Authorize the City Manager to negotiate and execute a contract with Micon Construction, Inc., a California -based company, in an amount not to exceed $998,481 (includes a 10% contingency) for construction of the Universally Accessible Playground Project. 2. Authorize the Director of Public Works to issue any necessary change orders to complete additional work within budget authority. Executive Summary In June 2011, Council approved a design contract with Katherine Spitz Associates, Inc. to provide design and preconstruction services for the Universally Accessible Playground Project at South Beach Park. Following substantial completion of the new playground design, the City issued a Request for Bids on July 19, 2012. A total of four bids were received for construction services. Staff recommends Micon Construction, Inc. as the best bidder for construction of the Universally Accessible Playground Project in amount not to exceed $998,481. Background On June 28, 2011, Council approved a professional services contract with Katherine Spitz Associates, Inc. (KSA) to provide design and preconstruction services for the Universally Accessible Playground Project. Following execution of the agreement with KSA, the design consultant and City staff initiated a community engagement process for the new playground. The process included a community workshop, a focus group, outreach to the special education and preschool communities, coordination with the 1 Disabilities and Recreation & Parks Commissions and on -going outreach to the immediate neighbors of the project site (Sea Colony condominium complex). The specific program and amenities for the new playground were determined through this process, and by working closely with the Disabilities and the Recreation & Parks Commissions and neighborhood stakeholders. Play features were incorporated in the unique design elements to integrate play for children of all abilities. On January 10 2012, Council approved the schematic design and directed staff to move forward with design development. Following Council's approval of the schematic design, the Coastal Commission approved the project on April 11, 2012. Discussion Contractor Selection On July 19, 2012, the City published Notices of Inviting Bids for construction services for the Universally Accessible Playground Project. The bid was posted on the City's on -line bidding site and notices were advertised in the Santa Monica Daily Press in accordance with City Charter and Municipal Code provisions. Over 750 vendors were notified and 49 prospective bidders made requests for bid documents. Three bids were received and publicly opened on August 9, 2012 as follows: Company Micon Construction, Inc. G2K Construction, Inc. MG Enterprises, Inc. Malibu Pacific Tennis Courts, Inc. Base Bid Add Alt Items 1 & 6 Total Bid $884,301 $23,409 $907,710 $1,077,000 $41,000 $1,118,000 $1,142,500 $21,000 $1,163,500 $1,997,000 $43,000 $2,040,000 The bids were evaluated based on price, direct experience on similar projects, record performing public sector work, hourly rates for services, understanding of the project's scope, approach to the work, qualifications of proposed staff, and scheduling of project activities. Based on these criteria, Micon Construction, Inc. is recommended as the FA best bidder to provide construction services for the Universally Accessible Playground Project. Micon Construction, Inc. recently completed projects include Del Norte Park in the City of West Covina, and Lake Gregory Regional Park and Alma Hofman Park in the County of San Bernardino. References were contacted and respondents reported that the contractor performed well on their projects. The California Contractors State License Board verified that contractor's license is current and in good standing. The recommended contract amount of $998,481 includes Alternate Bid Items 1 (concrete seat walls) and 6 (accessible picnic tables), and an overall 10% contingency. Financial Impacts & Budget Actions The contract to be awarded to Micon Construction, Inc. is $998,481 (includes a 10% contingency). Funds are available in the FY2012 -13 Capital Improvement Program Budget at account 0196005.589000.
