these disruptions. vi. Trucks making deliveries and hauling excavated material may cause traffic congestion in the general area of the site. vii. Construction activity may require access to private properties in order to protect adjacent structures. b. AFTER CONSTRUCTION L A +/- 10' -0" sidewalk will be located in the area acquired under parcel E2- 0606. The remaining portion of the parcel will be owned and maintained by the City of Santa Monica. 6. TYPE OF RIGHT OF WAY Acquisition of fee estate (E2 -0606) will be required to accommodate the proposed use for the widening of Colorado Ave. This property will be maintained by the City of Santa Monica. 7. OTHER CONSIDERATIONS Business tenants occupying the property may be eligible for relocation assistance which will follow the Uniform Relocation Assistance and Real Property Acquisition Regulations and Amendments. 8.
