SR-10-02-2012-3M 418-003/506-001-04City Council Meeting: October 2, 2012 Agenda Item: 3M To: Mayor and City Council From: Martin Pastucha, Director of Public Works Subject: Dedication of Public Right -of Way on Colorado Avenue between 14th Street and 17th Street for the Exposition Light Rail Transit (EXPO LRT) project. Recommended Action Staff recommends that the City Council: Authorize the City Manager to negotiate and execute an agreement for sale of a 8,297 square -foot portion of City -owned property at 1601 14th Street (Colorado Yards) to the Los Angeles County Metropolitan Authority (Metro) at fair market value, for construction of public improvements and for subsequent dedication as public right -of -way to accommodate EXPO LRT. 2. Authorize the City Manager and City staff to work with the Exposition Construction Authority (Expo) to develop the future public right -of -way improvements per the approved legal description and associated exhibits depicting the areas of the realignment of the street and sidewalk (See Exhibits A, B, D, and E). Executive Summary In order to accommodate the proposed EXPO LRT station improvements near 17th Street and Colorado Avenue, existing Metro -owned and City -owned property adjacent to Colorado Avenue must be dedicated as public right -of -way (see Exhibits C & F showing current design). The alignment of the new EXPO LRT requires a partial acquisition of City -owned property at 1601 14th Street and a subsequent dedication for public right -of -way. It is critical that an agreement be reached expeditiously between the City and Metro regarding the sale of this City -owned property to Metro and for the right -of -way to be ultimately dedicated in order to accommodate the implementation of the EXPO LRT including the rearrangement of various utilities in the area that have to be completed before the light rail line and station can be constructed. Background The EXPO LRT line will connect from Downtown Los Angeles to Downtown Santa Monica with three stations in Santa Monica: Olympic Avenue /26th Street Station (at Bergamot Arts Center), Colorado Avenue /17th Street Station (at Memorial Park) and Santa Monica Beach & Downtown Terminus Station (Colorado Avenue /4th Street). Expo is designing and building the line, and it will be turned over to Metro for operation following completion and testing. Phase 1 of the line to Culver City opened in April 2012, just as construction began on Phase 2 to extend the line to Santa Monica. Phase 2 of the Expo line is scheduled to open in early 2016. Discussion Expo selected the EXPO LRT Phase II location and alignment along the Colorado Avenue corridor within the City. The Expo and its design - builder, Skanska -Rados Joint Venture (SRJV) have completed pre -final design (85% plan completion) on the Colorado Avenue /17th Street Station improvements and are nearing final design (100% plan completion) on the public right -of -way improvements in the surrounding areas adjacent to the station which include roadway, utility, parkway and sidewalk improvements. Through much discussion, the City, Expo, and SRJV have agreed in principle to the proposed street alignment and related streetscape and utility improvements. Dedication plats (see Exhibits B & E) are shown to reflect and outline the limits of additional public right -of -way area needed for public improvements on what was previously private property. Construction of the Colorado Ave /17th Street Station necessitates widening of the existing public right of way in order to maintain vehicular traffic lanes. Widening of the public right -of -way would be accomplished as follows: 1. On behalf of Metro, Expo would purchase parcel E2 -0606, identified in Exhibits A and B as an 8,297 square feet portion of City -owned property located at 1601 14th Street. This real estate transaction between the City and Metro is currently under negotiation and will be brought to the City Council for approval of final terms. 2. Expo would construct the public improvements on parcel E2 -0606. 3. Expo would construct the public improvements on parcel E2 -0609, identified in Exhibits D and E as an 18,284 square -foot portion of Metro -owned property located at 1610 Colorado Ave. RIA 4. Upon completion of public improvements, parcels E2 -0606 and E2 -0609 would be dedicated as public right -of -way and accepted by the City Manager as authorized under the current Municipal Code. The scope of work for the street and station improvements in this area would include completion of final design documents (final 100% plans for station, street and private /public utility improvements) and construction of these improvements. Street dedication plats outline the limits of work to be completed within the partially dedicated area of each respective parcel. Financial Impacts & Budget Actions The City property will be sold to Metro at current fair market value as determined by an appraisal. The dedication of additional public right -of -way on Colorado Avenue between 14" and 17th Streets will have minimal ongoing financial impact to the City as the additional right -of -way is required in order to accommodate the light rail station within Colorado Avenue just west of 17th Street. Metro will be responsible for the maintenance of the station itself.
