sr-062612-3hID City of Santa Monica City Council Report City Council Meeting: June 26, 2012 Agenda Item: 3 H To: Mayor and City Council From: Martin Pastucha, Director of Public Works Subject: SCE Easements — OMES (Olympic & Main Electrical System) Ocean Lodge Easement — First Court Alley Electrical Undergrounding Vacation of SCE Easement across Palisades Garden Walk Project Recommended Action Staff recommends that the City Council authorize the City Manager to execute a letter agreement between the City and Southern California Edison (SCE), which contemplates the vacation of an existing underground utility easement across the Palisades Garden Walk and Town Center Project (Project) site, the relocation of SCE utility cables to Main Street with a connection to an existing underground utility duct on Olympic Drive, the creation of a replacement underground utility easement between Ocean Avenue and the Project site, and the creation of an easement to the Ocean Lodge for electrical service originating on City property. Executive Summary SCE has an existing underground recorded utility easement that runs through the Park Project site. City and SCE staff have been communicating over the last two years and reviewing options for this easement, given the age of SCE's utility ducts in the easement area and the City's plans for constructing the park over the easement area. The parties could not agree upon one option and have therefore developed a compromise solution, which would entail abandonment of the existing easement and installation of new utility duct and cables under Main Street, which would be connected to SCE's recently installed utility duct on Olympic Drive. The compromise entails the City's provision of "civil engineering" work for the excavation and installation of the new duct under Main Street, and SCE's provision and "electrical" installation of the cable lines through the new duct and connection to the existing duct on Olympic Drive. The compromise also entails the City's indemnification of SCE costs in the event that the City seeks to relocate this new duct on Main Street within the next ten years and grant of new easement between Ocean Avenue and Main Street with similar conditions to the easement being abandoned under the Project site. The total cost is estimated at $400,000, and will be shared between the City and SCE. The City would pay for 1 approximately $158,487 to construct the civil infrastructure and SCE would pay for the remainder of the cost at approximately $241,513. Background On October 25, 2011, Council approved the Palisades Garden Walk and Town Square design elements plans for a new park. These plans included proposals to vacate and dedicate certain areas of public right -of -way (ROW) within the planned park area. Prior to the Council meeting, the project plans were presented to the following boards and commissions as a courtesy visit or for approval: Architectural Review Board; Coastal Commission; Commission on the Senior Community; Disabilities Commission; Landmarks Commission; Planning Commission; Recreation and Parks commission; and Urban Forest Master Plan Task Force. On February 14, 2012, Council held a public hearing and adopted Resolition No. 10629 to vacate public ROW on Olympic Place South and a portion of First Court Alley and dedicate a new public ROW at 1665 Ocean Avenue. Discussion SCE Utility Easement There is a "L — shaped" SCE utility easement crossing the Project site, which is a 40' wide x 375' long and 40' x 125' long, as depicted in Attachment: Diagram A. SCE has reported that the existing electrical duct banks located in this easement are circa 1930. The original easement agreement language, dated May 10, 1960, gives the property owner (City) the right to build over the easement subject to SCE's right to access its utility lines. SCE expressed concerns that when the Project is constructed, the weight of the park's earth berms would damage the SCE duct banks, which are aging. SCE also expressed interest in having a new duct bank installed on Main Street that would connect to the electrical duct bank recently installed by Related Development for SCE on Olympic Drive for this purpose. After reviewing multiple options, staff recommends relocating the electrical duct banks and easement from the Project site to the public ROW under Main Street. This would ensure reliable service and maintain the parks 2 integrity. The total cost for this relocation effort would be shared between the City and SCE. Furthermore, the existing electrical overhead poles and wires feeding the Ocean Lodge Motel and Chez Jay Restaurant in the First Court Alley area are being removed and undergrounded as part of the Park Project. Electrical service for the Ocean Lodge Motel will now originate on City property and will require an easement for conduits to reach the public ROW in the First Court Alley. Proposal with SCE Both the City and SCE have agreed that relocating the electrical easement to the public ROW on Main Street is the recommended solution. A design concept and cost sharing agreement was drafted by the City and SCE to: • Avoid issues with old SCE infrastructure and potential electrical service disruptions. • Remove SCE electrical equipment and easement from the park. • Provide SCE with a system in the public ROW and utilize existing infrastructure where available. • Share costs between City and SCE. Desiqn Concept (Refer to Attachment: Diagram A) The design concept begins with creating a new Olympic & Main Electrical System (OMES) that connects electrical services from an existing manhole located in the west side of Main Street (in front/City Hall driveway) to: • A new 325 foot duct bank (consisting of 4" to 5" conduits) constructed by the City under Main Street's west parking lane, which intersects with an existing 330 foot duct bank and an electrical vault under the Olympic Drive Extension ROW (installed by The Village Project/Related Development). • An existing 255 foot duct bank located under the First Court Alley (recently installed by Related Development). • A new electrical pull box that would fully connect the new OMES to an existing 1930's duct bank located north of and parallel to the Chez Jay Restaurant (the vacated Olympic Place South Alley). 3 The design concept would also provide undergrounding of overhead electrical lines in First Court Alley, via a new transformer, to distribute 120/240v power to Chez Jay Restaurant and Ocean Lodge Motel. Cost Sharinq The total cost to create the described OMES is estimated at $400,000, and will be shared between the City and SCE. The City would pay for approximately $158,487 to construct the civil infrastructure. SCE would pay for the remainder of the cost at approximately $241,513 to install the electrical equipment including all transformer cables, switches and equipment to power the system. SCE would also be responsible for removing their electrical equipment from the park site and abandoning the easement. Financial Impacts & Budget Actions The City cost ($158,487) associated with the construction of public improvements and relocation of City -owned and private utilities are included in Design -Build Contract No. 9395 (CCS) with W. E. O'Neil, under Direct Owner Costs, as part of the overall Palisades Garden Walk and Town Square Project.
