Subject: Agreement with the State of California, Office of Environmental Health
Hazard Assessment for Risk Assessment Services
Recommended Action
Staff recommends that the City Council adopt the attached resolution authorizing the
City Manager to enter into an agreement with the State of California, Office of
Environmental Health Hazard Assessment ( OEHHA), for Risk Assessment Services.
Executive Summary
The City is seeking technical assistance on an as- needed basis from the State of
California OEHHA in the area of environmental risk assessment to satisfy corrective
action requirements resulting from unauthorized releases from underground storage
tanks located in Santa Monica. The costs of any needed assistance from OEHHA will
be charged to the owners of the respective properties that are responsible for the
underground storage tanks.
Discussion
The City is authorized by the State of California to enforce corrective action
requirements imposed by the State Water Resources Control Board in response to
unauthorized releases from underground storage tanks within the city of Santa Monica.
After a complete site investigation has been performed characterizing the extent of
subsurface contamination, an accepted remedial option allows for contamination to be
left in place only after demonstrating that it would not present a potential public health or
environmental hazard by conducting an environmental fate and risk determination

the City's costs and expenses are anticipated to be greater than the deposit, the City
shall notify the responsible party in writing for the additional amount due.
