A RESOLUTION OF THE CITY COUNCIL FOR THE
CITY OF SANTA MONICA
AUTHORIZING THE SALE OF CITY -OWNED PROPERTY AT 1920 OCEAN WAY TO
BE SOLD IN THE OPEN MARKET
WHEREAS, the property located at 1920 Ocean Way ( "Property ") was
bequeathed to the City of Santa Monica in July 1975; and
WHEREAS, Santa Monica Municipal Code (SMMC) Section 2.24.110 establishes
requirements for sale of City -owned real property, including public notices, presentation
of the bids to City Council, and City Council authority to accept bids or to reject all bids,
and City Council authority to sell the real property in the open market after adoption of a
resolution by at least five affirmative votes; and
WHEREAS, the State of California Government Code Sections 54220 to 54232
establish requirements for the disposition of surplus land owned by local agencies,
including but not limited to a local agency's responsibility to make written offers to sell
the property to various state, county and local entities and a local agency's right to sell
the property at fair market value; and

WHEREAS, pursuant to Resolution Number 10638 (CCS) dated November 22,
2011, the Santa Monica City Council determined the Property to be no longer needed
for any public purpose and deemed the Property to be surplus property; and
WHEREAS, the City sent letters on or about December 15, 2011, to various
state, county and local entities pursuant to California Government Code Section 54222.
The County of Los Angeles submitted the only response declining the offer; and
WHEREAS, on May 3, 2012, and May 5, 2012, the City placed advertisements in
the local newspaper for a Request for Letters of Interest (RLOI) seeking offers to
purchase the Property in compliance with SMMC 2.24.110. In response to the RLOI,
the City has received 15 offers reflecting a range of price, including cash offers, with
various contingencies; land exchange and other noncash offers.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to SMMC 2.24.110, the City Council rejects all offers
submitted pursuant to the RLOI and authorizes negotiation for the sale of the Property
in the open market.
SECTION 2. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
