SR-10-23-2012-3DCity of Santa Monica' City Council Report City Council Meeting: October 23, 2012 Agenda Item: ,3—D To: Mayor and City Council From: Martin Pastucha, Director of Public Works Subject: Professional Services Agreement Modification for Universally Accessible Playground Project Recommended Action Staff recommends that the City Council authorize the City Manager to negotiate and execute a second modification to Professional Services Agreement No. 9388 (CCS) in the amount of $10,378 (includes a 10% contingency) with Katherine Spitz Associates, a California -based company, to provide additional scope of work to complete the design and permitting process for the Universally Accessible Playground Project. This will result in a new agreement amount not to exceed $130,416. Executive Summary During the construction documentation and initial plan check phases of the Universally Accessible Playground Project, the project team discovered that it would be more cost effective to use the existing irrigation lines and not add additional lines resulting in savings of $25,000 in construction costs. This change also requires design adjustments to the hardscape and planting materials, as well as the addition of one concrete seat wall and two picnic tables. Staff is requesting approval for a second agreement modification in the amount of $10,378 for a total agreement amount not to exceed $130,416, with Katherine Spitz Associates to complete the design and permitting process. Background The City plans to construct an approximately 20,000- square -foot universally accessible children's playground on the site immediately south of the southernmost beach parking lot of the City. The address of the site is 2900 Ocean Front Walk. It is bounded by the Ashland Avenue pedestrian way and the City beach parking lot (Lot 5 at 2600 Barnard Way) to the north, Barnard Way to the east, the Marvin Braude Bike Path (bike path) and the Pacific Ocean to the west, and Ocean Front Walk and the bike path to the 1 south. The proposed playground site is presently occupied by a sand play area, picnic tables, turf area, and palm trees. On June 28, 2011, Council approved Professional Services Agreement No. 9388 (CCS) with Katherine Spitz Associates, Inc. (KSA), in an amount not to exceed $120,038, to provide design and preconstruction services for the Universally Accessible Playground Project. On July 5, 2012, the first modification to Professional Services Agreement No. 9388 (CCS) was executed within authorized contingency budget for additional design services, which included conducting geotechnical survey of the project site, and preparing the survey reports and site plans. On September 11, 2012, Council approved Construction Contract No. 9644 (CCS) with Micon Construction, Inc., in an amount not to exceed $998,481, for construction of the Universally Accessible Playground Project. Discussion During the construction documentation and initial plan check phases of the project, the project team identified design adjustments to reduce the overall project cost by approximately $25,000. Additionally, there would be savings in maintenance costs over time. These additional savings result from the value- engineering efforts that require a second modification to Professional Services Agreement No. 9388 (CCS) in the amount of $10,378. Changes in the design include: • Modification to irrigation system to use existing four irrigation lines and not add additional lines. • Adjustments to hardscape and planting materials. • Addition of one concrete seat wall and two picnic tables, which require input from the structural and civil engineering sub - consultants. • Geotechnical services consultant to provide review and signature to the structural drawings, per the request of City's Building & Safety Division. 6 Following Council action on the additional services from the second modification, KSA will complete the construction document plans and permit corrections for the playground. Construction is scheduled to begin in October 2012. Financial Impacts & Budget Actions The second modification to be awarded to Katherine Spitz Associates is $10,378, for a new agreement total not to exceed $130,416. Funds are available in the FY2012 -13 Capital Improvement Program budget in account C116011.589000.
